A complete copy of the agenda for the meeting of the Anaheim Redevelopment
Agency was posted at 4:30 p.m. on July 13, 1990 at the Civic Center kiosk,
containing all items as shown herein.
Chairman Hunter called the regular meeting of the Anaheim Redevelopment Agency
to order at 5:40 p.m.
MINUTES: Approval of the minutes was deferred to the next regular meeting.
FINANCIAL DEMANDS AGAINST THE ANAHEIM REDEVELOPMENT AGENCY in the amount of
$450,025.12 for the week ending July 13, 1990, in accordance with the 1990 -91
Budget, were approved.
161.157. RECEIVING AND FILING ORDINANCE NO. 5136: Agency Member Pickler
moved to receive Ordinance No. 5136 adopting the Redevelopment Plan for the
Plaza Redevelopment Project. Agency Member Hunter seconded the motion.
MOTION CARRIED.
ITEMS OF PUBLIC INTEREST:
Barbara Marr, California Citizens for Law and Order, Fullerton. She posed
questions relative to the extent of the Redevelopment Agency's jurisdiction on
the square block on which the Civic Center and various buildings sit,
specifically the Celebrity Theatre which is C -G zoning. She wanted to know if
it can be used for adult -only business.
Lisa Stipkovich, Executive Director of Community Development answered no and
then deferred to the City Attorney.
City Attorney Jack White. If the question is does the Redevelopment Agency or
Council have the authority to prohibit the conduct of a single event at the
Celebrity Theatre because that event may constitute an adult business, the
answer is no. The California State Supreme Court has held that a single or
sporadic use of the property that does not constitute a substantial portion of
the total activity on that property is not an adult business and does not
constitute a zoning violation. He reiterated even though the activity being
conducted may fall within the definition of an adult business, that activity
cannot be prosecuted as a zoning violation unless it is being conducted on
more than an isolated or sporadic basis. One performance of one event at the
Celebrity Theatre does not constitute a zoning violation even if it fits the
definition of an adult business.
