A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ANAHEIM GRANTING
VARIANCE NO. 4245.
WHEREAS, after a request for variance to permit two (2)
60 sq.ft. internally-illuminated freestanding monument signs with
multiple-tenant identification panels, was received, a public
hearing before the Planning Commission of the City of Anaheim was
held upon due and proper notice, a result of which Variance No.
4245 was denied covering the following described property:
PARCEL A: BEGINNING AT A POINT IN THE CENTER LINE
OF THE SANTA ANA CANYON ROAD (NOW STATE HIGHWAY),
49.13 FEET NORTH 44 DEG. 00' 30" EAST FROM THE END
OF A CURVE ON SAID CENTER LINE, SAID CURVE BEING
APPROXIMATELY 1388.00 FEET SOUTH 44 DEGREES 00' 30"
WEST FROM THE INTERSECTION OF SAID CENTER LINE, BY
NORTH LINE OF TOWNSHIP 4 SOUTH, RANGE 9 WEST, SAN
BERNARDINO BASE AND MERIDIAN, RUNNING FROM SAID

WHEREAS, thereafter, within the time prescribed by law,
an interested party or the City Council, on its own motion, caused
the review of said Planning Commission action at a public hearing
noticed and held as prescribed by law and, as a result thereof, the
City Council does hereby make the following findings:
1. That there are special circumstances applicable to the
property, including size, shape, topography, location or
surroundings, which do not apply to other property under identical
zoning classification in the vicinity.

2. That, because of special circumstances shown in (1)
above, strict application of the zoning code deprives the property
of privileges enjoyed by other property under identical zoning
classification in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that a conditional zoning variance be, and the same
is hereby, granted permitting two (2) 60 sq.ft. internally-
illuminated freestanding monument signs with multiple-tenant
identification panels on the property hereinbefore described with
waivers of the following sections of the Anaheim Municipal Code:
Sections 18.05.091.010 - Permitted type of shopping center
identification
18.05.091.012 signs in the Scenic Corridor
Overlay Zone.
18.05.091.014 (One single-faced, 26 sq.ft. 3-
foot high monument sign
18.44.067 displaying the commercial center
name and/or one major tenant name
or logo facing each street
frontage permitted;
and 18.84.062.040 Two single-faced, 60 sq.ft., 5-foot
high monument signs displaying the
commercial center name and a
maximum of six tenant names or
logos facing Santa Ana Canyon
Road proposed)
That said variance be granted subject to the following conditions:
1. That sign plans shall be submitted to the Building
Division showing conformance with Engineering Standard
Plan No. 137 pertaining to sight distance visibility.
2. That subject property shall be developed substantially in
accordance with plans and specifications submitted to the
City of Anaheim by the petitioner and which plans are on
file with the Planning Department marked Exhibit Nos. 1
through 3; provided, however, that prior to issuance of
a permit for the signs, specific plans shall be submitted
to the Zoning Division for review and approval showing
the following design features:
(a) Both monument signs shall be mounted on solid
bases;
(b) The maximum sign height shall be five (5) feet;
(c) The maximum area per monument sign shall be sixty
(60) square feet;
(d) Each monument sign shall be single-faced;
(e) The color of the stucco and plexiglass shall be
subdued and coordinated with the colors of the

building materials of this shopping center; and
(f) The sign illumination shall be subdued and shall
consist of either (1) indirect lighting or (2) the
lettering/text on the signs may be backlighted but
the background surfaces surrounding the
lettering/text shall be opague.
3. That each monument sign shall contain of a maximum of six
(6) panels identifying a maximum of six (6) tenant names
or five (5) tenant names and the shopping center name.
4. That the petitioner shall submit a letter requesting
termination of Variance No. 4188 (permitting two 44 sq.
ft. 4-foot high shopping center identification monument
signs) to the Planning Department.
5. That prior to issuance of a permit by the Building
Division or within a period of one (1) year from the date
of this resolution, whichever occurs first, Conditions
Nos. 1, 2, 3 and 4, above-mentioned, shall be complied
with. Extensions for further time to complete this
condition may be granted in accordance with Section
18.03.090 of the Anaheim Municipal Code.
6. That subject sign variance is hereby approved for a
period of two (2) years until April 12, 1996 at which
time this variance shall expire.
7. That approval of this application constitutes approval of
the proposed request only to the extent that it complies
with the Anaheim Municipal Zoning Code and any other
applicable City, State and Federal regulations. Approval
does not include any action or findings as to compliance
or approval of the request regarding any other applicable
ordinance, regulation or requirement.
BE IT FURTHER RESOLVED that the City Council of the city
of Anaheim does hereby find and determine that adoption of this
Resolution is expressly predicated upon applicant's compliance with
each and all of the conditions hereinabove set forth. Should any
such condition, or any part thereof, be declared invalid or
unenforceable by the final judgment of any court of competent
jurisdiction, then this Resolution, and any approvals herein
