3056ORDINANCE NO. 3056 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 71R-539 determining that a change or changes in the zone or zones hereinafter mentioned and des- cribed should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: All that land situated in the State of California, County of Orange, City of Anaheim and described as follows: Parcel 1: That portion of the Southwest quarter of the Northwest quarter of Section 8, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as per Map recorded in Book 51, Page 10 of Mis- cellaneous Maps, in the Office of the County Recorder of said County, described as follows: Beginning at a point 822.00 feet East of the Southwest corner and in the Southerly line of the Southwest quarter of the Northwest quarter of said section; thence, North 491.53 feet parallel to the West line of said Northwest quarter to a point in the South line of the North 25 acres of the Southwest quarter of the Northwest quarter of said section; thence, East 520.70 feet, more or less, along said South line to a point in the East line of said Southwest quarter of the Northwest quarter; thence South 492.07 feet along said East line to the Southeast corner of said Southwest quarter of the Northwest quarter; thence -1- 71-72-19 West 518.90 feet, more or less, to the point of beginning lying Southerly of the Southerly line of the Orange County Flood Control Channel as described in the Grant Deed to Orange County Flood Control District, recorded January 26, 1960, in Book 5068, page 304 of Official Records. Parcel 2: That portion of the Southwest quarter of the Northwest quarter of Section 8, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as per Map recorded in Book 51, page 10 of Miscellaneous Maps, in the Office of the County Recorder of said County, des- cribed as follows: Beginning at a point 822.00 feet East of the Southwest corner and in the Southerly line of the Southwest quarter of the Northwest quarter of said section; thence, North 491.53 feet parallel to the West line of said Northwest quarter to a point in the South line of the North 25 acres of the Southwest quarter of the Northwest quarter of said section; thence, East 520.70 feet, more or less, along said South line to a point in the East line of said South- west quarter of the Northwest quarter; thence, South 492.07 feet along said East line to the Southeast corner of said Southwest quarter of the. Northwest quarter; thence, West 518.90 feet, more or less, to the point of beginning lying Northerly of the Northerly line of the Orange County Flood Control Channel as described in the Grant Deed to Orange County Flood Control District, recorded January 26, 1960, in Book 5068, page 304 of Official Records. Parcel 3: That portion of the Southeast quarter of the Northwest quarter of Section 8, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, per Map recorded in Book 51, page 10 of Miscellaneous Maps in the Office of the County Recorder of said County, described as follows: Beginning at the most Westerly corner of the land described in the Deed to the Orange County Flood Control District recorded December 4, 1959, in Book 5001, page 318, of Official Records in the Office of said County Recorder; thence S. 320 55' 1751 W., 123.99 feet along the Southwesterly prolongation of the Northwesterly line of said land to a line which bears N. 89° 57' 10" E. from a point which is N. 00 02' 50" W., 39.50 feet from the "True Point of Beginning" as described in the Deed to the Orange County Flood Control District recorded January 26, 1960, in Book 5068, page 304, of said Official Records; thence S. 890 57' 10" W., 99.52 feet along said line to said point, being the beginning of a tangent curve concave Southerly having a radius of 2039.50 feet and being concentric with the curve described as having a radius of 2000.00 feet in said last mentioned Deed; thence Westerly along said curve having a radius of 2039.50 feet to the West line of said Southeast quarter; thence North- erly along said West line to the Southwesterly line of the Southern Pacific Railroad right of way; thence, South- easterly along said Southwesterly line to the point of beginning. -2- Parcel 4: That portion of the Northwest quarter of Section 8, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as per Map recorded in Book 51, page 10 of Miscellaneous Maps in the Office of the County Re- corder of said County described as follows: Beginning at a point in the Southerly line of the parcel of land conveyed to the State of California by Deed recorded in Book 2823, page 72, Official Records, said point being South 89° 37' 54"' West, 86.04 feet from the Southeasterly corner of said parcel; thence, Easterly along said Southerly line 86.04 feet to said Southeast- erly corner; thence, North 0° 43' 36" West along the Easterly line of said parcel, 100.00 feet to a point in the Southerly line of the parcel of land described in the Deed to the State of California, recorded in Book 2827, page 239, Official Records, said point being South 89° 37' 54" West, 85.00 feet from the Southeasterly corner of the parcel last above mentioned; thence Easter- ly along said Southerly line 85.00 feet to said South- easterly corner; thence North 0° 43' 36" West along the Easterly line of said parcel 100.00 feet to the North- easterly corner thereof, which corner lies on the Southerly line of the Northwest quarter of said Northwest quarter of Section 8, 265.00 feet Easterly from the intersection of said Southerly line with the Westerly line of said Section 8; thence North 890 37' 54" East, 217.81 feet; thence South 57° 12' 36"° East, 522.75 feet; thence North 32° 47' 24" East, 100.00 feet to the Southwesterly line of the land of the Southern Pacific Company as described in the Deed recorded in Book 44, page 496 in the Office of the County Recorder of Los Angeles County; thence along said Southwesterly line, North 57° 12' 36" West, 863.05 feet; thence South 230 27' 52" West, 334.31 feet; thence South 150 37' 42" West, 156.50 feet to the point of beginning. Excepting from a portion of said Parcel 4 all minerals, oils, gases and other hydrocarbons by whatsoever name known that may be within or under the parcel of land hereinabove described without, however, the right to drill, dig or mine through the surface thereof, as reserved by the State of California by Deed recorded in Book 6035, page 395 of Official Records. Said portion is described as follows: Beginning at the. Southeasterly corner of the parcel of land conveyed to State by Deed recorded in Book 2849, page 378 of Official Records of Orange County, said corner lying in the Southerly line of the Northwest quarter of said Northwest quarter of said Section 8, and being distant North 89° 37' 40" East 260.00 feet from the Southwesterly corner of said Northwesterly quarter of said Northwesterly quarter; thence North 0° 44' 50" West, 100.00 feet to the Northeasterly corner of said parcel; thence South 890 37' 40' West 54.97 feet to the Southeasterly corner of land described in Deed to State recorded in Book 3300, page 5 of said Official Records; thence South 230 26' 58" West 163.49 feet; thence South 150 36' 04" West, 156.47 feet to a point in the Southerly line of land described in Deed to State recorded in Book 2823, page 72 of said -3- Official Records, said point being South 89° 37' 40 West, 86.02 feet from the Southeasterly corner of the. land above mentioned; thence Easterly along said South- erly line 86.02 feet to said Southeasterly corner; thence North 0° 44' 50 West along the Easterly line of said land 100.00 feet to a point in the Southerly line of land described in Deed to State recorded in Book 2827, page 239 of said Official Records; said point being South 891 37' 40" West, 85.00 feet from the Southeasterly corner of the land last above mentioned; thence Easterly along said Southerly line 85.00 feet to said Southeasterly corner; thence North 0° 44' 50" West, along the Easterly line of said land; 100.00 feet to the Northeasterly corner thereof, which corner also lies on said Southerly line of said Northwesterly quarter of said Northwesterly quarter of said Section 8, 265.00 feet Easterly from the intersection of said Southerly line with the Westerly line of said Section 8; thence South 89° 37' 40" West, along said Southerly line, 5.00 feet to the point of beginning. now is R -A, AGRICULTURAL ZONE, and that it be changed to and incorporated in M-1, LIGHT INDUSTRIAL ZONE, subject to the following conditions: 1. That trash storage areas shall be provided in accord- ance with approved plans on file with the Office of the Director of Public Works. 2. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 3. That subject property shall be served by underground utilities. 4. That Conditions Nos. 1, 2 and 3, above mentioned, shall be complied with prior to final building and zoning inspections. SECTION 2. The City Zoning Map shall be, and the same is hereby amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circu- lated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force. -4- WPH:ms THE FOREGOING ORDINANCE is approved and signed by me this 27th day of June , 19 72 .
