Talley CITY ATTORNEY: William P. Hopkins SECRETARY: Linda D. Roberts EXECUTIVE DIRECTOR: Norman J. Priest Chairman Seymour called the regular meeting of the Anaheim Redevelop- ment Agency to order. MINUTES Approval of minutes was deferred to the next regular meeting. FINANCIAL DEMANDS AGAINST THE ANAHEIM REDEVELOPMENT AGENCY in the amount of $517,041.48, in accordance with the 1978 -79 Budget, were approved. 161.121: HEARING - PROPOSED CONDEMNATION OF CERTAIN REAL PROPERTY SPACIFIC TELEPHONE COMPANY) Executive Director Norman Priest reported on acquisition of real property within Redevelopment Project Alpha, owned by Pacific Telephone Company and located on the west side of Anaheim Boulevard from Cypress Street to Chartres Street. Subject property is involved in the projected widening of Anaheim Boulevard, as well as the imminent realignment of Lincoln Avenue. In response to question by Mr. Roth, Mr. Hopkins, City Attorney, expressed the opinion that Mr. Roth should continue to abstain from voting on matters involving the Lincoln Avenue realignment, due to his ownership of property at 1000 East Lincoln Avenue. Mr. Hopkins further advised that although the Agency could adopt a resolution authorizing condemnation of subject property with three affirmative votes, he would recommend delaying the vote until a new Council /Agency Member is appointed to fill the unexpired term of Mr. Kott (resigned effective April 30, 1979), in order to insure a two - thirds majority vote. In reply to question by Mr. Seymour, Mr. Priest advised that post- ponement of action on the recommendation could delay the project, and he suggested that representatives of Pacific Telephone Company be heard at this time. 79 -57 ANAHEIM REDEVELOPMENT AGENCY, MAY 8, 1979, 1:00 P.M. Chairman Seymour invited the Pacific Telephone Company representa- tive to address the Agency. Mr. R. William Ferrante, Attorney for Pacific Telephone Company, advised that they have been in negotiations for several months in an attempt to work out the proposed acquisition of property by the City. State law prevents any public utility from disposing of prop- erty which serves the public. He requested a thirty- to ninety -day postponement to allow for further negotiations between City staff and the company's Real Estate Department. Mr. Ferrante thereupon submitted a document setting forth the com- pany's position on this matter, and pointed out that subject property is part of a parking area used by company employees, and the proposed condemnation would eliminate 12,489 square feet of parking spaces, thereby reducing the number of spaces to 432, less than the 460 required by the City. In addition, the City has some construction activity which would expand Orange County's major switching center, as would normal growth in population, and parking needs will increase. Mr. Ferrante was of the opinion that the potential injury to Pacific Telephone Company could be minimized with the identification of an additional parking area which could be exchanged for subject property. Mr. Priest stated that although a one -week continuance of the hearing would not adversely affect the imminent realignment of Lincoln Avenue, he would be reluctant to delay the issue for any longer inasmuch as bids had already been received, and a determination would be immediately forthcoming for the project. Mr. Overholt moved that the hearing for the proposed acquisition of Pacific Telephone Company property be continued one week (May 15, 1979). Mrs. Kaywood seconded the motion. Mr. Ferrante re- stated his request for a minimum of thirty days. Mrs. Kaywood pointed out that a portion of the parking problem would very likely be resolved through necessary car - pooling and public transportation, due to the gasoline shortages currently being exper- ienced in California. Mr. Priest stated he would be happy to meet with Mr. Ferrante after the Agency meeting to identify the issues and review the situation. ---- He pointed out that negotiations for acquisition of subject property had been under way for more than one year. 79 -58 ANAHEIM REDEVELOPMENT AGENCY, MAY 8, 1979, 1 :00 P.M. Mr. Roth requested the record to show that he was abstaining from taking part in the discussion and action on this issue due to the fact that the outcome may affect the realignment of Lincoln Avenue, and he is the owner of property at 1000 East Lincoln Avenue. The motion to continue the hearing on proposed acquisition of subject property was re- stated. Mr. Roth abstained. MOTION CARRIED. 161.158: PROPOSED SALE OF AGENCY -OWNED EQUIPMENT On the recom- mendations of the Executive Director, Mrs. Kaywood moved that public hearing be authorized to consider the sale of Agency -owned property to the Anaheim Senior Citizens Club, Inc., and that the Agency Secre- tary be directed to fix the time and date of said hearing and publish appropriate public notice. Mr. Overholt seconded the motion. MOTION CARRIED. 161: NEW SENIOR CITIZENS APARTMENTS Mrs. Mary Berlin requested permission to address the Agency and thanked Agency Members for authorizing construction of the new 100 -unit senior citizens apart- ment facility which is now occupied and very much appreciated. ADJOURNMENT There being no further business to come before the Anaheim Redevelopment Agency, Mrs. Kaywood moved to adjourn. Mr. Overholt seconded the motion. MOTION CARRIED. ADJOURNED: 1:27.P.M.
