A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
AMENDING RATES, RULES AND REGULATIONS FOR THE SALE AND
DISTRIBUTION OF WATER AS ADOPTED BY RESOLUTION NO. 72R-600 AND
MOST RECENTLY AMENDED BY RESOLUTION NO. 91R-174.
WHEREAS, the City of Anaheim maintains a water distribution
system for the furnishing of water to residents and inhabitants of
the City of Anaheim and has adopted Water Rates, Rules and
Regulations for the sale and distribution of water; and
WHEREAS, the Public Utilities Board held a public hearing on
August 15, 1991 and evidence was presented in connection with
proposed revisions of Water Rates, Rules and Regulations; and
WHEREAS, a Notice of Hearing was published as follows:
1. On August 5, 1991, notice of the public hearing on water
rates was published in the Orange County Register and
proof thereof is on file with the Secretary of the Public
Utilities Board.
2. On August 5, 1991, notice of the public hearing on water
rates was published in the Orange County Edition of the
Los Angeles Times and proof thereof is on file with the
Secretary of the Public Utilities Board.
3. On August 5, 1991, notice of the public hearing on water
rates was published in the Anaheim Bulletin and proof
thereof is on file with the Secretary of the Public
Utilities Board.
WHEREAS, the Public Utilities Board considered the California
Environmental Quality Act and made the findings set forth in the
record of the public hearing, including the finding that the
establishment of these rates is exempt from the California
Environmental Quality Act pursuant to Section 21080(b) (8) of the
Public Resources Code; and
WHEREAS, the Public Utilities Board considered the proposal of
the Public Utilities Department and the evidence presented at the
public hearing, and has made findings with respect to the need for
changes to the Water Rates, Rules and Regulations, which findings
have been provided to city Council; and
WHEREAS, based on its findings, the Public Utilities Board has
recommended to the city Council that the Council adopt the changes
to the Water Rates, Rules and Regulations as shown in Appendix A;
and
WHEREAS, the City Council has considered the evidence
presented at the public hearing and the findings of the Public
Utilities Board.
NOW, THEREFORE BE IT RESOLVED that:
1. The city Council of the City of Anaheim hereby makes the
following findings with respect to the need for changes to the
Water Rates, Rules and Regulations:
a. The Water System revenue requirement of the Anaheim
Public Utilities Department was established, as set forth
below, on the basis of projections for the 1991-92 fiscal
year consisting of the twelve months July 1, 1991 through
June 30, 1992.
b. A reasonable estimate of the revenue requirement for
other operating expenses for the test period is
$9,768,000.
c. A reasonable estimate of the revenue requirement for
water supply for the test period is $7,620,000.
d. A reasonable estimate of the revenue requirement for
capital expenditures funded from rates for the test
period is $1,630,000.
e. A reasonable estimate of the revenue requirement for
current debt service, lease payment, RANS interest and
principal and reserve increases for the test period is
$3,823,000.
f. A reasonable estimate of the revenue requirement for
transfer to the General Fund for the test period is
$951,000.
g. A reasonable estimate of the revenue requirement for an
increase in working capital for the test period is
$1,010,000.
h. A reasonable estimate of the revenue requirement offsets
due to other water revenues and interest income for the
test period is $1,613,000.
i. An estimated revenue requirement of $23,189,000 as set
forth below, is appropriate for the test period:

~ j. It is appropriate to perform a cost-of-service study in
order to determine the allocated revenue requirement for
the test period for the following customer classes:
Single-Family Residential; Multi-Family Residential;
Residential Outside City; Commercial/Industrial;
Municipal; and Private Fireline.
k. The estimated total allocated annualized revenue
requirement is $23,990,070. The Customer Class revenue
requirements, on a Utility basis, as determined by a
cost-of-service analysis and set forth below, is

1. Section 1221 of the City Charter provides that utility
rates charged to a class of consumers shall be uniform
~ within the class and shall be based on cost of service for
the class.
m. On the basis of the preceding findings, the annual class
revenues under the proposed rates as shown above are
reasonable and appropriate:

n. It is appropriate to continue to fund the Water Capital
Replacement Fund by revenues from the sale of water.
o. It is appropriate to decrease the Water Utility water
supply budget for 1991/92 from $8,881,962 to $7,620,000.
p. It is appropriate to decrease the Water Utility revenue
from sales budget for 1991/92 from $23,669,000 to
$23,189,000.
q. It is appropriate to decrease the Water Utility RANS
interest expense budget for 1991/92 from $211,000 to
~ $131,000.
r. It is appropriate to decrease the Water Utility R&R
Reserve budget for 1991/92 from $96,000 to $82r000.
s. It is appropriate to decrease the Water Utility General
Fund Transfer for 1991/92 from $987,000 to $951,000.
t. Reasonable estimates for service fees and charges are
contained in the proposed Water Rates, Rules and
Regulations.
2. The changes to the Water Rates, Rules and Regulations as shown
in Appendix A are hereby adopted by the City Council of the
City of Anaheim.
THE FOREGOING RESOLUTION is approved and adopted by the city

SUBJECT: Water Utility Rate Action
RECOSIMENDATION
That the Public Utilities Board (PUB) recommend to the City Council
a rate action proposed to be effective January 1, 1992 supporting
the Water Utility's programs and projects for FY 91/92 and the
first half of FY 92/93.
DISCUSSION
On October 1, 1991, the City Council denied the Utility
Department's request for a 5.5% increase in water rates. This
rate increase was necessary to support the Water Utility's FY 91/92
budget as adopted on June 18, 1991 and September 10, 1991.
After the City Council's action, Department staff delayed and/or
deferred Water Utility program expenditures planned for FY 91/92.
These delays totaled approximately $1,122,000 and brought spending
in line with projected revenues until alternative actions could be
prepared.
Department staff has prepared, and is submitting for PUB
consideration and review, three water rate scenarios. The
following table summarizes these rate scenarios:

These rate scenarios are based on the following assumptions:
1. Water supply costs reflect the judgment of staff as to
the magnitude of rate increases the Metropolitan Water District
(MWD) will receive. Staff estimates are based on the most recent
information from MWD which includes drought-related issues.

Department staff forecasts of MWD rate increases based on
noninterruptible treated water prices are as follows: ~

2. The Department is preparing to downsize the organization.
Additional management efficiency studies beyond the Management
Audit are projected to produce annual savings to the Department of
about $1.6 million. Included are the elimination of approximately
15 positions, of which 10 are expected to be full-time positions.
Approximately 25 percent of these savings are expected 'to be within
the Water Utility ($400,000). These savings will begin to be
realized during the calendar year 1992 and should be fully
implemented within 18 months. This is in addition to the
Department audit savings of $1 million and the elimination of 5
management positions which have already been incorporated into the
budget.
3. In order to meet Federal water quality standards, Lenain
Filtration Plant must be rebuilt. This facility will be out of
service for an 18-month period from July 1993 untiI December 1994.
During thi~ period the Department will have to purchase higher
priced treated water from MWD to serve customers who normally
receive their water from the Lenain Filtration Plant facility. The
increase in water supply costs over this 18 month period is
expected to be approximately $941,000. Once the plant is
constructed, the annual cost of operating the rebuilt facility,
including debt service, will be approximately $1,761,000.
Additional proposed water quality standards may ultimately require
additional expenditures to conform with rules relating to lead and
copper, radon gas, and total coliform (level of bacteria
contamination).
4. The capital programs delayed and/or deferred resume
January 1, 1992. Also resuming January 1, 1992 are water
conservation programs which were delayed. These programs will help
customers reduce their water consumption and enable the City to
meet conservation targets set by the MWD.
5. Except for changes to the water commodity adjustment and
the high elevation surcharge, which are changed administratively as
the costs of water supply and pumping change, the Department does
not expect to request further rate action until January 1993. All
subsequent rate actions will be on a calendar year basis.

The base case consists of no rate increase in FY 1991-92. This
scenario forecasts a much larger double-digit increase in 1993 than
that projected under either the original rate proposal or the
revised rate proposal. The large increase forecast in 1993 is
followed by another forecast increase in 1994 that is also greater
than that projected under either alternative scenario. These
anticipated increases are undesirable but necessary to keep debt
service coverage at acceptable levels and to fund capital projects.
Debt service coverage is lowest under this option due to the
extended delay in rate action. Additionally, the reluctance to
raise rates over an extended period of time could be negatively
perceived by the rating agencies which could result in lower credit
ratings. Lower credit ratings would increase the Water Utility's
cost of borrowing.
ORIGINAL RATE PROPOSAL:

The original rate proposal consisted of a 5.5% increase. in water
rates effective September 1, 1991. This scenario provides the most
stable pattern of rate increases in all years. Debt service
coverage is better under this scenario compared to both the base
case and the revised proposal. Maintaining existing credit ratings
is also best supported under this scenario.
REVISED RATE PROPOSAL:

The revised rate proposal consists of a 4.5% rate increase in water
rates effective January 1, 1992. The original rate increase
proposed by the Department was 5.5% effective September 1, 1991.
The revised rate proposal forecasts stable rate increases in 1993
and 1994 while maintaining reasonable debt service coverage ratios.

The rate increases forecast in 1993 and 1994 under this scenario
would be only minimally higher than those projected under the
original rate proposal (12% in each subsequent year vs 11.5% and
11.75% respectively.)
STAFF RECOMMENDATION
The Department recommends adoption of the revised rate proposal.
Rate relief is needed in FY 91/92 to cover increased costs for
water supply and debt service. The Department's staff believes
that, with the planned downsizing, the proposed 4.5% rate proposal
is livable.
The revised rate proposal will fund capital projects necessary to
maintain system reliability and continue the timely replacement of
obsolete facilities. This scenario avoids rate shock by providing
reasonably stable rate increases over the next 3 years. This
scenario also maintains adequate debt service coverage, protecting
the Water Utility's credit ratings.

presented in the following table.

Department is also recommending that the Water rule and fee changes
proposed in the original rate proposal be adopted. These rule and
fee changes are provided for Board consideration.

Revenues sufficient to fund the approved FY 91/92 ~P have not been
adopted. Under any of the scenarios presented, it will be
necessary to amend the FY 91/92 ~P to reflect a lower level of
funding.

RATE C
Spacer Connections:
For tract developments requiring two inch or smaller meters, spacer connections may be
provided for the purpose of eliminating damage to permanent meters during the gradin~
of parkways, and for pressure testing of plur~bing. The rate shall be the same as the
Rate 31, Single-Family Residential, customer charge for a 3/4" meter per month for
single-family u~it and an additional charge of $0.85 will be made for each un~
excess of one that is served through a common meter.
SPECIAL CONDITIONS
A. Rates A and B of this schedule are subject to Schedules W-CA, W-ES and rules an~
regulations of the Utility.
B. For Rate A of this schedule, the permit holders are required to submit meter readings
of the temporary meters on a monthly basis on forms provided by the Utility. If tke
forms are not returned within 10 days from the date sent and it becomes necessary
a Utility inspector obtain meter readings at the job site, an additional $16.50 fe-
will be applied.
C. Temporary metered connections may be terminated at any time, and will be at
discretion of the Utility.

RULE NO. 11
DISCONTINUANCE ~ RESTORATION OF SERVICE
A. PAST DUE BILLS
Bills rendered will be considered past due if not paid within fifteen (15)
days after date of presentation.
B. NONPAY14~NT OF BILLS
1. When a bill for utility service has become past due and a 15-day
discontinuance of service notice has been issued, and delivery of
personal 48-hour notification service may be discontinued if the bill
is not paid within the time required by such notice. A charge will
be assessed if personal 48-hour notification is delivered.
Any customer who contests a bill and has initiated a complaint or
requested an investigation within 5 days of receiving ssid bill shall
not have service discontinued for nonpayment during the pendency of
a~ investigation by the City of such customer's dispute or complaint.
Services shall not be discontinued for nonpayment for any customer
complying with ~n amortization agreement entered into with the City,
provided the customer also keeps current the account for utility
services as charges accrue in each subsequent billing period. If a
customer fails to comply with an amortization agreement, the City
will give a 7-day d%scontinuance of service notice before
discontinuing services, but such notice shall not entitle the
customer to further investigation by the City.
2. Utility services to a domestic customer will not be discontinued for
non-payment when the customer has established to the satisfaction of
the City that such termination would be especially dangerous to the
health of the customer or a full time resident of the customer's
. household. Certification from a licensed physician, public health
nurse, or a social worker may be required by the City. The City
shall make available to customers, upon request, information
regarding agencies and/or organizations that may provide financial
assistance.

1. Definition of Terms
"East Santa Aria Canyon Area Documents" - Shall consist of Drawing
Nos. W-2389, as latest revised, and w-2393 delineating the boundary
of the East Santa Ana Canyon Area, location and estimated or actual
cost of transmission and terminal storage facilities and gross area
in acres. These documents shall be revised periodically to reflect
adjusted gross area, actual cost of facilities in place, current
cost estimates, and such other costs which may be incurred annually
in direct benefit of the area described in Rule 15-C.
2. ComPutation of Char~es
a. Transmission Facilities Acreage Fees - Transmission Facilities
Acreage Fees shall be co~%Duted on the basis of estimated or actual
costs of construction of the Transmission Facilities as defined in
Rule 15-C-l-d, as adjusted by an amount equal to any change in the
Engineering News Record (ENR) construction cost index, as provided
for in Rule 15-C-~4-e, since the date of completion for those
Transmission Facilities previously installed, and dividing such
total costs by the gross acreage remaining to be developed within
the East Santa Aria Canyon Area as shown on the East Santa Aria
Canyon Area Documents, and multiplying the quotient by the number
of acres in the A~plicant's development. The Applicant's
development area shall be measured to the nearest one-hundredth
acre of the gross acreage.

(3) Where two or more Applicants in the East Santa Aria Canyon Area have
advanced funds toward the construction of Transmission Facilities,
they each shall receive as reimbursement a proportional amount of
the monies collected by the Water Utility for Transmission
Pacilities Acreage Fees from subsequent Applicants. The
proportional amount of reimbursement shall be determined by
multiplying the gross amount available for reimbursement times a
weighted factor for each eligible Applicant. The numerator of this
factor is the product of the Applicant's original Advance,
multiplied by the number of years since the date of record of the
Applicant's Advance. The denominator of this factor is the sum of
the numerators for all Applicants eligible for reimbursements. The
nua%ber of years shall be calculated to the nearest month.
b. Terminal Storage Facilities
Should the General Manager, Public Utilities Department, determine that
~-e it would be in the best interests of the East Santa Aria Canyon area
to constr~ct a portion of the required terminal storage facilities, the
cost of which exceeds the Applicant's fees due and monies paid by
previous applicants together with interest, Rule 15-C-4 shall prevail.
Reimbursement for advances made in excess of terminal storage fees
shall be made in the same method outlined in Rule 15-C-5 and 15-C-6.

D. ANAHEIM STADIUM BUSINESS CENTER WATER FACILITIES
The cost of upgrading all water facilities serving the Anaheim Stadium
Business Center (Stadium /trea) as defined herein shall be paid for by the
owners or developers of property requiring such facilities. The procedure
set forth herein provides that the person who develops a parcel of property
within the Stadium Area, other than for permitted primary industrial uses
as provided in Section d.11, shall pay his proportional share of the cost
of facilities in the form of Gross Floor Building Area 4~ (GFA) fees.
Other fees, which are covered in the City's Water Rates, Rules, and
Regulations shall also be applicable.
1. Definition of Terms
a. Advance - The payment required for financing the installation of
upgraded water facilities within the Stadium Area.
b. City ~ The City of Anaheim, California, a municipal corporation.
c. Co~mmercial or Office Development - Any buildings or structures
within the Anaheim Stadium Business Center hereafter c~nstructed,
enlarged, or modified in use wherein the proposed use is changed to
a more intensive use.
d. Competitive Bidding Procedure - The process of obtaining sealed
construction bids by the developer for a portion of the upgraded
water facilities. The bids must be obtained in a bid :form and bid
items approved by the General Manager prior to soliciting for bids.
The developer must obtain a minimum of three bids. The developer
will not be allowed to award the contract and to proceed with the
water construction work, until the bids are submitted to the City
a~d the lowest responsible bid approved by the General Manager.
The bids obtained by the developer shall be from const:ruction
contractors licensed by the State of California and qualified to
perform water construction work. The General ~Ianager will have the
authority to reject all bids and request the developer to obtain
the authority to obtain additional bids. If all bids submitted to
the General Manager for approval are not satisfactory, the City
reserves the option to solicit bids for the work under established
City advertising and awarding procedures.

(1) The building is to be built in conformance with plans having
final discretionary approval by the Anaheim Planning Commission
or City Council prior to the effective date; and
{2) The o~rner or developer shall either, on the effective date, (a)
o~rn the property, (b) have a lease on the property for at least
25 years, or (c) have a binding agreement to purchase the
property.
Tier 3:
Development in the Stadium Area to which the criteria in Tier 1 and
Tier 2 does not appl~.
As used in this Section D.l.f "conformance with plans having final
discretionary approval by the Anaheim Planning Co~Taission or City
Council" shall mean (1) plans which the Director of Community
Development/Planning has determined to be identical with or
sLtbstantially in accordance with plans and conditions (imposed by the
granting body) which have received final discretionary approval by the
Anaheim Planning Commission or City Council on or before January 9,
1986, or (2) plans which the Anaheim Planning Commission or City
Council have found and determined to be substantially in accordance
with plans and conditions (imposed by the granting body) which have
received such final discretionary approval on or before January 9,
1986 .
g. General Manager - The City of Anaheim Public Utilities General Manager.
h. Gross Floor Building Area Fees - Gross Floor Building Area (C~~-- (~FA)
fees shall be the rate to be charged per Gross Floor Building -Jea in
commercial and office developments within the Stadium Area.
i. Gross Floor Building Area of Applicant's Development - The total gross
floor area as shown on the building plans submitted to the City for
approval including any amendments, additions or revisions as may be
requested by the Applicant or the City, measured to the nearest square
foot.

OWNERSHIP AND ABSENCE OF RENTAL OBLIGATION WIqERE FACILITIES ARE ON PREMISES
OF CUSTOMER
1. The service pipe, curb stop, meter, and meter box located wholly or
partially upon a customer's premises are the property of the Utility.
2. NO rent or other charge will be paid by the Utility where the
Utility-owned service facilities are located on a customer's premises.
E. ACCESS TO PP~EMIS~S OF CUSTOMER
1. The Utility shall at all reasonable hours have access to meter, service
connections and other property owned by it which may be located on
customer's premises for purposes of installation, meter reading,
maintenance, operation or removal of the property at the time service
is to be terminated. The customer's system should be open for
inspection at all reasonable times to authorized representatives of the
Utility.
2. Any inspection work or recommendations made by the Utility or its
agents in connection with plumbing or appliances or any use of water on
the customer's premises, either as a result of a complaint or
otherwise, will be made without charge.
F. CROSS-CONNECTIONS
1. Protective Regulation
No physical corulection between the potable water supply system of the
Utility and that of any other water supply will be permitted except in
compliance with the regulations of the State Department of Public
Health contained in Title 17 of the California Administrative Code
under "Regulations Relating to Cross-Connections."

2. Special Protective Devices Required
The Utility will require the installation of approved reduced
pressure principle type backflow protection devices under any of the
following conditions:
a. Where a fresh water supply which has not been approved by the
State Department of Public Health is already available from a
well, spring, reservoir or other source. (If the customer agrges
to abandon this other supply and agrees to remove all pumps and
piping necessary for the utilization of this supply, the
installation of reduced pressure principle type backflow
protective devices will not be required.)
b. Where salt water, or water other%~ise polluted, is available for
~ industrial or fire protection purposes at the same premises.
c. Where the premises are or may be engaged in industrial processes
using or producing process waters or liquid industrial wastes, or
where the premises are or may be engaged in handling sewage or
any other dangerous substance.
d. Where the circumstances are such that there is special danger of
backflow of sewage or other contaminated liquids through plumbing
fixtures or water-using or treating equipment, or storage tanks
and reservoirs.
3. Type and Expense of Protective Devices
Any backflow protective device utilized shall be of the type and
design specified and approved for the circumstances by the Foundation
for Cross Connection Control and hydxaulic Research, University of
Southern California, and/or the Los Angeles Plumbing Test Lab and
such device shall be installed by and at the expense of the customer,
in a manner approved by the Utility and the public health agency
having jurisdiction when so required, and in a location which is
readily available for periodic inspection.
