A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AUTHORIZING THE TRANSFER OF A PORTION
OF THE CITY'S APPROPRIATIONS LIMIT TO THE ANAHEIM
REDEVELOPMENT AGENCY AND AUTHORIZING A DECREASE
OF THE CITY'S APPROPRIATIONS LIMIT BY THE SAME
AMOUNT.
WHEREAS, pursuant to Revenue and Taxation Code Section 7202.6, the Anaheim
Redevelopment Agency (the "Agency") is considering adopting Ordinance No. to impose a
sales and use tax of one percent (1%) on retail sales and use of personal property; and
WHEREAS, pursuant to Revenue and Taxation Code Section 7202.5, the City Council of
the City of Anaheim (the "City") adopted Ordinance No. 5115 on April 3, 1990 which gives
credit against the City's existing sales and use tax for the sales and use tax paid to the Agency;
and
WHEREAS, the Agency and the City have entered or will enter a "Sales Tax Agreement"
whereby the Agency would reimburse to the City all of such sales and use tax revenue ("Sales
and Use Tax Proceeds") except those sums as are necessar~ for the Agency to satisfy its
obligations to assist certain retail development projects and to make other expenditures in
implementation of the Agency's Plaza Redevelopment Project; and
WHEREAS, pursuant to the California Constitution Article XIIIB, Ordinance Nos. 5115
and may cause a transfer of the financial responsibility of providing services from the City
to the Agency, and, therefore, the City by this resolution intends to adjust and decrease its
appropriations limit each year by the amount of sales tax collected and retained by the Agency if
such appropriations limit is applicable to the Agency.
NOW, THEREFORE, the City Council of the City of Anaheim does hereby
resolve as follows:
1. The City by Ordinances No. 5115 and may have transferred to the Agency
financial responsibility for providing services, specifically the removal of urban blight.
2. In accordance with California Constitution Article XIII B, Section 3, subdivision
(a), for the year in which this transfer becomes effective, the City's appropriations limit shall be
decreased by the reasonable a~nount mutually estimated by the City and the Agency, and in the
following years shall be decreased by the net amount of Sales and Use Tax Proceeds retained by
the Agency pursuant to the Sales Tax Agreement.
3. The City Manager of the City or his or her designee, in coordination with the
Executive Director of the Agency or his or her designee, is authorized and directed to calculate
the amount of the decrease in the appropriations limit for this year and in the following years for
which the Agency imposes and collects a sales and use tax.
4. The City accordingly this year reduces and in such following years will reduce its
appropriations limit by the amounts described in Section 3 above and to be determined by the
City Manager in coordination with the Executive Director of the Agency.
