A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM REVISING THE PARKING FEES AT
ANAHEIM STADIUM FOR ARENA EVENT PARKING
WHEREAS, the City of Anaheim (the "City") owns and
operates certain parking facilities within the City and located
on the parking lots adjacent to Anaheim Stadium; and
WHEREAS, the City Council of the City has heretofore
established, and from time to time revised, the parking fees for
vehicle parking at Anaheim Stadium; and
WHEREAS, Ogden Facility Management Corporation of
Anaheim ("Ogden") is the manager and operator of the Arrowhead
Pond of Anaheim (the "Arena"), including parking facilities
related thereto (the "Arena parking"), pursuant to the Second
Amended and Restated Management Agreement dated as of December 1,
1993 between the City and Ogden; and
WHEREAS, the City has heretofore entered into an
agreement with Ogden dated as of March 16, 1994 (the "Parking
Agreement") relating to parking for Arena patrons and employees
at Anaheim Stadium at certain times and on certain dates at the
sole discretion of the City as more fully set forth in said
Parking Agreement; and
WHEREAS, the City Council desires to revise the parking
fees for vehicle parking at Anaheim Stadium by Arena patrons
during times the Stadium parking lots are open solely for the
purpose of providing parking for Arena patrons and employees.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that, during such times as the Anaheim
Stadium parking lots, or any of them, are open and operated
solely to provide parking for Arena patrons and employees, the
following parking rates shall apply for the Anaheim Stadium
parking lots:
1. Arena employee parking shall be charged to Ogden
at the rate set forth in the Parking Agreement, as the same may
from time to time be amended.
2. Arena patron and other general parking for
vehicles not exceeding twenty feet (20') in length shall be at a
competitive rate set from time to time by the Stadium General
Manager provided such amount shall not exceed the parking fee
charged by Ogden for Arena parking for vehicles of comparable
size.
3. Arena patron and other general parking for
vehicles exceeding twenty feet (20') in length shall be double
the rate established pursuant to paragraph 2 above.
BE IT FURTHER RESOLVED that this resolution shall
supersede all previous resolutions and actions of the City
Council pertaining to parking fees at Anaheim Stadium which
resolutions or actions are inconsistent or in conflict with the
express provisions of this resolution.
BE IT FURTHER RESOLVED that nothing contained in this
resolution shall be deemed to (i) authorize the use of the
Anaheim Stadium parking lots for Arena event parking to the
extent and during such times as such Stadium parking is
prohibited by any other agreement to which the City is a party,
including agreements with the Golden West Baseball Company and
the Los Angeles Rams Football Company, or (ii) effect or modify
the parking fees charged for parking at Anaheim Stadium during
such times as such parking lots are open and operated for any
Stadium events.
BE IT FURTHER RESOLVED that this resolution shall take
effect immediately upon adoption.
THE FOREGOING RESOLUTION is approved and adopted by the
