A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM (i) DESIGNATING DEPOSITORIES FOR
CERTAIN CITY FUNDS, (ii) AUTHORIZING THE CITY
TREASURER TO ESTABLISH ACCOUNTS WITH SAID
DEPOSITORIES AND DEPOSIT PUBLIC FUNDS OF THE
CITY THEREIN, (iii) AUTHORIZING WARRANTS,
DEMANDS, DRAFTS AND CHECKS TO BE DRAWN AGAINST
ANY ACCOUNTS ESTABLISHED WITH SAID DEPOSITORIES
ON BEHALF OF THE CITY, AND (iv) AUTHORIZING THE
CITY TREASURER TO OPEN ACCOUNTS WITH FINANCIAL
INSTITUTIONS AND CORPORATIONS FOR THE PURCHASE
AND SALE OF VARIOUS SECURITIES AND MONEY MARKET
INSTRUMENTS.
WHEREAS, Section 705 of the City Charter of the City of
Anaheim authorizes and requires the City Treasurer to deposit or
cause to be deposited all funds coming into his or her hands and
in such depositories as may be designated by resolution of the
City Council; and
WHEREAS, the city Council of the City of Anaheim
desires to designate those certain institutions specified herein
as depositories of public funds belonging to or under control of
the city of Anaheim or any office, department or agency of the
City government; and
WHEREAS, the city Council desires to authorize certain
officers of the city to sign all authorized warrants, demands,
drafts and checks drawn against any accounts established with a
depository by the city; and
WHEREAS, the city Council has heretofore approved, or
may hereinafter approve, depository agreements with each of said
depository institutions; and
WHEREAS, the city Treasurer of the city of Anaheim
annually prepares and delivers to the City Council a Statement of
Investment Policy for approval; and
WHEREAS, said Statement of Investment Policy provides
for, among other things, the purchase and sale of various
securities and money market instruments; and
WHEREAS, the City Council has heretofore, and shall
hereinafter, annually approve said Statement of Investment
Policy; and
WHEREAS, Government Code Section 53635 directs the city
Treasurer to deposit all money paid to the City Treasurer for
safekeeping in state or national banks, savings associations or
federal associations, credit unions or federally insured
industrial loan companies in the state (the "depository
institutions"), or provides that such funds may be invested in
certain specified investments with any financial institution as
specified in Government Code Section 53635.5; and
WHEREAS, it is the desire of the City Council to open
and maintain accounts with financial institutions and
corporations for the deposit of monies and the purchase and sale
of said securities and money market instruments as authorized by
law.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the city of Anaheim as follows:
SECTION 1.
The following institutions are hereby each designated
as a depository (hereinafter "Depository") of public funds
belonging to, or under the control of, the City of Anaheim or any
office, department or agency of the city government pursuant to
Section 705 of the city Charter:

A change of name or address, or merger or
reorganization, by any Depository specified herein shall not
affect the designation of such institution as an authorized
depository of the City unless such authorization is expressly
revoked by an amendment to or repeal of this resolution.
SECTION 2.
Provided the City Council has heretofore approved, or
hereinafter approves, the execution of a depository agreement for
each Depository specified in Section 1 of this Resolution (the
"Depository Agreement"), the City Treasurer of the City of
Anaheim, or such other officer of the City as may be consistent
with the City Charter, be, and the same is hereby, authorized to
(i) sign signature cards and deposit them with the Depository,
(ii) establish City accounts with the Depository consistent with
the provisions of the Anaheim City Charter and the applicable
Depository Agreement, and (iii) deposit public funds of the city
in said accounts and perform such other functions or duties as
authorized or required by the provisions of the Anaheim City
Charter, the applicable Depository Agreement, or other applicable
provisions of law.
SECTION 3.
The Mayor, Finance Director and city Treasurer be, and
they are hereby, authorized to sign signature cards and deposit
them with the Depository, and that they be, and they are hereby,
authorized to sign all warrants, demands, drafts, checks and
other documents consistent with all applicable provisions of the
Anaheim City Charter and necessary or required for the deposit
in, or withdrawal from, the accounts established with said
Depository and within which public funds of the City shall from
time to time be deposited.
SECTION 4.
The officers hereinabove designated may affix their
respective signatures to any warrants, demands, drafts, checks
and other documents through the use of a facsimile signature
machine.
SECTION 5.
The City of Anaheim, a validly existing charter city
under the laws of the State of California, be and it hereby is,
authorized and empowered to open and maintain accounts for the
purchase and sale of U.S. Government Securities, Federal Agencies
Securities, and all manner of Money Market Instruments, issued or
unissued, including Repurchases and Reverse Repurchases,
("Securities") and that the City Treasurer or her or his
designated representative (as indicated in the Statement of
Investment Policy) be, and hereby is, authorized as the only
person(s) authorized to buy or sell Securities provided that such
actions comply with the Charter of the City of Anaheim and all
State and Federal laws applicable to such transactions.
SECTION 6.
Financial institutions and corporations at which the
City, at the direction of the City Treasurer, has opened an
account ("the financial institutions") are authorized to receive
from the City, checks and drafts drawn upon the funds of the city
by the city Treasurer or her or his designated representative, or
monies paid to the city and to apply the same to the credit of
the City or to its account with the financial institutions and
said financial institutions are authorized to receive from said
city Treasurer the City bonds or securities for the account of
the City.
SECTION 7.
The City Treasurer is authorized to provide
instructions to financial institutions regarding the delivery of
securities to the account of the City; and the City Treasurer
shall have the fullest authority at all times with reference to
any transaction deemed by her or him to be proper to make or
enter into for or on behalf of the city with the financial
institutions provided that such transactions comply with the city
of Anaheim Charter, State and Federal laws, and the Statement of
Investment Policy applicable to such transactions.
SECTION 8.
All confirmations, notices and demands upon this
organization may be delivered by the financial institutions
verbally or in writing, by telegraph or telephone to the City
Treasurer and she or he is authorized to empower any person, or
persons, that she or he deems proper, at any time or times, to do
any and all things that she or he is hereinbefore authorized to
do.
SECTION 9.
This resolution shall supersede Resolutions No. 84R-
139, 84R-385 and the provisions of any other prior resolution or
actions of the City Council inconsistent with the provisions
hereof.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the city of Anaheim this 18th day of
June , 1991.
