Chairman Seymour called the regular meeting of the Anaheim Redevelopment
Agency to order.
MINUTES On motion by Mrs. Kaywood, seconded by Mr. Roth, minutes of
th(.: Anaheim Redevelopment Agency regular meeting of August 29, 1978,
were approved. MOTION CARRIED.
FINANCIAL DEMANDS AGAINST THE ANAHEIM REDEVELOPMENT AGENCY in the
amount of $87,365.59, in accordance with the 1978 -79 Budget, were
approved.
161: MONTHLY STATUS REPORT - SEPTEMBER, 1978: On motion by Mr. Kott,
seconded by Mrs. Kaywood, the Month y Status Report dated October 3,
1978, covering Redevelopment activities for the month of September 1978,

Mr. Ben Bay, Redevelopment Commissioner, addressed the Agency briefly,
summarizing the discussion and action of the Redevelopment Commission,
and reviewed the September 1 hearing before the State Historic Com-
mission, noting that there were serious differences of opinion
evidenced. The issue encompasses federal criteria of what is histor-
ically significant, and it was felt that the decision to preserve or
not preserve a structure should be made by the local government,
rather than a State office or commission.
Responding to question by Mr. Kott, Mr. Bay recalled that eight Redevel
opment Commission public hearings on possible redirection of the City's
Redevelopment Program were held in 1976, and from those hearings and
from discussions with many other citizens, he felt the opinion of the
majority of people is that historic preservation should be determined
by local entities.
Discussion was held and Chairman Seymour briefly reviewed the redirec-
tion of the City's Redevelopment Program which had taken place in
1976. He noted that when City representatives attended the State
Historic Commission's hearing to consider application by the Anaheim
Historical Society for preservation of certain additional structures,
they received impolite treatment. He was of the opinion that said
Commission had made a decision, after rejecting much of the evidence
without review thereof, and without receiving full input, and had
declared some twenty -four buildings historic and should be pre-
served. Now the Commission is offering a rehearing on this issue,
subject to conditions. He pointed out the impact on the City's
redevelopment progress which can be made by decisions rendered by
non - elected, State - appointed bodies. The City of Anaheim has made a
commitment to its citizens and has signed contracts with developers
which, if certain structures were newly designated for preservation,
could be subject to lawsuits against the City. The downtown area is
undergoing a thorough revitalization process.
Mr. Seymour moved that the Redevelopment Agency instruct the
Executive Director to respond to the State Historical Commission,
that a rehearing is considered appropriate, without making any con-
cessions, due to the admitted irregularities that occurred prior to
and during the public hearing held in Los Angeles on September 1,
1978, as recommended by the Community Redevelopment Commission.
Mr. Kott seconded the motion. MOTION CARRIED.
161.123: AGREEMENT - JACOBS, KANE, BALLMER AND BERKMAN, ADDITIONAL
PAYMENT On report and recommendation by the Executive Director,
Mr. Overholt moved that payment of the amount billed for services
rendered during the months of May, July and August, 1978, by Jacobs,
Kane, Ballmer and Berkman, in excess of the maximum amount payable
by the Redevelopment staff under terms of the agreement be authorized
in the amount of $4,244,96. Mr. Roth seconded the motion. MOTION
CARRIED.

161.158: ZION LUTHERAN CHURCH WINDOWS: Mr. Michael Valenti, 202 E.
Adele Street, Anaheim, addressed the Redevelopment Agency referring
to his letter to the Executive Director dated October 4, 1978, which
posed six questions regarding procedures which were followed by the
City for the sale and removal of stained glass windows from the former
Zion Lutheran Church building. He advised of response received from
Mr. Priest, and acknowledged that in his letter to the Executive
Director he had quoted as the high bid received an incorrect amount
of $1,200 rather than the actual $1,528.85 high bid. However, he
was of the opinion that award of bid in that amount cost the City
$78,471.15, considering the actual market value of this stained glass.
Mr. Valenti criticized the procedures as outlined in Mr. Priest's
response to his letter, questioning why only appraisal of the glass
was obtained, why the windows were not preserved as a part of the
City's historical patrimony, and why there is no comprehensive
architectural plan to assess and utilize materials such as these.
In response to question by Agency Members, Mr. Valenti advised that
his estimate on the value of the stained glass windows was based on
his experience as a collector, on certain research in the field, and
on the opinion of a friend and colleague who makes stained glass his
business. They felt there would have been no problem in retailing
the windows in question for between $70,000 and X75,000.
Mr. Valenti went over the questions and answers from the Executive
Director, advising that the successful bidder for the windows, Pat
Proppe Antiques, had informed him they expected to retail the windows
at $45 per square foot. He advocated adaptive re -use of historic
items under the Redevelopment Program, being of the opinion that
this was an important decision area and one of those which underlie
the clash between the Anaheim Historic Society and the Redevelopment
Agency. He requested that the Redevelopment staff be directed
towards more preservation and adaptive re -use of historic materials.
Mr. Priest briefly reported that the building was acquired by the
Agency for demolition, and the windows had to be removed by an
expert so as not to lose the glass through breakage. The $4,000
in -place appraisal of the windows was made by a fixtures appraiser,
and it was felt if the windows were auctioned, it would be difficult
to acquire the fair price. Bids ranged from $1,528.85 down to
$101.01, and the sale was conducted by sealed bid under strict com-
petitive conditions.
Mr. Valenti expressed concern that other historical items are not
being preserved; for instance, where wheel chair ramps are being
installed at certain downtown corners, old street names engraved in
cement are not sawed out for preservation. He noted the possibility
that critical decisions may be made by Redevelopment Department
employees who are not necessarily residents of the city.
Mr. Priest pointed out that projects such as installation of wheel
chair ramps are conducted only after public hearings open to Anaheim
citizens are held for the express purpose of taking input from those
who are interested. The Redevelopment Department and Commission are
open to suggestions.

Discussion was held, and Mr. Seymour stated he was sensitive to
Mr. Valenti's viewpoint, and felt the Redevelopment Department
should be alert for artifacts which could be housed and perhaps
incorporated aesthetically or architecturally in some new develop-
ments. He was satisfied, after looking into the matter, that the
sale of stained glass windows was conducted in an entirely legal
manner and there were no intended irregularities. He requested that
Mr. Valenti and other interested parties come forward with suggestions
and input in advance, rather than after the fact.
At the conclusion of the discussion, Mr. Overholt moved that the
action taken September 19, 1978, under Resolution No. ARA78 -106,
awarding bid for purchase and removal of stained glass windows of the
former Zion Lutheran Church to Pat Proppe Antiques in the amount of
$1,528.85, be reaffirmed. Mr. Seymour seconded the motion. MOTION
CARRIED.
ADJOURNMENT: There being no further business to come before the
Anaheim Re evelopment Agency, Mr. Kott moved to adjourn. Mr. Roth
seconded the motion. MOTION CARRIED.
