2448ORDINANCE NO. 2448 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 3, CHAPTER 3.44, SECTION 3.44.030 OF THE ANAHEIM MUNICIPAL CODE. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, there is a continuing need to promote the tourist and convention facilities of the City of Anaheim; and WHEREAS, the City Council of the City of Anaheim has determined by the enactment of m1unicipal Ordinance No. 1848 that it is in the best interests of the people of Anaheim that the burden of supporting this activity fall upon those who princi- pally share the benefits therefrom, to wit, the transient visitors to the City; and WHEREAS, the hotel and motel owners of the City of Anaheim have petitioned unto said City for an increase in the business license tax established by said Ordinance No. 1848 to provide additional funds to promote convention and tourist activ- ity within the City of Anaheim; and WHEREAS, in order to continue an energetic program of promotion in connection with tourist and convention activity, the City Council finds that a need exists to increase said business license tax from 4% to 5%; and WHEREAS, such finding is reflected in the petition of said hotel and motel owners as presented to the City. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION l: That Title 3, Chapter 3.44, Section 3.44.030 of the Anaheim iviunicipal Code be, and the same is hereby amended to read as follows: "SECTION 3.44.030 -- MOTELS, HOTELS. "Every person conducting, managing, or carrying on the business of a motel or hotel shall pay a business license tax of five per cent (5%) of the gross rental receipts from such hotel or motel operation. Such business license tax shall be paid monthly. It shall be permissible to display such tax as a separate item in connection with the rental of motel and motel accommodations and to collect such tax as a separate item in the billing and collection for accommodations. "A motel, for the purposes of this section, is defined as: Any business which is identified or advertised as a motel, or, -1- A group of attached or detached buildings containing �- individual sleeping or living units, used or intended, wholly or in part, for the accommodations of transients. "A hotel, for the purposes of this section, is defined as: Any business which is identified or advertised as a hotel, or, A building in which there are six or more guest rooms, used or intended, wholly or in part, for the accommoda- tion of transients. SECTION 2: The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and on the 1st day of January, 1968, it shall take effect and be in full force.
