A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
AMENDING RATES, RULES AND REGULATIONS FOR THE SALE AND
DISTRIBUTION OF ELECTRICITY AS ADOPTED BY RESOLUTION NO.
71R-478 AND AS MOST RECENTLY AMENDED BY RESOLUTION NO.
93R-178 AND AMENDING RATES, RULES AND REGULATIONS FOR THE
SALE AND DISTRIBUTION OF WATER AS ADOPTED BY RESOLUTION
NO. 72R-600 AND AS MOST RECENTLY AMENDED BY RESOLUTION
NO. 93R-185.
WHEREAS, the City of Anaheim maintains electric and water
distribution systems for the furnishing of electricity and water to
residents and inhabitants of the City of Anaheim and has adopted
Rates, Rules and Regulations for the sale and distribution of
electricity and water; and
WHEREAS, the Public Utilities Board of the City of Anaheim at
its meeting on September 9, 1993, considered proposed revisions to
the Rates, Rules and Regulations concerning disputed bills for
electric and water service as set forth in Attachment A attached
hereto and incorporated by this reference ; and
WHEREAS, the Public Utilities Board recommended to the City
Council that the Council adopt the proposed revisions to the Rates,
Rules and Regulations as shown in Attachment A; and
WHEREAS, the City Council has considered the recommendation of
the Public utilities Board and concurs in that recommendation.
NOW, THEREFORE BE IT RESOLVED that:
1. The changes and additions to the Rates, Rules and
Regulations as shown in Attachment B are hereby adopted
by the City Council of the City of Anaheim and will
become effective October 1, 1993.
2. The Public Utilities General Manager is hereby authorized
and directed to prepare, promulgate, publish, and
implement changes and additions to the Rates, Rules and
Regulations as set forth herein.
THE FOREGOING RESOLUTION is approved and adopted by the City
Council of the City of Anaheim on this28th day of September ,
1993.

A. CONTRACTS
Each contract for water service shall contain the following provision:
"This contract shall at all times be subject to such changes or
modifications by the City Council of the City of Anaheim as said City
Council may, from time to time, direct in the exercise of its jurisdiction."
B. UTILITY BILL
The following statements will be printed on each utility bill:
1. "Bill is due upon receipt."
2. "PROCEDURES FOR PROCESSING PAYF~NT OF DISPUTED UTILITY BILL
Should you have a question regarding this bill, please request an
explanation from the Customer Services Division of the City of Anaheim,
within 10 days after receiving the bill. Your request may be made by
telephone (714 254-0125) or in writing (Customer Service Manager,
Public Utilities Department~ P.O. Box 3222, Anaheim, California 92803).
If, after you receive the explanation from Customer Service, you still
believe you have been billed incorrectly, you have ten days to send
your entire remittance (payable to the City of Anaheim) with the bill
and a written statement supporting your bclicf that thc bill setting
forth the reasons why you believe the bill is not correct to the
General Manager, Public Utilities Department, P.O. Box 3222 Anaheim,
California 92803, to avoid discontinuance of service. Upon timely
receipt of the written statement, the General Manager will review the
basis of the billed amount and authorisc any adjustmcnt rcquircd in
accordancc with his findings. communicate the results of the review and
decision to the customer. If the matter is not satisfactorily resolved
with the General Manager, you may petition the City Council Public
Utilities Hearing Board for final determination. In the absence of a
timely filed appeal, the decision of the Public Utilities General
Manager will be final."
C. DISCONTINUANCE OF SERVICE NOTICE (48 hr. final notice)
The following statement will be printed on each discontinuance of service
notice:
"If payment is not received by 5:00 p.m. on the date shown above your
service will be disconnected without further notice. Full payment of
the bill plus any reconnection charges will be required prior to any
restoration of services. A deposit may be required to reestablish your
credit, whether or not service is disconnected for nonpayment."
"Tampering with meter or unauthorized breaking of seal constitutes a
misdemeanor. Charges for equipment replacement must be paid in advance
of restoring the service."

RULE NO. 10
DISPUTED BILLS
A. A customer who feels that his/her bill is in error must first contact the
Customer Service Division by phone or in writing within ten (10) days after
receiving the bill to attempt to resolve the disputed bill. Failure to do
so will authorize discontinuance of service in accordance with Rule No. 11.
B. If, after contact with the Customer Service Division, the customer believes
the bill is still incorrect, the customer must, within ten (10) days after
receiving the explanation from Customer Service, send his/her remittance for
the entire amount of the disputed bill (payable to the City of Anaheim)
along with a written statement setting forth the reasons why the customer
believes the oupporting his/hcr position that thc bill is incorrect to the
Public Utilities General Manager, Public Utilities Department, P.O. Box
3222, Anaheim, California 92803.
C. Failure of the customer to file a written statement with the Public
~ Utilities General Manager within ten (10) days after receipt of the review
explanation from the Customer Service Division will constitute acceptance
by the customer of the bill as rendered, and ;'ratrant authorize
discontinuance of service in accordance with Rule No. 11.
D. Upon timely receipt of the written statement, the Public Utilities General
Manager or his designee will review the basis of the billed amount, and
communicate the results of the review and decision to the customer.
E. If before completion of the Public Utilities General Manager's review,
additional bills become due which the customer wishes to dispute, the
customer will not be required to file the dispute with the Customer Service
Division, as stated in Rule 10.A. above; but will be required to send
his/her remittance (payable to the City of Anaheim) for the entire amount
of the additional bills disputed to the Public Utilities General Manager and
file additional written statements within ten (10) days after receipt of
such bills supporting thc bclicf that such bills arc incorrcct. setting
forth the reasons why the customer believes the additional bills are
incorrect. Failure to do so will %'ratrant authorize discontinuance of
service in accordance with Rule No. 11.
F. If the bill is not satisfactorily resolved with the Public Hearing Utilities
General Manager or his designee the customer may pctition thc City Council

The appeal must be submitted in writing to the chairman of the Public
Utilities Board, together with reasons for the dispute within seven (7) days
following receipt of the Public Utilities GeneralManager's review. In the
absence of a timely filed appeal, the decision of the General Manager shall
be final. Upon receipt of a timely appeal, a hearing will be held by the
Public Utilities Hearing Board within sixty (60) days of receipt of a
request for appeal. A written decision of the Public Utilities Hearing
Board shall be delivered to the customer by personal delivery or certified
mail within fifteen (15) days following the appeal hearing. The decision
of the Public Utilities Hearing Board shall be final.
