2929ORDINANCE NO. 2929 AN ORDINANCE OF THE CITY OF ANAHEIM ArdiENDING TITLE 18 BY ADDING THERETO CHAPTER 18.59 RELATING TO (SC) - SCENIC CORRIDOR OVERLAY ZONE. THE CI`T`Y COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 is amended by adding thereto Chapter 18.59 to read as follows SECTION 18.59.010 DESCRIPTION AND PURPOSE The Scenic Corridor Overlay (SC) Zone is intended to provide for and promote orderly growth and development while protecting, preserving and further enhancing the scenic and environmental features primarily within the Santa Ana Canyon Scenic Corridor. The Corridor shall be defined as that area lying easterly of the intersection of the Newport and Riverside Freeways, westerly of the Orange County line, southerly of the Atchison, Topeka and Santa Fe Railroad right-of-way and northerly of a line lying one-half mile south of Santa Ana Canyon Road. The purpose of this chapter is to implement local governmental agency action to protect the scenic appearance of the Scenic Corridor. The Scenic Corridor presently contains a distinctive character that is exemplified in three primary natural features and their interrelationships. These features are the rolling terrain, the winding river and the eucalyptus tree windbreaks. The foremost purpose of this chapter is to maintain the character they exemplify by retaining or expanding the impact of these natural features. The (SC) Zone is established to be combined with other zones within the Scenic Corridor (e.g., R-1 (SC)). The regula- tions which apply to property in any zone with which the (SC) Zone is combined shall remain the same, except as to the matters specified in this Chapter 18.59. This chapter shall apply in lieu of or in addition to and shall supersede the corresponding regulations of such zone with which the (SC) Zone is combined. SECTION 18.59.020 SINGLE-FAiVIILY RESIDENTIAL AND AGRICULTURAL ZONES Subsection 18.59.021 Permitted Buildings and Uses. Those uses which are automatically or conditionally permitted in the specific zones shall be permitted automatically or condi- tionally except the following uses shall be excluded: 1. Hotels, motels and motor inns 2. Billboards 3. Drive-in, walk-up or semi -enclosed restaurants 4. Open air theaters 5. Borrow pits 6. Concrete batching or mixing of Portland or asphaltic concrete 7. Dumps (sanitary land fill) -1- 8. Excavation, processing, storage, wholesaling and distribution of sand, gravel, and other non -fuel minerals 9. Refuse, disposal or transfer 10. Animal hospitals and kennels 11. Sewage treatment plants 12. Automobile or truck sales agency (new or used) 13. Car washes 14. Amusement parks 15. Circuses, carnivals, rodeos, or fairgrounds 16. Race tracks 17. Pawn shops 18. Planned unit shopping centers 19. Transportation terminals 20. Explosives storage Subsection 18.59.022 Site Development Standards. The Scenic Corridor site development standards are intended to provide for the continued orderly development of the City's scenic areas by encouraging a high quality of development in keeping with the natural amenities of these areas and preserving their unique scenic resources as an asset to the community. The following site development standards are established to insure harmony with adjacent uses of land and to retain the scenic characteristics of the areas. (1) BUILDING AND STRUCTURAL HEIGHT LIMITATIONS (a) The maximum overall height of any building or mobilehome shall be twenty-five (25) feet measured from the highest portion of structure to the highest finished grade level at the foundation. (b) Roof mounted equipment including exterior mounted and ground mounted radio and television antennas shall not be permitted. SECTION 18.59.030 MULTIPLE-FANaILY RESIDENTIAL ZONES Subsection 18.59.031 Permitted Buildings and Uses. Those uses which are automatically or conditionally permstted in the specific zones shall be permitted automatically or condi- tionally except the following uses shall be excluded: 1. Hotels, motels, and motor inns Subsection 18.59.032 Site Development Standards. The Scenic Corridor site development standards are .intended to pro- vide for the continued orderly development of the City's scenic areas by encouraging a high quality of development in keeping with the natural amenities of these areas and preserving their unique scenic resources as an asset to the community. The following site development standards are established to insure harmony with adjacent uses of land and to retain the scenic characteristics of the areas: (1) MINIJ1.UM SI`Z'E AREA All sites shall be of sufficient size and width to accommodate the anticipated number of dwelling -2- units and parking spaces, open areas, and other structures and uses for which provisions are made in these zones. Further, the minimum project area shall be five (5) acres and such five (5) acre projects may develop as condominium projects or as multiple -family subdivisions. (2) BUILDING LOCATION On all lots adjacent to freeways, expressways, arterial 'highways, and railroad rights-of-way, buildings and mobilehome coaches shall be located no closer than fifty (50) feet to the right-of- way line. (3) PARKING AREA LANDSCAPING (a) The required fifty (50) feet shall be used for recreation and open space or may be used for open parking and vehicular accessways; provided that a minimum ten (10) foot wide screen plant- ing (may include trees or shrubs, etc., a mini- mum 42" high decorative masonry wall, a 42" high earthen berm, or any combination of these) shall be maintained adjacent to the right-of- way line. (b) All open parking areas and their adjacent vehicu- lar accessways shall be landscaped. Landscaping shall include at least one (1) tree per 3,000 square feet of open parking area and vehicular accessway evenly distributed throughout the open parking areas. SECTION 18.59.040 COMIvTERCIAL ZONES Subsection 18.59.041 Permitted Buildings and Uses. Those uses which are automatically—or conditionally perm z� ed in the specific zones shall be permitted automatically or condi- tionally except the following uses shall be excluded: 1. Office or commercial use of a residential structure. 2. Automobile, truck, or mobilehome sales lots (new or used) . 3. Billboards except temporary tract signs as provided in Section 18.62.070. 4. Service stations except where integrated with a shopping center. Subsection 18.59.042 Site Development Standards. The Scenic Corridor site development standards are intended to pro- vide for the continued orderly development of the City's scenic areas by encouraging a high quality of development in keeping with the natural amenities of these areas and preserving their unique scenic resources as an asset to the community. The following site development standards are established to insure harmony with adjacent uses of land and to retain the scenic characteristics of the areas. -3- (1) YARDS AND SETBACKS (a) All buildings along freeways, scenic highways shall maintain setback area having a minimum dred (100) feet. expressways, or a landscaped depth of one hun- (b) All buildings along major, primary, secondary, hillside primary or hillside secondary highways shall maintain a landscaped setbacs area having a minimum depth of fifty (50) feet. (c) All buildings along collector and local streets shall maintain a landscaped setback area having a minimum depth of twenty (20) feet. (d) The required landscaped setbacks listed above shall be either fully landscaped or may be used as part of an automobile parking area; provided that a minimum twenty (20) foot wide screen planting area shall be maintained adjacent to any right-of-way line. Where the developer pro- vides a three (3) foot high landscaped berm adjacent to the right-of-way line the planting and landscaping may be reduced to fourteen (14) feet. (e) Where the rear of a commercial building abuts upon a local street where two-thirds of property in the block on the opposite side of the street is zoned for residential use, a six (6) foot high masonry wall shall be provided to the rear of said screen planting area for the full width of the subject property. (f) Where an interior site boundary line abuts a residential zone a minimum ten (10) foot screen landscaped setback shall be provided adjacent to the property line. (2) BUILDING AND STRUCTURAL HEIGHT LIMITATIONS (a) The maximum building height shall be thirty-five (35) feet above the average finished grade levels of the building site on which it is located measured at the exterior building walls. (b) Roof mounted equipment including exterior mounted and ground mounted radio and television antennas shall not be permitted. (3) LANDSCAPING In addition to the required setback and slope land- scaping, all parking areas and vehicular accessways shall be landscaped. "Landscaping shall include at least one (1) tree per 3,000 square feet of parking area and/or vehicular accessway evenly distributed throughout tie parking area. There shall be an average of forty-eight (48) square feet of planter area pro- vided per tree. Said planter areas shall have a mini- mum dimension of six (6) feet. -4- (4) ON -PREMISE ADVERTISING SIGNS Signs as permitted in the C -H Commercial Hillside Zone and subject to the same standards. (5) OFF -PREMISE ADVERTISING SIGNS No billboard shall be permitted except tract adver- tising signs as provided under Section 18.62.070 of this code. SECTION 18.59.050 INDUSTRIAL ZONES Subsection 18.59.051 Permitted Buildings and Uses. Those uses wnich are automatically or conditionally permitted in the specific zones shall be permitted automatically or con- ditionally except the following uses shall be excluded: 1. Building material storage yard 2. Contractor storage yard 3. Draying, freighting or trucking yard or terminal 4. Large equipment storage or rental 5. Rags, paper, metals, or junk storage or sales 6. Rock, sand or gravel, wholesale storage or distribution 7. Auto or truck storage (new or used) 8. Mobilehome parks or travel trailer parks 9. Billboards 10. Amusement parks 11. Circuses, carnivals, or rodeos 12. Drive-in, walk-up or semi -enclosed restaurants 13. Borrow pits 14. Concrete batching or mixing of portland or asphaltic concrete 15. Dumps 16. Open air theaters 17. All outdoor aspects of permitted uses unless screened from the freeway or scenic highway by the use of wall, landscaping or both. SECTION 2. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circu- lated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
