A RESOLUTION OF THE ANAHEIM REDEVELOPMENT
AGENCY ACCEPTING A SEALED PROPOSAL AND
AWARDING A CONTRACT TO THE LOWEST RESPON-
SIBLE BIDDER FOR DEMOLITION, CLEARANCE AND
MODIFICATION OF CERTAIN AGENCY PROPERTY.
(CONTRACT D79 -15)
WHEREAS, the Anaheim Redevelopment Agency has received
sealed Proposals for the demolition, site clearance and modifica-
tion of a part of a structure on the following Agency property,
to wit:

in accordance with specifications on file in the Office of the
Agency Representative; and
WHEREAS, the Agency Representative did receive the follow-
ing sealed proposals, to wit:

ROSIE'S, INC. . . . . . . . . . . . $4,950.00
WHEREAS, the Agency Representative did thereupon examine
and tabulate said sealed proposals and did report to the Anaheim
Redevelopment Agency the result of his examination and tabulation;
and
WHEREAS, the Anaheim Redevelopment Agency finds that the
sealed proposal submitted by MARCUS P. SOUTH AND ASSOCIATES, is the
lowest responsible proposal submitted for the furnishing of all
plant, labor, services, materials and equipment, all utilities and
transportation, including power, fuel and water and performing all
work necessary to complete in a good and workmanlike manner, in
strict accordance with the specifications therefor on file in the
office of the Secretary of the Agency, the demolition, clearance
and modification hereinabove mentioned and described, together
with the appurtenances thereto, and as specified in the notice in-
viting sealed proposals, and that said proposal of said above -named
bidder should be accepted and a contract awarded to said bidder in
accordance therewith; and

WHEREAS, the Anaheim Redevelopment Agency finds that the
above - mentioned sealed proposal is the lowest responsible proposal
received and that the person, firm or corporation submitting said
proposal is a responsible person, firm or corporation and that the
proposal submitted is the best suited and fitted for the demolition
and clearance to be undertaken.
NOW, THEREFORE, BE IT RESOLVED by the Anaheim Redevelop-
ment Agency that the sealed proposal submitted by said contractor
for the furnishing of all plant, labor, services, materials and
equipment, all utilities and transportation, including power, fuel
and water, and performing all work necessary to complete, in a
good and workmanlike manner, in strict accordance with the speci-
fications therefor on file in the Office of the Secretary of the
Anaheim Redevelopment Agency, the demolition, clearance and modi-
fication hereinabove more particularly mentioned and described,
together with the appurtenances thereto, be, and the same is hereby,
accepted and that a contract for the completion of said demolition,
clearance and modification be, and the same is hereby, awarded to
the said above - mentioned bidder.
AND BE IT FURTHER RESOLVED that the successful bidder or
bidders upon each contract awarded as hereinabove set forth, shall
be, and they are hereby, required to execute a contract in the re-
quired form with the Anaheim Redevelopment Agency upon the terms
and conditions specified in the proposal submitted by said success-
ful bidder or bidders and in accordance with the specifications for
said demolition, clearance and modification hereinabove described,
and in accordance with the terms, conditions and provisions of
this resolution, and that said successful bidder or bidders to whom
each contract is awarded shall be required to furnish a surety bond
in the amount of Ten Thousand Dollars ($10,000.00) for all labor,
materials and equipment to be furnished and performed, as set forth
in the sealed proposal submitted by said bidder for the demolition,
clearance and modification, together with the appurtenances thereto
or such portion thereof as is covered by said contract, as security
for the faithful performance of said contract, and a separate surety
bond in the amount of Ten Thousand Dollars ($10,000.00) as security
for the payment of all persons performing labor and furnishing
material for said demolition, clearance and modification.
AND BE IT FURTHER RESOLVED that said successful bidder or
bidders be, and they are hereby, required to furnish to the Anaheim
Redevelopment Agency, in companies satisfactory to the Anaheim Rede-
velopment Agency, public liability, property damage, compensation,
and other insurance in the amounts and for the purposes set forth
and specified in the notice inviting sealed proposals, and subject
to the approval of the General Counsel of the Agency as to form
and sufficiency.
AND BE IT FURTHER RESOLVED that the Chairman and Secretary
of the Anaheim Redevelopment Agency be, and they are hereby, author-
ized and directed to make, execute and enter into, for and on behalf
of the Anaheim Redevelopment Agency, a written contract with said
successful bidder or bidders for the furnishing of all plant, labor,

materials, and equipment and performing all work, as hereinabove more
particularly described for the completion of said demolition, clear-
ance and modification hereinabove described upon the terms and con-
ditions as specified in the proposals, the specifications, and all
addenda thereto, and all modifications incorporated therein prior to
the date of the opening of bids, on file in the office of the Anaheim
Redevelopment Agency and in strict accordance with the terms, condi-
tions and provisions of this resolution, and in accordance with all
of the contract documents herein specified.
BE IT FURTHER RESOLVED that should Marcus P. South and
Associates fail to post the required bonds or insurance, or other-
wise fail to execute a contract for the work, that said Agency
officers are directed to take such steps as are necessary to execute
the agreement with the next lowest responsible bidder (Rosie's, Inc.,
in the amount of "A,950-00).
THE FOREGOING RESOLUTION is approved and adopted by the
Anaheim Redevelopment Agency this 3rd day of July, 1979•
