ARA1981-025RESOLUTION NO. ARA81 -25 A RESOLUTION OF THE ANAHEIM REDEVELOPMENT AGENCY ACCEPTING A SEALED PROPOSAL AND AWARDING A CONTRACT TO THE LOWEST RESPON- SIBLE .BIDDER FOR SITE CLEARANCE AND GRADING AND CONSTRUCTION OF PERIMETER IMPROVEMENT FOR CERTAIN AGENCY PROPERTIES. (Contract D81 -5) WHEREAS, the Anaheim Redevelopment Agency did cause to be published in a newspaper of general circulation, printed, pub- lished and circulated in the City of .Anaheim, to wit: The Anaheim Bulletin, on the 13th and 19th days of August, 1981, a notice inviting sealed proposals for site clearance and grading of, and construction of perimeter improvements to, the following Agency properties, to wit: A parcel of land bounded generally by Anaheim Boulevard, Cypress Street, Claudina Street and realigned Lincoln Avenue - Parcel Map No. 80 -264, designated as Contract D81 -5, in accordance with the specifications on file in the Office of the Secretary of the Agency; and WHEREAS, said notice inviting sealed proposals for said clearance, grading and construction did provide that sealed propo- sals would be received by the Anaheim Redevelopment Agency at the Office of the Secretary of the Anaheim Redevelopment Agency up to the hour of 2:00 o'clock P.M. on the 27th day of August, 1981, for the furnishing of all plant, labor, services, materials and equip- ment, all utilities and transportation, including power, fuel and water, and performing all work necessary to complete in a good and workmanlike manner, the clearance, grading and construction herein - above more particularly mentioned and described, and which notice did state and declare that pursuant to the provisions of Section 1770 of the Labor Code, the Anaheim Redevelopment Agency had ascertained the prevailing rate of wages in the locality in which this type of labor is to be performed for each craft or type of workman or mechanic needed to execute the contract, and which wage scale is on file in the Office of the Secretary of the Agency; and WHEREAS, the Secretary of the Agency did receive the following sealed proposals prior to 2:00 o'clock P.M. on the 27th day of August, 1981, in response to the notice aforesaid inviting sealed proposals, to wit: -1- NAME FIVE STATES PLUMBING & TOTAL PRICE JAMES I. NOBLE COMPANY . . . . . . . . . . . . . . . . . $80,458.73 COXCO ASSOCIATES . . . . . . . . . . . . . . . . . . $94,286.80 AND WHEREAS, the Agency Representative did thereupon examine and tabulate said sealed proposals and did report to the Anaheim Redevelopment Agency the result of the Representative's examination and tabulation; and WHEREAS, the Anaheim Redevelopment Agency finds that the sealed proposal submitted by FIVE STATES PLUMBING & JAMES I. LANGFORD PLUMBING, J.V., 677 Hariton Street, Orange, California 92667, is the lowest responsible proposal submitted for the furnishing of all plant, labor, services, materials and equipment, all utilities and transportation, including power, .fuel and water and performing all work necessary to complete in a good and workmanlike manner, in strict accordance with the specifications therefor on file in the Office of the Secretary of the Agency, the site clearance and grading and construction hereinabove mentioned and described, to- gether with the appurtenances thereto, and as specified in the notice inviting sealed proposals, and that said proposal of said above -named bidder should be accepted and a contract awarded to said bidder in accordance therewith; and WHEREAS, the Anaheim Redevelopment Agency finds that the above - mentioned sealed proposal is the lowest responsible proposal received and that the person, firm or corporation submitting said proposal is a responsible person, firm or corporation and that the proposal submitted is the best suited and fitted for the site clear- ance and grading and construction to be undertaken. NOW, THEREFORE, BE IT RESOLVED by the Anaheim Redevelopment Agency that the sealed proposal submitted by said contractor for the furnishing of all plant, labor, services, materials and equipment, all utilities and transportation, including power, fuel and water, and performing all work necessary to complete, in a good and workman- like manner, in strict accordance with the specifications therefor on file in the Office of the Secretary of the Anaheim Redevelopment Agency and the notice inviting sealed proposals, the site clearance and grading and construction hereinabove more particularly mentioned and described, together with the appurtenances thereto, be, and the same is hereby, accepted and that a contract for the completion of said site clearance and grading and construction be, and the same is hereby, awarded to the said above -named bidder. -2- BE IT r'URTHER RESOLVED that the successful bidder or bidders upon each contract awarded as hereinabove set forth shall be, and they are hereby, required to execute a contract in the required form with the Anaheim Redevelopment Agency upon the terms and conditions specified in the notice inviting sealed proposals and the proposal submitted by said successful bidder or bidders and in accordance with the specifications for said site clearance and grading and construction hereinabove described, and in accordance with the terms, conditions and provisions of this resolution, and that said successful bidder or bidders to whom each contract is awarded shall be required to furnish a surety bond in an amount equal to one hundred percent (100 %) of the contract price for all labor, materials and equipment to be furnished and performed, as set forth in the sealed proposal submitted by said bidder for the site clearance and grading and construction, together with the appurtenances thereto or such portion thereof as is covered by said contract, as security for the faithful performance of said contract, and a separate surety bond in an amount equal to one hundred percent (100 %) of the cost of said site clearance and grading and construc- tion covered by said contract as security for the payment of all persons performing labor and furnishing material for said site clearance and grading and construction. BE IT FURTHER RESOLVED that said successful bidder or bidders be, and they are hereby, required to furnish to the Anaheim Redevelopment Agency in companies satisfactory to the Anaheim Redevelopment Agency, public liability, property damage, compensa- tion, and other insurance in the amounts and for the purposes set forth and specified in the notice inviting sealed proposals, and subject to the approval of the General Counsel of the Agency as to form and sufficiency. BE IT FURTHER RESOLVED that the Chairman and Secretary of the Anaheim Redevelopment Agency be, and they are hereby, authorized and directed to make, execute and enter into, for and on behalf of the Anaheim Redevelopment Agency, a written contract with said suc- cessful bidder or bidders for the furnishing of all plant, labor, materials, and equipment and performing all work, as hereinabove more particularly described for the completion of said site clearance and grading and construction hereinabove described upon the terms and conditions as specified in the notice inviting sealed proposals, the specifications, and all addenda thereto, and all modifications incor- porated therein prior to the date of the opening of bids, on file in the Office of the Secretary of the Anaheim Redevelopment Agency and in strict accordance with the terms, conditions and provisions of this resolution, and in accordance with all of the contract documents herein specified. BE IT FURTHER RESOLVED that should Five States Plumbing & James I. Langford Plumbing, a joint venture, fail to post the re- quired bonds or insurance, or otherwise fail to execute a contract for the work, that said Agency officers are directed to take such steps as are necessary to execute the agreement with the next lowest responsible bidder (A & C General Engineering Contractors, Inc. in the amount of $70,591.05). -3- THE FOREGOING RESOLUTION is approved and adopted by the Anaheim Redevelopment Agency this 15th day of� SWtember, 1981.
