ARA78 - �55 A RESOLUTION OF THE ANAHEIM REDEVELOPMENT AGENCY ACCEPTING A SEALED PROPOSAL AND AWARDING A CONTRACT TO THE LOWEST RESPON- SIBLE BIDDER FOR THE FOLLOWING WORK OF IMPROVEMENT. ( Contract No. S178-1) WHEREAS, the Anaheim Redevelopment Agency did cause to be published in a newspaper of general circulation, printed, pub- lished and circulated in the City of Anaheim, to wit: The Anaheim Bulletin, on the 14th day of April, 1978, a notice inviting sealed proposals for furnishing the following: All plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete in a good and workmanlike man- ner, in strict accordance with the specifications, plans and drawings therefor on file in the Office of the Secretary of the Agency, the following public improvement, to wit: Construction of asphalt concrete pavement on two park- ing lots located (1) east side of Anaheim Blvd. at alley between Chartres Street and Lincoln Avenue; and (2) east side of Emily Street (now abandoned) at alley between Chartres Street and Lincoln Avenue, in the City of Anaheim, consisting of grading, compacting and construction of asphalt concrete surface, and appur- tenant work as shown on the plans and delineated in the specifications on file in the office of the Rede- velopment Agency, Contract No. SI78 - (hereinafter "Improvement ") , in accordance with the specifications on file in the Office of the Secretary of the Agency; and WHEREAS, said notice inviting sealed proposals for Improvement did provide that sealed proposals would be received by the Anaheim Redevelopment Agency at the Office of the Secretary of the Anaheim Redevelopment Agency up to the hour of 2:00 o'clock P.M. on the 24th day of April, 1978, for the furnishing of all plant, labor, services, materials and equipment, all utilities and trans- portation, including power, fuel and water, and performing all work necessary to complete in a good and workmanlike manner, the Improve- ment hereinabove more particularly mentioned and described, and which notice did state and declare that pursuant to the provisions -1- of Section 1770 of the Labor Code, the Anaheim Redevelopment Agency had ascertained the prevailing rate of wages in the locality in which this type of labor is to be performed for each craft or type of workman or mechanic needed to execute the contract, and which wage scale is on file in the Office of the Secretary of the Agency; and WHEREAS, the Secretary of the Agency did receive the following sealed proposals prior to 2:00 o'clock P.M. on the 24th day of April, 1978, in response to the notice aforesaid inviting sealed proposals, to wit: NAME TOTAL PRICE JOHN W. NOBLE CO . . . . . . . . . . . . . . . . . . $10,563.00 WHEREAS, the Agency Representative did thereupon examine and tabulate said sealed proposals and did report to the Anaheim Redevelopment Agency the result of his examination and tabulation; and WHEREAS, the Anaheim Redevelopment Agency finds that the sealed proposal submitted by JOHN W. TIEDEMANN CO., P. 0. Box 4069, Whittier, California 90607 (hereinafter "successful bidder ") is the lowest responsible proposal submitted for the furnishing of all plant, labor, services, materials and equipment, all utilities and transportation, including power, fuel and water and performing all work necessary to complete in a good and workmanlike manner, in strict accordance with the specifications therefor on file in the Office of the Secretary of the Agency, the Improvement hereinabove mentioned and described, together with the appurtenances thereto, and as specified in the notice inviting sealed proposals, and that said proposal of said above -named bidder should be accepted and a contract awarded to said bidder in accordance therewith; and WHEREAS, the Anaheim Redevelopment Agency finds that the above- mentioned sealed proposal is the lowest responsible proposal received and that the person, firm or corporation submitting said proposal is a responsible person, firm or corporation and that the proposal submitted is the best suited and fitted for the Improvement to be undertaken; and WHEREAS, the Anaheim Redevelopment Agency does hereby approve, in accordance with Section 830.6 of the Government Code, the plan or design of Improvement. -2- NOW, THEREFORE, BE IT RESOLVED by the Anaheim Redevelop- ment Agency that the sealed proposal submitted by said contractor for the furnishing of all plant, labor, services, materials and equipment, all utilities and transportation, including power, fuel and water, and performing all work necessary to complete, in a good and workmanlike manner, in strict accordance with the specifications therefor on file in the Office of the Secretary of the Anaheim Rede- velopment Agency and the notice inviting sealed proposals, the Improvement hereinabove more particularly mentioned and described, together with the appurtenances thereto, be, and the same is hereby, accepted, and that a contract for the completion of said Improvement be, and the same is hereby, awarded to the said above -named bidder. AND BE IT FURTHER RESOLVED that the successful bidder or bidders upon each contract awarded as hereinabove set forth, shall be, and they are hereby, required to execute a contract in the re- quired form with the Anaheim Redevelopment Agency upon the terms and conditions specified in the notice inviting sealed proposals and the proposal submitted by said successful bidder or bidders and in accordance with the specifications for said Improvement hereinabove described, and in accordance with the terms, conditions and provi- sions of this resolution, and that said successful bidder or bidders to whom each contract is awarded shall be required to furnish a surety bond in an amount equal to one hundred percent (100 %) of the contract price for all labor, materials and equipment to be furnished and performed, as set forth in the sealed proposal submitted by said bidder for the Improvement, together with the appurtenances thereto or such portion thereof as is covered by said contract, as security for the faithful performance of said contract, and a sepa- rate surety bond in an amount equal to one hundred percent (100 %) of the cost of said demolition and clearance covered by said contract, as security for the payment of all persons performing labor and fur- nishing material for said Improvement. AND BE IT FURTHER RESOLVED that said successful bidder or bidders be, and they are hereby, required to furnish to the Anaheim Redevelopment Agency in companies satisfactory to the Anaheim Redevelopment Agency, public liability, property damage, compensation, and other insurance in the amounts and for the pur- poses set forth and specified in the notice inviting sealed propo- sals, and subject to the approval of the General Counsel of the Agency as to form and sufficiency. AND BE IT FURTHER RESOLVED that the Chairman and Secretary of the Anaheim Redevelopment Agency be, and they are hereby, author- ized and directed to make, execute and enter into, for and on behalf of the Anaheim Redevelopment Agency, a written contract with said successful bidder or bidders for the furnishing of all plant, labor, materials, and equipment and performing all work, as hereinabove more particularly described for the completion of said Improvement hereinabove described upon the terms and conditions as specified in -3- the notice inviting sealed proposals, the specifications, and all addenda thereto, and all modifications incorporated therein prior to the date of the opening of bids, on file in the Office of the Secre- tary of the Anaheim Redevelopment Agency and in strict accordance with the terms, conditions and provisions of this resolution, and in accordance with all of the contract documents herein specified. THE FOREGOING RESOLUTION is approved and signed by me this 2nd day of May, 1978.
