3169FOLLOWS: ORDINANCE NO. 3169 AN ORDINANCE OF THE CITY OF ANAHEI-M REGULAT- ING PARADES ON PUBLIC RIGHTS OF WAY. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1_ Sections 14.24.060, 14.24.070 and 14.24.080 of the Anaheim Municipal Code are herebv repealed. SECTION 2. Section 14.24.060 is added to the Anaheim Municipal Code as follows: "Section 14.24.060 'PARADE' DEFINED. The word 'parade' as used in this chapter is defined to mean a procession or congregation of two or more vehicles or persons moving on or along a public right of way, including but not limited to streets and sidewalks, which obstructs either vehicular or pedestrian traffic or draws attention to the vehicles or persons for reasons other than safety." SECTION 3_ Section 14.24.070 is added as follows: "Section 14.24.070 PARADE PERMIT REQUIRED. No person, firm or corporation may conduct or participate in a parade unless a permit as provided for in this chapter has been issued." SECTION 4. Section 14.24.080 is added as follows: '"Section 14.24.080 PARADE PEW41T. Upon application made to the Chief of the Police of the City of Anaheim and a determination made by the Chief of Police that the parade as applied for in said application will not unduly disturb the convenience of the public, a permit to conduct such parade shall be granted. In making the determination that the convenience of the Public will not be unduly disturbed by a parade, the Chief of Police shall consider the following factors: 1. Time of the proposed parade. 2. Place of the proposed parade. 3. The manner in which the proposed parade is to be held. 4. Other proper uses of the streets such as construction or maintenance or pedestrian traffic and construction or maintenance on the streets involved in the proposed parade route. -1- Every person, firm or corporation who files an applica- tion, as provided herein, shall pay to City the sum of twenty-five (25) dollars, which shall be paid at the time the application is filed. This sum is for the purpose of paying for the cost of processing such application and is non-refundable." SECTION 5. Section 14.24.090 is added as follows: "Section 14.24.090 PAYMENT FOR CITY PERSONNEL. Prior to the issuance of the parade permit referred to in Section 14.24.080, the Chief of Police shall determine the number of police officers needed for the traffic control purposes for said parade and employees in other City Departments for traffic control, clean-up and repair of the right of way along the parade route. When the number of said officers and employees is determined, the Chief of Police shall also determine the estimated cost of providing said officers and employees (including equipment and traffic control devices) and inform the person, firm or corporation conducting said parade of such estimated costs. Upon pay- ment of said estimated costs by the person, firm or corpora- tion conducting said parade, the parade permit referred to in Section 14.24.080 shall be issued. In lieu of the pay- ment of said estimated costs, such person, firm or corpora- tion may post a bond in the form and manner satisfactory to the City Attorney of the City of Anaheim guaranteeing the payment of such estimated costs. When the estimated costs become final, the person, firm or corporation conduct- ing said parade shall pay to the City any amount which the final costs exceeds the estimated cost. In the event that the estimated costs exceed the final costs, the excess will be refunded to the person, firm or corporation who conducted the parade." SECTION 6. Section 14.24.100 is added as follows: "Section 14.24.100 APPEAL TO CITY COUNCIL. Any person, firm or corporation who is aggrieved by the denial (or granting) of a permit as provided in this Chapter shall have the right to file a written appeal with the City Council. Such appeal shall be filed with the City Clerk within five (5) days after the denial (or granting) of said parade permit. The City Council shall determine whether said permit should be granted or denied and such determination shall be final and conclusive." SECTION 7. The City Clerk shall certify to the Passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force. -2- THE FOREGOING ORDINANCE is approved and signed by me this 5th day of ____ June 19 73-- � q OR F THE � OF / AHEIM A ST: CIT CLERK OF THE CITY OF ANAHEIM STATE OF CALIFORNIA ) COUNTY OF ORANGE ) ss.
