A RESOLUTION OF THE ANAHEIM REDEVELOPMENT
AGENCY ACCEPTING A SEALED PROPOSAL AND
AWARDING A CONTRACT TO THE LOWEST RESPONSIBLE
BIDDER FOR DEMOLITION AND CLEARANCE OF CERTAIN
AGENCY PROPERTIES. (D78 -8RB)
WHEREAS, the Agency, by Resolution ARA 78- 102
awarded Contract No. D78 -8 for certain demolition work to
Wilkinson Construction, and due to the failure of said firm
to complete the work, the Agency, by adopting Resolution
ARA 79 -46, authorized the Executive Director to seek bids
for the uncompleted work for demolition and site clearance
of the following Agency properties, to wit:
in accordance with the specifications on file in the Office of
the Secretary of the Agency; and
WHEREAS, sealed proposals for said demolition and
clearance were received by the Anaheim Redevelopment Agency
at the Office of the Secretary of the Anaheim Redevelopment
Agency on May 29, 1979 for the furnishing of all plant, labor,
services, materials and equipment, all utilities and transpor-
tation, including power, fuel and water, and performing all
work necessary to complete in a good and workmanlike manner,
the demolition and clearance hereinabove more particularly
mentioned and described, and which, pursuant to the provisions
of Section 1770 of the Labor Code, the Anaheim Redevelopment
Agency had ascertained the prevailing rate of wages in the
locality in which this type of labor is to be performed for
each craft or type of workman or mechanic needed to execute
the contract, and which wage scale is on file in the Offices
of the Secretary of the Agency; and
WHEREAS, the Secretary of the Agency did receive the
following sealed proposals on the 29th day of May, 1979, in
response to the Agency's request for rebidding, to wit:

the Secretary of the Agency; and
WHEREAS, sealed proposals for said demolition and
clearance were received by the Anaheim Redevelopment Agency
at the Office of the Secretary of the Anaheim Redevelopment
Agency on May 29, 1979 for the furnishing of all plant, labor,
services, materials and equipment, all utilities and transpor-
tation, including power, fuel and water, and performing all
work necessary to complete in a good and workmanlike manner,
the demolition and clearance hereinabove more particularly

WHEREAS, the Agency Representative did thereupon
examine and tabulate said sealed proposals and did report to
the Anaheim Redevelopment Agency the result of his examination
and tabulation; and
WHEREAS, the Anaheim Redevelopment Agency finds that
the sealed proposal submitted by Rosie's Inc., P.O. Box 2858,
Fullerton, California 92633, is the lowest responsible proposal
submitted for the furnishing of all plant, labor, services,
materials and equipment, all utilities and transportation,
including power, fuel and water and performing all work neces-
sary to complete in a good and workmanlike manner, in strict
accordance with the specifications theerfor on file in the
Office of the Secretary of the Agency, the demolition and
clearance hereinabove mentioned and described, together with
the appurtenances thereto, and as specified by the Agency, and
that said proposal of said above -named bidder should be accepted
and a contract awarded to said bidder in accordance therewith;
and
WHEREAS, the Anaheim Redevelopment Agency finds that
the above - mentioned sealed proposal is the lowest.responsible
proposal received and that the person, firm or corporation sub-
mitting said proposal is a responsible person, firm or corpor-
ation and that the proposal submitted is the best suited and
fitted for the demolition and clearance to be undertaken.
NOW, THEREFORE, BE IT RESOLVED by the Anaheim Redevel-
opment Agency that the sealed proposal submitted by said
contractor for the furnishing of all plant, labor, services,
materials and equipment, all utilities and transportation,
including power, fuel and water, and performing all work neces-
sary to complete, in a good and workmanlike manner, the demoli-
tion and clearance hereinabove more particularly mentioned and
described, together with the appurtenances thereto, be, and the
same is hereby, accepted, and that a contract for the completion
of said demolition and clearance be, and the same is hereby,
awarded to the said above -named bidder.
AND BE IT FURTHER RESOLVED that the successful bidder
or bidders upon each contract awarded as hereinabove set forth,
shall be, and they are hereby required to execute a contract in
the required form with the Anaheim Redevelopment Agency upon
the terms and conditions specified in the proposal submitted
by said successful bidder or bidders and in accordance with
the specifications for said demolition and clearance herein-
above described, and in accordance with the terms, conditions

and provisions of this resolution, and that said successful
bidder or bidders to whom each contract is awarded shall be
required to furnish a surety bond in the amount of $10,000.00
for all labor, materials and equipment to be furnished and
performed, as set forth in the sealed proposal submitted by
said bidder for the demolition and clearance, together with
the appurtenances thereto or such portion thereof as is
covered by said contract, as security for the faithful per-
formance of said contract, and a separate surety bond in the
amount of $10,0.00.00 for the payment of all persons performing
labor and furnishing material for said demolition and clearance.
AND BE IT FURTHER RESOLVED that said successful
bidder or bidders be, and they are hereby, required to furnish
to the Anaheim Redevelopment Agency in companies satisfactory
to the Anaheim Redevelopment Agency, the public liability,
property damage, Workers' Compensation, and other insurance in
the amounts and for the purposes set forth and specified in the
proposals, and subject to the approval of the General Counsel
of the Agency as to form and sufficiency.
AND BE IT FURTHER RESOLVED that the Chairman and
Secretary of the Anaheim Redevelopment Agency be, and they are
hereby, authorized and directed to make, execute and enter into,
for and on behalf of the Anaheim Redevelopment Agency, a written
contract with said successful bidder or bidders for the furnish-
ing of all plant, labor, materials, and equipment and perform-
ing all work, as hereinabove more particularly described for
the completion of said demolition and clearance hereinabove
described upon the terms and conditions as specified in the
sealed proposals, the specifications, and all addenda thereto,
and all modifications incorporated therein prior to the date of
the opening of bids, on file in the Office of the Secretary of
the Anaheim Redevelopment Agency and in strict accordance with
the terms, conditions and provisions of this resolution, and
in accordance with all of the contract documents herein specified.
BE IT FURTHER RESOLVED that should Rosie's, Inc. fails
to post required bonds or insurance, or otherwise fails to
execute a contract for the work, that Agency officers are directed
to take such steps as are necessary to execute an agreement with
the next lowest responsible bidder (The Wizard of Wrecking).
THE FOREGOING RESOLUTION is approved and adopted by
the Anaheim Redevelopment Agency this 5th,. f June, 1979.

adopted at a regular meeting of the Anaheim Redevelopment Agency held on
