3000ORDINANCE NO. 3000 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FI14D THAT: WHEREAS, the City Council did adopt its Resolution No.70 _19 determining that a change or c anges in the zone or zones ereinafter mentioned and described should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: All that certain land situated in the State of California, County of Orange, City of Anaheim, described as follows: Those portions of Lots 4,5, and 6 of the J.D. Taylor Tract, as shown on a Map recorded in book 36, pages 58 to 60, inclusive of Miscellaneous Records, records of Los Angeles County, California, together with the Northerly half of Glen Avenue adjoining said Lots on the South and abandoned by Resolution of the Board of Supervisors of Orange County, California, on March 8, 1907 entered in Minute Book 7, page 58 and that portion of Old Jefferson Street vacated and abandoned by Resolution No. 69R-700, a certified copy of which was recorded December 15, 1969 in book 9164, page 550 of Official Records records of said Orange County, described as follows: Beginning at the intersection of the Northeasterly line of Jefferson Street with the Southerly line of Batavia Street as shown on a Map filed in State Highway Map book 6, pages 25 and 26, records of said Orange County, said Northeasterly -1- 69-70-60 line being the. Northeasterly line of Tract No. 4643, as shown on a map recorded in Book 195, pages 35, 36 and 37 of Miscellaneous Maps records of said Orange County; thence Southerly along said Northeasterly line of Jefferson Street, being a curve concave Southwesterly having a radius of 1250.00 feet, through a central angle of 10° 27' 53" an arc distance of 228.31 feet; thence radial to said curve South 630 38' 53°' West to the Westerly line of said Lot 5; thence Southerly along said Westerly line to the centerline of said Glen Avenue; thence Easterly along said centerline 725.76 feet to the Northwesterly corner of the land described in deed to the State of California recorded August 22, 1968 in Book 8698, page 564 of Official Records of said Orange County; thence North 430 31' 14" West 169.31 feet; thence North 370 23' 07" West 105.78 feet; thence North 43° 59' 29" West 199.10 feet to the Easterly terminus of that certain course shown as "South 820 06' 19" West, 85.26 feet" in the Southerly line of Parcel 2 of Rel - 637 on said State Highway Map; thence along said Southerly line South 82° 061 19" West 85.26 feet, South 560 53' 27`' West 67.39 feet and South 82° 25' 05" West 395.79 feet to the point of beginning. Excepting from a portion of said land all oil, oil rights, minerals, mineral rights, natural gas, natural gas rights, and other hydrocarbons, by whatsoever name known, that may be within or under the parcel of land herein described, without, however, the right ever to drill, dig or mine through the surface of said land, therefor, or otherwise develop same in such manner as to endanger the safety of any highway that may be constructed on the lands herein described as reserved in the deed from Bryan L. Berkley and others to State of California, filed in the Office of the Registrar of Titles of Orange County, California, March 19, 1953 as Document No. 26916. now is R -A, AGRICULTURAL ZONE, and that it be changed to and incorporated in R-2, MULTIPLE -FAMILY ZONE, upon the following conditions: 1. That trash storage areas shall be provided in accord- ance with approved plans on file with the office of the Director of Public Works. 2. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 3. That all air --conditioning facilities shall be properly shielded from view. 4. That subject property shall be served by underground utilities. 5. That drainage of subject property shall be disposed of in a manner that is satisfactory to the City Engineer. 6. That the owner of subject property shall pay to the City of Anaheim the appropriate park and recreation in -lieu fee, said amount to be paid at the time the building permit is issued. -2 7. That a 6 -foot masonry wall shall be constructed along the south property line, said wall to be permanently maintained. 8. That a 20 -foot landscaped area with screen landscaping shall be provided along the Tustin Avenue frontage south of the intersection of Tustin Avenue and "A" Street. Plans for landscaping and irrigation of this area shall be approved by the Parkway Maintenance Superintendent. Said landscaping shall be maintained by the owner of subject property. 9. That Conditions Nos. 1, 21 3, 4, 5, 6, 7, and 8, above mentioned, shall be complied with prior to final build- ing and zoning inspections. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
