2980ORDINANCE NO. 2980 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ANAHEIM, CALIFORNIA, PROVIDING FOR PROCEDURES FOR THE AUTHORIZATION, ISSUANCE AND SALE OF ELECTRIC REVENUE BONDS OF SAID CITY AND ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD IN SAID CITY ON JANUARY 18, 19722 FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A PROPOSITION OF ISSUANCE OF ELECTRIC REVENUE BONDS WHEREAS, the City of Anaheim is a City organized and existing under a Charter duly and regularly adopted pursuant to the provisions of the Constitution of the State of Cali - fornix; and WHEREAS, pursuant to Section 1210 of said Charter, the City of Anaheim, acting by and through its City Council, is authorized to issue, on behalf of said City, bonds payable only from revenues; and WHEREAS, pursuant to said Section 1210 of said Charter no such bonds payable out of revenues shall be issued without the assent of the majority of the voters voting upon the proposition for the issuing of the same at an election at which such proposition shall have been duly submitted to the qualified electors of the City; and WHEREAS, the City Council of the City of Anaheim, acting under and pursuant to the powers reserved to the City under Section 5 of Article XI of the Constitution of the State of California and said Section 1210 of the Charter of the City -1- of Anaheim, finds that the public interest and necessity require the establishment by this procedural Ordinance of procedures for the authorization, issuance and sale of electric revenue bonds for certain purposes; NOW, THEREFORE, THE COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council, exercising the powers reserved to the City under Section 5 of Article XI of the Constitution of the State of California and Section 1210 of the Charter of the City, may when the public interest and necessity require, by resolution or resolutions, issue and sell electric revenue bonds to provide funds for the acquisi- tion, construction and financing of additions, enlargements and improvements of the electric system of said City, including all engineering, financing and legal fees, costs of the issuance of said revenue bonds, bond reserve funds and other costs, incidental to or connected with such acquisition, construction and financing. SECTION 2. That the procedure for the authorization, issu- ance and sale of revenue bonds shall be the procedure set forth in the Revenue Bond Law of 1941 (commencing with Govern- ment Code Section 54300), and by this reference, with the exception hereinafter stated, the provisions of said Law are incorporated herein; (a) provided, however, that no election to authorize the issuance of said bonds other than that elec- tion required by the City Charter shall be held, and to that end Sections 54380 through 54387 of said Government Code are not incorporated herein and shall not be applicable to the YAI issuance of said revenue bonds; (b) and, provided, however, notwithstanding any provision contained in said Revenue Bond Law of 1941, the City Council may issue and sell the bonds in such manner as it may determine, either by private sale, or by means of competitive bid, and to that end, such sections of the Revenue Bond Act, specifically including Sections 54388, 54403 and 54418, which shall be inconsistent with such pro- vision are not incorporated herein and shall not be applicable to the issuance of said revenue bonds; provided that regardless of the maximum coupon rate of interest recited in this ordi- nance calling the election, said bonds may be issued at a discount not to exceed six percent (6%) of the par value of said bonds; (c) and, provided, however, that notwithstanding anything contained in said Revenue Bond Act of 1941, specifi- cally including Section 54402, interest on said bonds shall be payable for such periods and in such increments as the City Council shall by resolution identify; (d) and, provided, however, notwithstanding anything contained in said Revenue Bond Act of 1941, said enterprise shall continue in operation in accordance with provisions in the Charter of the City of Anaheim, and procedures therefor adopted pursuant to said Charter and pursuant to such provision as shall be made for said operation in the future, so long as said provision shall be consistent with terms, conditions and covenants contained in the resolution providing for issuance of said bonds; (e) and, provided that Section 54310 of said Revenue Bond Act of 1941 shall not be applicable to the issuance of said revenue bonds. 1918 SECTION 3. That pursuant to the provisions of the Charter of the City of Anaheim and this Ordinance, a special election be held and the same is hereby called to be held in said City on January 18, 1972, for the purpose of submitting to the qualified voters of said City the proposition herein- after set forth of issuing revenue bonds of said City in the principal amount stated in the ballot proposition hereinafter set forth, and for the object and purpose set forth in this Ordinance and in said ballot proposition. SECTION 4. That the estimated cost of the acquisition, construction, improvement and financing described in said ballot proposition is the sum of $8,000,000. The principal amount of revenue bonds to be issued is $8,000,000. SECTION 5. That the maximum rate of interest to be paid on said revenue bonds shall not exceed the maximum rate permitted by law, to -wit: seven percent (7%) per annum. SECTION 6. That the bonds to be authorized are revenue bonds, payable exclusively from the revenues of the enterprise and are not secured by the taxing power of the City. Said bonds shall be secured as provided in the Revenue Bond Act of 1941 and the Resolution of Issuance. SECTION 7. The enterprise herein referred to is the entire electric system of the City of Anaheim, including all improvements and extensions later constructed or acquired. SECTION 8. That the polls for said election shall be opened at seven o'clock a.m. of the day of said election and shall remain open continuously from said time until seven o'clock p.m. of the same day, when said polls shall be closed, except -4- as provided in Section 14436 of the Elections Code of the State of California. SECTION 9. That on the ballots to be used at said special election, in addition to any other matters required by law, there shall be printed substantially the following: MARK CROSS (+) ON BALLOT ONLY WITH RUBBER STAMP; NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND INK OR PENCIL.) INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross (+) in the voting square after the word "YES" or after the word "NO". All marks except the cross (+) are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of elec- tion lec- tion and obtain another. On absent voter ballots mark a cross (+) with pen or pencil. That a cross (+) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the proposition. A cross (+) placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of the proposition. SECTION 11. That if the proposition receives the requisite number of votes, to -wit: a majority of the votes of the qualified electors voting on said proposition, revenue bonds of said City, in not exceeding the principal amount stated in such proposition, may be issued and sold for the object and purpose set forth in said proposition as provided in Section 1210 of the City Charter and this Ordinance. SECTION 12. That for the purpose of holding said election there are hereby established sixty-eight (68) voting precincts designated as stated in the notice hereinafter set forth and each consisting of the regular election precincts in said City of the numbers hereinafter stated, as said regular election precincts have been established by the Board of Supervisors of Orange County for the purpose of holding state and county elections and exist on the date this Ordinance is adopted. The polling places for the respective voting precincts shall be the places hereinafter designated, and the persons hereinafter named, being competent and qualified electors and residents of said City and of their respective voting precincts, are hereby appointed officers of election for their respective voting precincts and they shall hold said election and make return thereof in the manner provided by law. That the City Clerk shall cause this Ordinance to be published, within fifteen (15) days after its adoption, in The Anaheim Bulletin, a newspaper published at least six (6) days a week in the City. The City Clerk shall also publish in said newspaper the notice entitled "Measure To Be Voted On" in substantially the form and manner set forth in Elections Code Section 22835 once a week for two (2) successive weeks. In such notice the synopsis of the measure to be voted on shall be the ballot proposition herein- before set forth. SECTION 15. This Ordinance shall take effect upon its passage.
