ORDINANCE NO. 4505
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM REPEALING TITLE 7, CHAPTER 7.28,
SECTION 7.28.030 AND 7.28.040, AND ADDING A
NEW TITLE 7, CHAPTER 7.28, SECTION 7.28.030
TO THE ANAHEIM MUNICIPAL CODE PERTAINING TO
HOTEL AND MOTEL LOITERING.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
SECTION 1
That Title 7, Chapter 7.28, Sections 7.28.030 and
7.28.040 of the Anaheim Municipal Code be, and the same are hereby
repealed.
SECTION 2.
That Title 7, Chapter 7.28, Section 7.28.030 be added to
the Anaheim Municipal Code to read as follows:
"7.28.030 HOTEL AND MOTEL - LOITERING
It is unlawful for any person to refuse or
fail to leave the property of a hotel, as defined in
Section 18.01.090, or motel, as defined in Section
18.01.140, when requested to do so by the owner, the
owner's agent or by a peace officer when acting at the
request of the owner or the owner's agent. This Section
shall apply to all areas of the hotel or motel property
whether or not such areas are open to the general public.
Violation of this Section is a misdemeanor.
7.28.030.010 This Section shall not apply to persons
currently registered in the hotel or motel or to persons
who have otherwise been given the right to use a certain
portion or portions of the hotel or motel property by the
owner or the owner's agent.
7.28.030.020 This Section shall not apply to persons
engaged in lawful labor union activities.
7.28.030.030 This Section shall not apply where its
application results in or is coupled with an act
prohibited by the Unruh Civil Rights Act or any other
provision of law relating to prohibited discrimination
against any person on the basis of color, race, religion,
creed, ancestry or national origin.
7.28.030.040 This Section shall not apply where its
application results in or is coupled with an act
prohibited by Section 365 of the California Penal Code or
any other provision of law relating to duties of
innkeepers and common carriers.
7.28.030.050 Nothing contained in this Section shall
be construed or applied so as to abridge the lawful
exercise of rights guaranteed under the First Amendment
to the Constitution of the United States.
SECTION 3. SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance, hereby adopted, be declared for any reason to be
invalid, it is the intent of the Council that it would have passed
all other portions of this ordinance independent of the elim-
ination herefrom of any such portion as may be declared invalid.
SECTION 4. CERTIFICATION
The City Clerk shall certify to the passage of this or-
dinance and shall cause the same to be printed once within fifteen
(15) days after,.its adoption in the Anaheim Bulletin, a newspaper
of general circulation.,. published and circulated in said City, and
thirty (30) days from and after its final passage, it shall take
effect and be in full force.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 29th day of May, 1984.
