2886ORDINANCE NO., 2886 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHLIM DOES FI14D THAT: WHEREAS, the City Council did adopt its Resolution No. 70R-524 determining that a change or c anges in a zone or zones__f�ereinafter mentioned and described should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COU14CIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Parcel A That portion of the Northeast Quarter of the Northwest Quarter of Section 13, Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as per map recorded in Book 51, page 11 of Miscellaneous Maps, in the office of the County Recorder of said County, described as follows: Beginning at a point in the Northerly line of the North- east Quarter of said Northwest Quarter, distant thereon South 890 41' 15" West, 727.91 feet from the Northeast corner of the Northeast Quarter of said Northwest Quarter; thence South 0° 13' 18" East 266.00 feet to the True Point of Beginning; thence North 890 41' 15" East 73.90 feet; thence North 00 12' 20" West 266.00 feet to the Northerly line of the Northeast Quarter of said Northwest Quarter; thence North 89° 41' 15" East 362.775 feet; thence South 0" 12' 20" East 598.55 feet to a point on the easterly -1- 70-71-16 prolongation of the Southerly line of the land of Orville L . Matteson as shown on a map filed in Book 74, page 5 of Record of Surveys in the office of the County Recorder of said County; thence along said prolongation North 890 41' 15" East 37.59 feet; thence South 00 11' 45"° East parallel with the East line of said Northwest Quarter of Section 13, a distance of 96.78 feet; thence North 890 41' 15" East parallel with said easterly prolongation of the South line of the land of Matteson, 253.47 feet, more or less, to the East line of said Northwest Quarter; thence South 0" 11' 45" East along said East line, 45.61 feet, more or less, to the North boundary of the right of way of the Orange County Flood Control District as described in various deeds of record; thence South 890 40' 47" West 727.58 feet along said North boundary to its intersection with the southerly prolongation of the West line of said land of Matteson; thence North 00 13' 18" West along pro- longation and said West line 475.04 feet to the True Point of Beginning. EXCEPTING therefrom the North 66.00 feet. PARCEL B That portion of the Northeast Quarter of the Northwest Quarter of Section 13, Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as per map recorded in Book 51, page 11 of Miscellaneous Maps, in the office of the County Recorder of said County, described as follows; Beginning at a point in the Northerly line of the Northeast Quarter of said Northwest Quarter, distant thereon South 890 41' 15" West 727.91 feet from the Northeast corner of the Northeast Quarter of said Northwest Quarter; thence South 00 13' 18"° East 266.00 feet; thence North 890 41' 15" East 73.90 feet; thence North 00 12' 20" West 266.00 feet to the Northerly line of the Northeast Quarter of said North- West Quarter; thence South 890 41' 15" West 73.975 feet to the Point of Beginning. EXCEPT the North 66.00 feet. that Parcel A now is R -A, AGRICULTURAL ZONE, and C-1, GENERAL COMMERCIAL ZONES, and that it be changed to and incorporated in R-3, MULTIPLE -FAMILY RESIDENTIAL ZONE; that Parcel B now is R --A, AGRICULTURAL ZONE, and that it be changed to and incorporated in C-1, GENERAL CO14MERCIAL ZONE, upon the following conditions; 1. That trash storage areas shall be provided in accord- ance with approved plans on file with the office of the Director of Public Works. 2. That fire hydrants shall be installed as"required and determined to be necessary by the Chief of the Fire Department. 3. That a 6 -foot masonry wall shall be constructed along the east property line adjacent to R -A zoned property and between Portions A and B. 4. That all air-conditioning facilities shall be properly shielded from view and the sound buffered from adjacent properties. -2- 5. That a parcel map to record the approved division of subject property be submitted to and approved by the City of Anaheim and then be recorded in the office of the Orange County Recorder. 6. That subject property shall be served by underground utilities. 7. The owners of subject property shall pay to the City of Anaheim appropriate fees as established by the City Council for park and recreation purposes; said fees to be paid at the time the building permit is issued. 8. Drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 9. That a 35 -foot strip of land shall be landscaped on the Lincoln Avenue frontage, plans for said land- scaping to be approved by the Development Services Department. 10. That Conditions Nos. 1, 2, 3, 4, 5, 6, 7, 8, and 9, above mentioned, shall be complied with prior to final building and zoning inspections. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circu- lated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
