A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DENYING VARIANCE NO. 1730.
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zoning variance from James
Durante, John Lauria and Jo Ann Laurin, owners of certain real
property situated in the City of Anaheim, County of Orange, State
of California, described as follows:
The Easterly 85 feet of the hereinafter described property,
said 85 feet being measured along the Southerly line of
said property:
That portion of the Rancho San Juan Cajon de Santa Ana,
being a portion of Lot 1 of "Anaheim Extension," as
said Lot 1 is shown on a map of survey made by William
Hamel and acknowledge., by Alfred Robinson, Trustee,
on file in the Office of the County Recorder of Los
Angeles County, California, more particularly described
as follows:
Beginning at a point in the North line of said lot,
being on the South line of La Palma Avenue, distant
thereon 817.84 feet West of the Northeast corner of
said Lot, said point being the Northwest corner of the
land conveyed to J. E. Walter, and others, by deed
recorded May 13, 1947, in Book 1514, page 377 of
Official Records, in the Office of the County Recorder
of said Orange County, and running thence Southerly
along the Westerly line of said land, 209.41 feet to
the Southwest corner of said land; thence
South 73 54' 25" West along the Westerly extension
of the Southerly line of said land, 270.81 feet,
more or less, to the Westerly line of said lot;
thence Northerly along said Westerly line 288.00 feet
to the Northwest corner of said lot; thence East along
the Northerly line of said lot, 281.07 feet to the
point of beginning.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim on
October 18, 1965, notice of which said public hearing was duly
given as required by law and the provisions of Title 18,
Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission after due
inspection, investigation and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said hearing, did adopt Resolution No. 1815, Series
1965-66, granting Variance No. 1730 subject to certain conditions
therein set forth; and
WHEREAS, thereafter within twenty -two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action taken by
the City Planning Commission in granting said variance and did
set a public hearing thereon to be held on the 23rd day of
November, 1965, at 7:00 o'clock P.M. in the City Hall in the City
of Anaheim, and notice of such public hearing was duly given as
required by law and the provisions of Title 18, Chapter 18.76 of
the Anaheim Municipal Code; and
ATTEST:
WHEREAS, the City Council does find that:
1. There is no substantial property right possessed
by other property in the same vicinity and zone
and denied the subject property.
2. It appears that the subject property can be
adequately developed and used under the present
zone.
NOW THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Com-
mission granting Variance No. 1730 be, and the same is hereby
disapproved, and that the petition for a zoning variance
permitting a waiver of the 10 -foot minimum building setback
area, a waiver of the required screen planting adjacent to a
residential zone boundary, and a waiver of the maximum struc-
tural height limitation, on the property hereinbefore described,
be, and the same is hereby denied.
THE FOREGOING RESOLUTION is approved and signed by me
this 23rd day of November, 1965.
