(Contract No. SI78 -2) WHEREAS, the Anaheim Redevelopment Agency did cause to be published in a newspaper of general circulation, printed, pub- lished and circulated in the City of Anaheim, to wit: The Anaheim, Bulletin, on the 5th and f'th cays of May, 1970, a notice inviting sealed proposals for furnishing the following: All plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete in a good and workmanlike man- ner, in strict accordance with the specifications, plans and drawings therefor on file in the Office of the Secretary of the Agency, the following public im- provement, to wit: Construction of public parking lot east side of Harbor Boulevard, between Oak and Chestnut Streets, in the City of Anaheim, consisting of clearing and grubbing; compacted fill; construction of asphalt concrete paved surface; concrete sidewalk; concrete curb and gutter; striping; minor landscaping and all appurtenant work as shown on the plans and delineated in the specifi- cations on file in the Agency offices, Contract No. SI78 -2, in accordance with the specifications on file in the Office of the Secretary of the Agency; and WHEREAS, said notice inviting sealed proposals for Improvement did provide that sealed proposals would be received by the Anaheim Redevelopment Agency at the Office of the Secre- tary of the Anaheim Redevelopment Agency up to the hour of 2:00 o'clock P.M. on the 15th day of ray, 1979, for the furnishing of all plant, labor, services, materials and equipment, all utilities and transportation, including power, fuel and water, and perform- ing all work necessary to complete in a good and workmanlike man- ner, the Improvement hereinabove more particularly mentioned and described, and which notice did state and declare that pursuant to the provisions of Section 1770 of the Labor Code, the Anaheim Redevelopment Agency had ascertained the prevailing rate of wages in the locality in which this type of labor is to be per- formed for each craft or type of workman or mechanic needed to execute the contract, and which wage scale is on file in the Office of the Secretary of the Agency; and -1- WHEREAS, the Executive Director of the Agency did re- ceive the following sealed proposals prior to 2:00 o'clock P.M. on the 15th day of May, 1978, in response to the notice aforesaid inviting sealed proposals, to wit: NME TO�l'AL PRICE SCH AIT CONTRACT01M, INC. o . . . . . $27,404.25 SULLY- MILLFR CO %1TPACTIr4G COMPANY o . . . . . $ 29 , 201.0 5 JO.IUM W. TIEDPIANN COMPANY . . . . . . . . . . . . $29,690.06 WHEREAS, the Agency Representative did thereupon examine and tabulate sealed proposals and did report to the Anaheim Rede- velopment Agency the result of his examination and tabulation; and WHEREAS, the Anaheim Redevelopment Agency finds that the sealed proposal submitted by SCE AM24 CONTRACTORS, INC., 1245 East Walnut Street, Suite 197, Pasadena, California 91106 (hereinafter "successful bidder ") is the lowest responsible proposal submitted for the furnishing of all plant, labor, services, materials and equipment, all utilities and transportation, including power, fuel and water and performing all worm necessary to complete in a good and workmanlike manner, in strict accordance with the specifications therefor on file in the Office of the Secretary of the Agency, the Improvement hereinabove mentioned and described, together with the appurtenances thereto, and as specified in the notice invit- ing sealed proposals, and that said proposal of said above -named bidder should be accepted and a contract awarded to said bidder in accordance therewith; and+. WETEREAS, the Anaheim. Redevelopment Agency finds that the above - mentioned sealed proposal is tie lowest responsible proposal received and that the person, firm or corporation submitting said proposal is a responsible person, firm or corporation and that the proposal submitted is the best suited and fitted for the Improvement to be undertaken; and WHEREAS, the Anaheim Redevelopment Agency does hereby approve, in accordance with Section 830.6 of the Government Code, the plan or design of Improvement. NOW, THEREFORE, BE IT RESOLVED by the Anaheim Redevelop- ment Agency that the sealed proposal submitted by said contractor for the furnishing of all plant, labor, services, materials and equipment, all utilities and transportation, including power, fuel and water, and performing all work necessary to complete, in a good and workmanlike manner, in strict accordance with the specifications therefor on file in the Office of the Secretary of the Anaheim Rede- velopment Agency and the notice inviting sealed proposals, the Improvement hereinabove more particularly mentioned and described, -2- together with the appurtenances thereto, be, and the same is hereby, accepted, and that a contract for the completion of saic: Improvement be, and the same is hereby, awarded to the said above- narked kidder. AND BE IT FURTHER RESOLVED that the successful bidder or bidders upon each contract awarded as hereinabove set forth, shall be, and they are hereby, required to execute a contract in the re- quired form with the Anaheim Redevelopment Agency upon the terms and conditions specified in the notice inviting sealed proposals and the proposal submitted by said successful bidder or bidders and in accordance with the specifications for said Improvement here- inabove described, and in accordance with the terms, conditions and provisions of this resolution, and that said successful bidder or bidders to whom each contract is awarded shall be required to fur- nish a surety bond in an amount equal to one hundred percent (100%) of the contract price for all labor, materials and equipment to be furnished and performed, as set forth in the sealed proposal sub- mitted bv_ said bidder for the Improvement, together with the appur- tenances thereto or such portion thereof as is covered by said contract, as security for the faithful performance of said contract, and a separate surety bond in an amount equal to one hundred per- cent (1000) of the cost of said Improverent covered by said contract, as security for the payment of all persons performing labor and fur- nishing material for said Improvement. A 7D BE II' FURTHER RFSOLNTM that said successful bidder or bidders be, and they are heresy, required to furnish to the Anaheim Redevelopment Agency in companies satisfactory to the Anaheim Redevelopment Agency, public liability, property damage, compensation, and other insurance in the amounts and for the pur- poses set forth and specified in the notice inviting sealed pron?o- sals, and subject to the approval of the General Counsel of the Agency as to form and sufficiency.
