AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
TITLE 4 OF THE ANAHEIM MUNICIPAL CODE BY
ADDING THERETO CHAPTER 4.09, RELATING TO THE
REGULATION OF OUTDOOR ADVERTISING OF MOTEL
AND HOTEL RENTAL RATES.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND
THAT:
WHEREAS, the Legislature of the State of California
in the 1967 Legislative Session duly enacted Senate Bill No. 596
and Assembly Bill No. 1005, each of which added Section 17567.5
to the Business and Professions Code of the State of California;
and
WHEREAS, the aforementioned addition to the Business
and Professions Code reads as follows:
"The governing body of any city, county, or city and
county may, pursuant to reasonable exercise of police
power, enact ordinances imposing regulations equal to
or greater than those imposed by this Article."
AND WHEREAS, the City Council of the City of Anaheim
is desirous of setting forth its intention not to regulate in
any manner the rates or charges imposed by owners and operators
of motel and hotel units in the City of Anaheim; and
WHEREAS, the City Council of the City of Anaheim is
desirous of regulating the manner in which the rates to be
charged to transients are advertised in order to prevent the
advertising of rates or charges or the changing of advertising
copy relating to rates or charges which will result in false
and misleading representations to the public relating to such
rates and charges.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM
DOES ORDAIN AS FOLLOWS:
SECTION 1.
That Title 4 of the Anaheim Municipal Code be, and the
same is hereby amended by adding thereto Chapter 4.09 reading
as follows:
"CHAPTER 4.09 OUTDOOR ADVERTISING OF MOTEL
AND HOTEL RENTAL RATES.
"SECTION 4.09.010
"If the owner or operator of any establishment described
in Section 17563 of the Business and Professions Code
of the State of California located within the City of
Anaheim desires to advertise rates for accommodations,
all such advertising shall be in conformity with Sections
17560 through 17568 of the Business and Professions Code
and the owner or operator of any such establishment
shall not change or remove the advertising of such rates
for accommodations for a period of sixty (60) days from
the date of posting of such rates.

"Whenever an owner or operator of any establishment
defined in the aforementioned Sections of the Business
and Professions Code of the State of California elects
to advertise rates for accommodations for said establish-
ment by means of any sign visible to passersby whether
the same shall be located within or without buildings,
said owner or operator shall file a copy of such rates
with the T easurer of the City of Anaheim. Failure
to file Scurates with the Treasurer of the City
of Anaheim shall constitute a misdemeanor.
"Any change in the posted rates occurring after any
sixty-day period shall be accompanied by an amended
rate list filed with the aforementioned City official."
SECTION 2.
The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be printed once within
fifteen (15) days after its adoption, in the Anaheim Bulletin
a newspaper of general circulation, printed, published and
circulated in said City, and thirty (30) days from and after
its final passage it shall take effect and be in full force.
THE FOREGOING ORDINANCE is approved and signed by

AND I FURTHER CERTIFY that the Mayor of the City of Anaheim
