3804ORDIIIANCE 110. 3804 AN ORDINANCE OF T -TE CITY OF AAAHEIP,i ADDING NEW CHAPTER 18.8 a TO TITLE 13 OF THE ANAHEIM 1,1UNICIPAL CODE ESTABLISHING AN OPE`1 SPACE ZONE . THE CITY COUNCIL OF THE CITY OF AdAHEIi� DOES ORDAIN AS FOLLOWS: SECTION 1. That new Chapter 13.08 be, and the same is hereby, added to Title 13 of the Anaheim 11unicipal Code, to read as follows : 11CHAPTER 18.33 'OSI OPEN SPACE ZONE 1".80.010 DESCRIPTION AND PURPOSE The purpose of the OS Zone is to protect and preserve open space for the preservation of natural resources, for the preservation and managed production of resources, for outdoor recreation and education, and for public health and safety. This zone is intended to be applied to permanent easements, public and semi-public land and agricultural preserves. Upon the annexation of land, or in certain other instances, this zone may be utilized as an interim zone until such time as specific development proposals are submitted on individual properties, or a zoning reclassification is requested and approved. I,Jithin this zone it is proposed to provide open space in the City of Anaheim by limiting development in areas which are located, configured and possessed of physical features that may provide valuable and functional open space for the purposes of shaping urban form while, at the same time, permitting a substantial and reasonable beneficial use of such property. 1".88.020 PERMITTED PRIMARY USES AND STRUCTURES Subject to all provisions of this zone, the following buildings, structures and uses, either singly or in combination, are permitted: -1- .010 Agricultural experimental facilities .020 Apiaries, fisheries -- .030 Aquariums, arboretums .0110 Athletic fields .050 Aviaries .060 Botanical gardens .070 Electrical substations .080 Farms or ranches for trees, crops, truck gardening, flower gardening. .090 The growing of field crops, trees, vegetables, fruits, berries and plants. .100 Fire stations .110 Flood control channels, spreading grounds or basins .120 Forest reserves including maintenance facilities and ranger stations .130 Grazing fields .140 Orchards and vineyards .150 Livestock feeding ranches not feeding garbage, refuse or offal .160 Outdoor recreation including, but not limited to, swimming pools, spas, tennis courts, horseshoe courts, and other outdoor recreation facilities. .170 Pipeline easements .180 Public libraries .190 Public parks, playgrounds and recreational areas .200 Public schools .210 Public Works maintenance yards -2- .220 Pumping stations .230 Reclamation for open space purposes of mines, quarries and pits resulting from the commiercial extraction of rock, sand, gravel, earth, clay and similar materials. .240 Scenic reserves and trails .250 Tree farms, horticulture .260 Utility easements .270 Wildlife reserves .280 Zoological gardens 18.88.030 PERMITTED ACCESSORY USES AND STRUCTURES The following accessory buildings, structures. and uses are permitted only where they are integrated with, and clearly incidental to, a primary permitted use: .010 Accessory structures and uses necessary or incidental to any permitted use including, but not limited to, gazebos, restrooms, maintenance buildings greenhouses, recreational buildings, and parking; structures or facilities. .020 Accessory living quarters within an accessory building provided that the minimum floor area of such dwellings shall comply with the standards established for the R?," -1200 Nultiple-Family Residential Zone. Such quarters shall be only for use by persons employed on the premises as caretakers or managers of any permitted primary use. .OLEO The keeping of animals in accordance with Section 18.02.052.010 "Accessory Structures and Uses -- General"; provided, however, that this section shall not be deemed to prohibit the keeping of animals on any lot where a permitted primary use is not also located thereon. 18.88.040 PERMITTED TEMPORARY USES AND STRUCTURES The following temporary buildings, structures and uses shall be permitted, subject to the conditions and limitations specified herein: -3- .010 Special Events. The temporary use of pre;ii.ses for promotional events as defined in Section 13.01.200 including, but limited to, outdoor sales, religous services, amusements, such as rides, games, booths, or similar devices, subject to compliance with the provisions of Chapter 4.02 "Special Events" of the Anaheim Municipal Code. .020 Temporary structures other than as permitted in subparagraph .010 above may be authorized by the Planning Commission for a period not exceeding forty- five (45) consecutive days. 18.33.050 CONDITIONAL USES AND STRUCTURES The following buildings, structures and uses shall be permitted subject to the conditions and required showings of Section 18.03.030 "Conditional Use Permits --General." The site development standards of this Chapter shall apply except as otherwise provided or as specifically approved in conjunction with the approval of said permit: .01.0 Archery ranges .020 Cemeteries including, as an accessory use, mortuaries, mausoleums, and crematoriums. .030 Public utility facilities. .040 Private schools. .050 Commercial uses incidental and accessory to permitted uses including, but not limited to, the following: .051 Sale of agricultural products only when grown on the premises. .052 Sale of food and beverages. .053 Operation of riding academies and stables, equestrian centers, polo grounds .054 Commercially operated parking facilities. .055 Concessions. .060 Country clubs, golf courses. .070 Cultural arts centers. -4- .080 Fair or exposition grounds .O90 Horse or dog racing tracks where otherwise legal .100 Miniature golf .110 Museums; Indian, archaeological, or scientific displays or centers .120 Skeet clubs, gun clubs .130 Swimming pools, natatoriums 18.88.060 SITE DEVELOPMENT STANDARDS The following site development standards are intended to provide for the reasonable and orderly develo_Dment of the City's open lands and to assure adequate levels of light, air and density of development, to maintain and enhance the locally recognized values of open space and to promote the safe and efficient circulation of pedestrian and vehicular traffic. The following site development standards and, except as modified herein, the site development standards of Chapter 18.04 shall apply and are found necessary for the preservation of the community health, safety and general welfare. .010 No minimum lot area, width, or frontage is required. .020 Site coverage of buildings and structures shall not exceed twenty-five percent of the total area of the parcel. .030 Off-street parking shall be provided in accordance with the provisions of Chapter 18.06 "Vehicle Parking and Unloading Requirements --General." .0110 All utility services shall be installed underground unless otherwise approved by the City Council. .050 Except as otherwise provided hereinabove, the site development standards set forth in Sections 18.21.062 through 18.21.067 of this Code shall be deemed to apply to this zone; provided, however, nothing contained therein shall be construed to authorize any use not otherwise expressly permitted by the provisions of this Chapter. -5- 13.38.070 DEVELOPMENT REVIEW AND PERMITS Prior to commencing any wore pertaining to the erection, construction, reconstruction, moving, conversion, alteration or addition to any building, structure or sign within this zone, a site plan showing the total development as proposed must be submitted to, and approved by the Planning Commission as being compatible with the purposes of this Chapter. Said site plan shall include schematics, elevations, composite renderings, landscaping plans, and detailed building; plans for the site. 18.38.080 PENALTIES FOR VIOLATIONS Any violation of the provisions of this Chapter shall be subject to penalties as prescribed in Section 18.04.110 of this code. 18.88.090 AMENDMENTS, CONDITIONAL USE PERI1IITS AND VARIANCES Boundaries of the zones established by this Chapter, the classification of property uses therein, or other provisions of this title may be amended, exceptions made therefrom, or conditional uses permitted in accordance with the facts, conditions, procedures and required showings specified in Chapter 18.03 of this code "Zoning Procedures - Amendments, Conditional Use Permits and Variances." SECTION 2. SEVERABILITY. The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this chapter of the Code hereby adopted be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this chapter independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 3.
