AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AMENDING TITLE 18 OF THE ANAHEIM MUNICIPAL
CODE BY ADDING CERTAIN SECTIONS THERETO RELATING
TO CONDOMINIUM DEVELOPMENTS; DECLARING THE SAME
TO BE AN INTERIM URGENCY ORDINANCE.
SECTION 1.
The City Council does hereby declare that condominiums
constitute a reasonable classification of land use different from
other land uses within the City in that residential condominium
projects being basically a home ownership development may have a
higher density unit than apartments which traditionally are rented
largely by young couples not ready for home ownership, by single
persons or by couples whose children have grown up and left the
family unit. Other problems invisioned are the difficulties of
controlling children or peeping toms from access to areas just
outside the windows of condominium units; utility services for
each unit; and the problems of continuing maintenance together
with appropriate covenants, conditions and restrictions.
SECTION 2.
Whenever there is created an estate in real property
consisting of an undivided interest in common in a portion of a
parcel of real property together with a separate interest in space
in a residential, industrial or commercial building on such real
property, the City of Anaheim finds and determines that such
development may be permitted as a conditional use in any residential,
industrial or commercial zone. But no such development shall be
permitted without first obtaining a conditional use permit.
SECTION 3.
The City Council, the City Planning Commission, and the
Development Services Department of the City of Anaheim are presently
considering and studying the problems surrounding the establishment
of adequate and equitable standards to encompass residential condo-
minium developments and adopt this interim ordinance as an urgency
measure to protect the public health, safety and welfare by pro-
hibiting any uses which may be in conflict with the contemplated
zoning standards.
SECTION 4.
During such interim period, conditional use permits may
be issued under appropriate circumstances when each of the following
interim standards have been met;
(1J. Maximum permitted lot coverage shall not exceed forty
percent (40%) .
(2.). Two covered parking spaces per dwelling unit and one-
half
ne-half open space per dwelling unit shall be required
per dwelling unit for guest parking.

(3). Covenants, conditions and restrictions, including the
establishment of a "perpetual care" fund shall be
approved by the Planning Commission, City Council, and
City Attorney.
(4). Separate utilities shall be required for each dwelling
unit.
(5). Such other conditions and standards as may be deemed
necessary and appropriate bythe Planning Commission
or the City Council.
SECTION 5.
This ordinance shall be effective immediately and for
ninety days from and after the date of its adoption and the City
Clerk shall certify to its passage and adoption by the City Council
of the City of Anaheim at a regular meeting held on the 6th
day of October, 1970, and shall cause the same to be pubTi—s-H-e-Z once
in the Anaheim Bulletin within fifteen (15) days after its
passage.
THE FOREGOING ORDINANCE is approved and signed by me
