AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ANAHEIM,
CALIFORNIA AMENDING CERTAIN PROVISIONS OF ORDINANCE
NO. 4415 OF THE CITY COUNCIL.
WHEREAS, the City Council of the City of Anaheim (the
"City") at its meeting on April 26, 1983, adopted an Ordinance desig-
nated as Ordinance No. 4415 providing for the procedures for the
issuance, sale and securing of water revenue anticipation notes (the
"Notes") of the City and providing the terms and conditions of the
Notes (the "Ordinance"); and
WHEREAS, the City and Bank of America National Trust &
Savings Association (the "Bank") have heretofore entered into a
Revolving Credit Agreement dated June 1, 1983, related to the Notes;
and
WHEREAS, the City Council has determined that it is neces-
sary and desirable that the City Council amend the Ordinance to
revise the purposes for which the Notes may be issued; and
WHEREAS, the City has obtained or will obtain the consent
of the Bank to the amendments of the Ordinance hereinafter set forth;
and
WHEREAS, currently the City has no Notes outstanding;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM
DOES ORDAIN AS FOLLOWS:
SECTION 1. The second "WHEREAS" clause of the Ordinance
is hereby amended to read, in its entirety, as follows:
WHEREAS, the City of Anaheim incurs expenditures with
respect to its water system; and
SECTION 2. The fourth "WHEREAS" clause of the Ordinance
is hereby amended to read, in its entirety, as follows:
WHEREAS, the City Council has determined that it is in
the best interests of the City of Anaheim to issue and sell
Water Revenue Anticipation Notes pursuant to said Section
1210 of the Charter to defray certain of the expenditures
made or to be made with respect to its water system;
SECTION 3. Sub -section (m) of Section 1 of the Ordinance
is hereby amended to read, in its entirety, as follows:
(m) "Ordinance" or "this Ordinance" means Ordinance
No. 4415 as from time to time amended or supplemented in

accordance with the terms of Ordinance No. 4415 and the
Charter.
SECTION 4. Section 2 of the Ordinance is hereby amended
to read, in its entirety, as follows:
Section 2. Creation, Amount. Designation and Purpose
of Issue. In accordance with Section 1210 of the Charter,
there is hereby prescribed a procedure for the sale, secu-
rity and issuance from time to time of the Notes. The
principal amount of the Notes Outstanding in accordance
with their terms at any one time shall not exceed 25% of
the gross revenue earned by the Enterprise during the imme-
diately preceding fiscal year as set forth in the audited
financial statements of the Enterprise for such year or the
maximum aggregate amount of the revolving Water System
Credit available to the City as described in the Revolving
Credit Agreement, whichever is less. The Notes shall be
known as "City of Anaheim Water Revenue Anticipation Notes"
and shall be sold, secured and issued on such terms and
conditions as are hereinafter set forth, for the purpose of
defraying expenditures made or to be made for repairs,
enlargements, extensions or improvements of the
Enterprise.
SECTION 5. Sub -section (a) of Section 3 of the Ordinance
is hereby amended to read, in its entirety, as follows:
(a) Municipal Affairs. The financing and payment by
the City through the Notes of expenditures made or to be
made in the repair, enlargement, extension or improvement
of the Enterprise are incidental to the procurement and
distribution of water by the City and as such constitute
municipal affairs of the City which are not statewide
concerns.
SECTION 6. The City Clerk shall cause this Ordinance to
be published once within fifteen days after its adoption, in Tha
Anaheim Bulletin, the official newspaper of the City.
SECTION 7. This Ordinance shall become effective thirty
days from and after the date of its adoption. Except as amended
hereby, Ordinance No. 4415 remains in full force and effect.
