2931ORDINANCE NO. 2931 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 18 BY ADDING THERETO CHAPTER 18.57 RELATING TO PC PLANNED COMMUNITY ZONE. THE CITY COUNCIL OF THE CI`T'Y OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 is amended by adding thereto Chapter 18.57 to read as follows: SECTION 18.57.010 PC PLAINNED COMMUNITY ZONE DESCRIPTION AND PURPOSES (1) The purpose of this Zone is to encourage, preserve and improve the health, safety and general welfare of the people residing within the Community by encouraging the use of contem- porary land planning principles. The provisions of this zone are intended to allow diversification of uses, relationships and heights of buildings and open spaces in planned building groups while insuring compliance with the spirit, intent and other pro- visions of the zoning ordinance. (2) To be reclassified to the PC Zone an area shall be of sufficient acreage to be suitable for development as described in the Description and Purpose of this zone. Furthermore, said area shall be under single ownership or controlled by a single entity at the time of application and until the effective date of the ordinance approving the proposed General Plan of Develop- ment. (3) Contiguous land may be added to an existing PC Zone provided said land is made a part of the General Plan of Develop- ment as hereinafter provided. Contiguous shall mean having a common boundary with the property to which it is to be added or shall mean that the property is so physically located that in the opinion of the City Council, after review of a recommendation by the Planning Commission, said additional area bears a significant relationship to the approved and adopted General Plan of Develop- ment. SECTION 18.57.020 PROCEDURE FOR RECLASSIFICATION TO THE PLANNED COMMUNITY ZONE AND THE GENERAL PLAN OF DEVELOPMENT The applicant for reclassification to the PC Zone shall, prior to acceptance of his petition by the City, submit a General Plan of Development for review by the Interdepartmental Committee. Said General Plan of Development shall consist of maps, statements of goals and objectives and proposed land uses and shall include the following elements: -. (1) Land Use and Housing Element (2) Circulation Element (3) Population Element (4) Services and Facilities Element -1- SECTION 18.57.021 LAND USE AND HOUSING ELEMENT The land use element shall consist of maps setting forth the distribution, general location and extent of the areas of land devoted to each category of land use proposed as part of the General Plan of Development. For example, the land use and housing map might include designations for various housing types, i.e., one -family, multiple -family, condominiums, cluster or row dwellings, etc., neighborhood retail shopping facilities, com- munity retail shopping facilities, regional retail shopping facilities; office facilities, service facilities, education, religious, recreation, public and semi-public facilities, conservation or open space areas, or other categories of public or private uses of land. SECTION 18.57.022 CIRCULATION ELEMENT The circulation element shall consist of maps setting forth the general locations and width of arterial highways and extent of all transportation facilities proposed as part of the General Plan of Development. This element shall include basic design criteria for engineering review and the traffic carrying capacities of all arterial streets and highways. The circulation element may be shown as part of the land use map. Nothing herein is to be construed as to require the delineation of local streets on the circulation element since such street orientation is sub- ject to development design and topography. All major, primary, secondary and collector street networks shall be in substantial conformance with the circulation element of the Anaheim General Plan. SECTION 18.57.023 POPULATION ELEMENT The population element shall contain a statement of dwelling unit density for the entire planned community as well as for the individual planning areas. SECTION 18.57.024 SERVICES A14D FACILITIES ELEMENT The services and facilities element shall contain maps setting forth the general location of any and all existing and proposed backbone systems for sewerage, water, and drainage facilities. ADDITIONAL ELEMENTS of Development may include any addi- necessary for the physical development to aid in evaluating the impact and proposed facilities and services of SECTION 18.57.026 SUPPORT DATA The General Plan of Development shall include support- ing maps, data and explanations of the method utilized in its formulation, and shall be the basis on which paragraph 18.57.040, 'Development Standard Criteria and Final Specific Plans' shall be evaluated. -2- SECTION 18.57.030 METHOD OF ADOPTION OF THE GENERAL PLAN OF DEVELOPMENT (1) Public notice of the hearing on the General Plan of Development shall be incorporated into the public notice of the proposed change of zone. (2) The General Plan of Development may be approved, modi- fied, conditionally approved or rejected by the Planning Com- mission or City Council. Reclassification to the PC Zone may be accomplished upon adoption of the General Plan of Development. SECTION 18.57.031 A14-ENDMENT TO THE GENERAL PLAN OF DEVELOPMENT Any amendment to the adopted General Plan of Develop- ment shall proceed as outlined in paragraph 18.57.030, captioned 'Method of Adoption of the General Plan of Development'. SECTION 18.57.040 DEVELOPMENT STANDARD CRITERIA AND FINAL SPECIFIC PLANS Prior to the introduction of an ordinance establishing the PC Zone on a specific parcel or parcels, there shall be sub- mitted to the City of Anaheim the development standard criteria to be employed in implementing the planned community along with two (2) complete sets of final specific plans for each phase of development or portion thereof for which permits are to be requested or required. (1) Development Standard Criteria (A) In the event a proposed planned community is to be developed in accordance with existing ordinances of the City of Anaheim, those zones or development standards that are to be employed in implementing each type, phase or area of residential and/or commercial development shall be so designated. (B) In the event a proposed planned community is not to be developed in accordance with existing ordinances of the City of Anaheim but rather is to be developed under other standards designed speci- fically for a particular type, phase or area of residential and/or commercial development, fifteen (15) copies of the standards to be employed in implementing the development of the planned commu- nity shall be submitted to the City designating the specific uses proposed within the planned community and the most appropriate Anaheim zones and any deviations therefrom. (1) The residential development standards and regulations may include but not be limited to the following items: (a) Description and purpose (b) Definition of terms set forth in Title Municipal Code) -3- (if other than that 18 of the Anaheim (c) Permitted uses, buildings and structures: 1. Primary uses 2. Accessory uses 3. Conditional uses (d) Minimum building site areas and dimensions (e) Minimum building site area per dwelling unit (f) Minimum floor area per dwelling unit (g) Minimum setbacks: 1. Yards 2. Building separations (h) Maximum lot coverage (i) Building and structural height limita- tions (j) Recreational leisure areas, open space and private outdoor living areas (k) Off-street parking: 1. Open 2. Covered (1) Distance of dwelling units from vehicular accessways and parking (m) Walls or fencing (n) Refuse storage areas (o) Treatment of any external lighting and roof mounted equipment (p) On-site and off-site landscaping (q) Covenants, conditions and restrictions (2) The commercial development standards and regulations may include but not be limited to the following items: (a) Description and purpose (b) Definition of terms (if other than that set forth in Title 13 of the Anaheim Municipal Code) (c) Permitted uses, buildings and structures: 1. Primary uses 2. Accessory uses 3. Conditional uses (d) Setbacks and building separations (e) Landscaping (on and off-site) (f) Building and structural height limita- tions (g) Site size (h) Off-street parking -4- (i) Walls (j) Refuse storage and loading areas (k) Access (secondary) (1) Treatment of external lighting and roof mounted equipment (m) Signs (n) Performance standards (standards which might affect adjacent residential uses, i.e., noise, odor, lighting, dust, etc.) (o) Covenants, conditions and restrictions (2) Final Specific Plans. Final specific plans shall include but not be limited to: (A) Location map drawn to the same scale as the map of the adopted General Plan of Development relating site plan to the approved General Plan of Develop- ment. Said locational map shall include a legal description of the property upon which the Final Specific Plan is filed. (B) The placement of buildings and structures, front, side, and rear elevations. (C) Lot dimensions and pad size of all lots sufficient to indicate the relationship of the proposal to the nature and extent of the cut and fill or earthwork involved. (D) Off-street parking and vehicle storage. (E) Extent and type of landscaping proposed including any existing vegetation. (F) Topographic map. (G) Public and private streets, public alleys or private accessways used for vehicular circulation. (H) Type of fencing along any lot line of a site abutting a street, river, creek, open storm drain, lake, railroad, or other works. SECTION 18.57.042 FINAL SPECIFIC PLAN PROCESSING FEE The applicant shall be required to pay appropriate fees for the processing of any and all final specific plans. SECTION 18.57.044 APPROVAL OF FINAL SPECIFIC PLANS The Anaheim Planning Commission shall approve all final specific plans in the PC Planned Community Zone. The Planning Commission shall consider each request to insure that the proposed improvements will meet the purpose and intent and development standards and regulations of the PC -5- Planned Community Zone. The decision shall be subject to appeal in the same manner as conditional use permits and variances. SECTION 18.57.050 RECLASSIFICATION FROM THE PC ZONE Any application for reclassification from the PC Zone to any other zone shall be deemed to be an amendment to the adopted General Plan of development. Said application shall be processed as prescribed in the paragraph captioned 'Amendment to the General Plan of Development'. SECTION 18.57.060 DEDICATION AND IMPROVEMENTS Anticipating that changes will occur in the area due to the increase in vehicular traffic, the following dedications and improvements are deemed to be necessary to prevent congestion and the other hazards related to the intensified use of the land, and to be necessary for the preservation of the public health, safety and general welfare. These requirements shall be met or complied with before any complex or building shall be given final approval and accepted for use and occupancy: (1) All required arterial streets and highways, local streets, and alleys, which abut the subject property, shall be dedicated to the full width designated by the Anaheim General Plan or other official plans or standards adopted by the City Council. (2) All required streets, highways, alleys, or other circulation facilities which abut the subject property shall have been installed and in good repair. A faithful performance bond in a form approved by the City Attorney and in an amount determined by the City Engineer may be posted to guarantee the construction of the required improvements which may include but not necessarily be limited to excavation, curbs, gutters, pave- ment, drainage facilities or other engineering requirements. (3) Street light facilities shall be installed in accordance with the official street lighting plan approved by the Utilities Director. (4) Public utility easements necessary to serve the subject property and/or area in which the subject property is situated shall be dedicated to the City in accordance with the require- ments of the Utilities Director. Electrical utilities shall be placed underground and dedicated to the City of Anaheim in accordance with the require- ments of the Utilities Director. (5) Necessary fire protection facilities shall be provided for in accordance with the requirements of the Fire Chief. (6) Street tree fees in the amount specified by the City Council for any abutting street or highway shall be paid to the City of Anaheim for the furnishing and planting of required trees. (7) The Building Inspector shall not grant final release or issue a final certificate of occupancy to any building constructed upon any property covered by this chapter until the City Engineer has certified to compliance with the conditions set forth in (1) Z-2 and (2) above, the Utilities Director has certified compliance with the conditions set forth in (3) and the Fire Chief has certified to compliance with the forth in (5) above, and the Director of Public Works fied to compliance with the conditions set forth in SECTION 18.57.070 CLARIFICATION OF USES to (4) above, conditions set has certi- (6) above. If any use is for any reason omitted from the informa- tion required in the adopted General Plan of Development, or if ambiguity arises concerning the classification of a particular use within the meaning and intent of this ordinance, it shall be the duty of the Planning Commission to ascertain all pertinent facts concerning such use and determine if such proposed use is consistent with the intent of the General Plan of Development adopted by the City. If the Planning Commission finds such pro- posed use to be consistent with the intent of said General Plan, such use shall be incorporated or included therein. If the Planning Commission disapproves said use, the applicant may appeal in writing to the City Council whose decision will be final. SECTION 2. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circu- lated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
