2821ORDINANCE NO. 2821 AN ORDINANCE OF THE CITY OF ANAHEI-11 A 'FNDIIJIG TITLE 18, CHAPTERS 18.04 AND 18.08 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEI24 DOES ORDAIN AS FOLLOWS : SECTION 1: That Title 18, Chapter 18.04, Section 18.04 .020, Sub- section (6) of the Anaheim 'lunicipal Code be, and the same is hereby amended as follows: `°SECTION 18.04.020 GENERAL PROVISIONS -USE -GENERAL (6) The keeping of animals for domestic, non-commercial use shall be permitted in residential zones subject to the provisions of Chapter 8.08 of this Code and the follow- ing: (a) Animals shall be maintained in coops, pens, corrals, stables, tethered, or by some other means of con- finement, in accordance with the following provi- sions: 1. No person shall ;peep, stable, or tether any equine, bovine, sheep, swine, goat on a parcel of property of less than one acre (43,560 square feet). 2. No person shall keep, stable, or tether anv equine, bovine, sheep, swine, goat, poultry, or birds within fifty (50) feet of any struc- ture used for human habitation other than that of the owner, or within twenty (20) feet of any property line. (b) Poultry, rabbits, birds, and rodents shall not exceed twenty-four (24) animals per acre. The maximum number of the above animals permitted on an indivi- dual lot or parcel shall be pro -portional to the number permitted on one (1) acre, (i.e., one-half acre would permit twelve (12) such animals); pro- vided, however, that roosters and peacocks shall not be permitted in any residential zone. (c) Equine shall not exceed four (4) adult animals and their immature offspring per acre. (d) Bovine, sheep, goats, and swine shall not exceed a total of two (2) animals per acre. (e) Domestic housecats small not exceed three (3) animals over the age of four months (4) per dwell- ing unit. A non-commercial kennel may be permitted subject to the approval of the Development Services Department and the Orange County Poundmaster. (f) Dogs shall not exceed three (3) animals over the age of four (4) months per duelling unit. P_ non- -1- commercial kennel may be permitted subject to the approval of the Development Services Department and the Orange County Poundmaster. (g) This section shall not prohibit the keeping of animals which are gentle as found in nature, such as small turtles, non --dangerous birds, small, non- poisonous snares, non -harmful fish, or small monkeys. (h.) This section st=all not prohibit the '_Keeping of wild animals when: 1. In conjunction with zoos, museums, circuses, exhibits, or shows; 2. Under treatment in licensed veterinary hospitals; or, 3. Maintained by bona fide educational institutions for the purpose of instruction; provided, how- ever, the provisions of Section 8.20 shall apply. (i) The keeping of animals not specifically mentioned in this Chapter is prohibited except as provided under paragraphs (g) and (h) above. (j) In the event of a conflict between this Chapter and Cha?ter 3.08 of this Code, the provisions of this Chapter shall be superior." ~ SECTTOM 2: That Title 18, Chapter 18.08 of the Anaheim unicipal Code be, and the same is hereby amended, by adding Sections 13.08. 243 and 18.08.247, reading as follows: "SECTION 18.08.243 COOP A place of confinement, usually in the form of a cage or small enclosure, used in conjunction with the keeping of animals. SECTION 18.08.247 CORRAL A yard which is enclosed to adequately confine animals." SECTION 3: That Title 18, Chapter 18.08 of the Anaheim M�unici-Dal Code be, and the same is hereby amended, by amending Section 18.08. 640, reading as follows: "SECTION 13.08.640 STABLE, PRIVATE A structure or accessory building for the keeping of animals owned by the owners or occupants of the premises which are not kept for remuneration, hire, or sale. A stable may or may not include a corral" Sr nTTnW A a The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within -2- fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage shall take effect and be in full force.
