A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING CONDITIONAL USE
PERMIT NO. 759
WHEREAS, the City Planning Commission of the City of
Anaheim did receive an application for a Conditional Use Permit
from John F. Murphy and Marianne Murphy, 1233 Nutwood Street,
Anaheim, California, to establish a private educational institution
on the following described property situated in the City of Anaheim,
County of Orange, State of California, to wit:
That portion of Lot 6 of the Kellogg Homestead Tract, in
the City of Anaheim, County of Orange, State of California,
as per map recorded in Book 8, page 51, Miscellaneous
Maps, records of said Orange County, described as follows:
Beginning at a point in the west line of said lot, distant
thereon South 0 55' 23" West 395.00 feet from the north-
west corner thereof, said northwest corner being in the
center line of the street, 60.00 feet in width, now known
as Ball Road, adjoining said lot on the north, and running
thence South 89 40' East, parallel with the north line
of said lot, 249.40 feet to a line parallel with and 200.00
feet westerly of the east line of said lot, said east line
being the center line of the street, 40.00 feet in width,
now known as Nutwood Avenue, adjoining said lot on the
east; thence South 1 07' 40" West, parallel with said
east line, 85.00 feet to a line parallel with and 450.00
feet southerly of the north line of said lot; thence
South 89 40' East along said parallel line, 200.00 feet
to said east line; thence South 1 07' 40" West along said
east line, 101.89 feet to a line parallel with and 230.00
feet north of the south line of said lot; thence westerly,
parallel with said south line, to the west line of said
lot; thence North 0 55' 23" East along said west line,
186.20 feet to the point of beginning.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
application on September 13 19 65 notices of which
said public hearing were duly given as required by law and the
provisions of Title 18, Chapter 18.76 of the Anaheim Municipal
Code; and
WHEREAS, said Commission, after due inspection,
investigation and studies made by itself and in its behalf and
after due consideration of all evidence and gports offered at
said hearing did ado t its Resolution No. Series
1965 -66 granting Conditional Use Permit No. 759,
subject to certain conditions therein set forth and
WHEREAS, thereafter, within twenty -two (22) days from
the date of the adoption of said resolution, a written appeal
was filed with the City Council protesting'the action of the
City Planning Commission in granting, Conditional Use
Permit and said appeal was set for p hearing oe
October 26 19 65 at the City Hall, in the City of
Anaheim, and notices of suc public hearing were duly given as
required by law and the provisions of Title 18, Chapter 18.76
of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, g
ri ng give City Council did duly hold and conduct such hearing
i g ve 1 persons interested therein an opportunity to
be heard and did receive evidence and reports; and
WHEREAS, the City Council finds, after careful
consideration of the recommendations of the City Planning
Commission and all evidence and reports offered at said hearing,
that:
The proposed use is properly one for which a
Conditional Use Permit is authorized by the
Anaheim Mtuaicip:' l Code.
The proposed use will not adversely effect the
adjoining land uses and the growth nand develop.
mant of the area in which it is proposed to be
located.
3. The size and shape of the site proposed for the
use is adequate to allow the full development of
the proposed use in a manner not detrimental to
the particular area nor to the peace, health,
safety and general welfare.
The traffic generated by the proposed use will
not impose an undue burden upon the streets and
highways designed and i proved to carry the
traffic in the ::reap
5. The granting of the Conditional Use Permit under
the conditions imposed will not be detrimental to
the peace, health, safety and $eneral welfare of
the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commis
sion grantj ng said Conditional Use Permit be, and the same
is hereby sustained and that Conditional Use Permit
No, 759 be, and the same is her.oby, granted permitting
the establishment of a private educational institution on the
property.hereinbefore described, subject to the following
conditions:
1. (a) That all engineering requirements of the City
of Anaheim along Nutwood Street, including prepara-
tion of improvement plans and installation of all
improvements, such as curbs and gutters, sidewalks,
street grading and paving, drainage facilities, or
other appurtenant work shall be complied with as
required by the City Engineer and in accordance
with standard plans and specifications on file in
the Office of the City Engineer; and (b) that a bond
in an amount and form satisfactory to the City of
Anaheim shall be posted with the City to guarantee
the installation of said engineering requirements.
2. That the owners of subject property shall pay to
the City of Anaheim the sum of $2.00 per front foot,
along Nutwood Street, for street lighting purposes.
3. That the owners of subject property shall pay to
the City of Anaheim the sum of 15Q per front foot,
along Nutwood Street, for tree planting purposes.
4. That trash storage areas shall be provided in
accordance with approved plans on file in the Office
of the Director of Public Works and Superintendent
of Streets, prior to final building inspection.
5. That subject property shall be developed substan-
tially in accordance with plans and specifications
on file with the City of Anaheim, marked Exhibits
Nos. 1, 2, 3 and 4; provided, however, that one
off street parking space shall be provided for
each employee.
6. That Conditions Nos. 1(b), 2 and 3 above mentioned
shall be complied with prior to the issuance of a
building permit or within a period of 180 days
from date hereof, whichever occurs first, or such
further time as the City Council may grant.
e City Council hereby reserves the right to revoke
such Conditional Use Permit for good cause or failure of said
owners their heirs, successors or assigns to comply with the
Anaheim Municipal Code and regulations and the conditions
herein.
THE FOREGOING RESOLUTION is approved and signed by
me this 26th day of October, 1965.
