A RESOLUTION OF THE ANAHEIM REDEVELOPMENT
AGENCY ACCEPTING A SEALED PROPOSAL AND
AWARDING A CONTRACT TO THE LOWEST RESPON-
SIBLE BIDDER FOR THE FOLLOWING WORK OF
IMPROVEMENT. (Contract No. D79-20)
WHEREAS, the Anaheim Redevelopment Agency did cause to
be published in a newspaper of general circulation, printed, pub-
lished and circulated in the City of Anaheim, to wit: The Anaheim
Bulletin and The Register on the 6th and 13th days of
September, 1979 , a notice inviting sealed proposals
for furnishing the following:
All plant, labor, services, materials and equipment,
and all utilities and transportation, including power,
fuel and water, and performing all work necessary to
complete in a good and workmanlike manner, in strict
accordance with the specifications, plans and drawings
therefor on file in the Office of the Secretary of the
Agency, the following public improvement, to wit:
Furnishing all the labor, materials, necessary tools,
expendable equipment, and all utility and transportation
services required in connection with the Modifications to
George Washington School, 233 East Chartres Street,
Anaheim, California, Architect's Job No. A79 -24,
Agency Contract No. D79 -20, in accordance with the
drawings and specifications on file in the Office of
the City Clerk.
in accordance with the specifications on file in the Office of
the Secretary of the Agency; and
WHEREAS, said notice inviting sealed proposals for
Improvement did provide that sealed proposals would be received by
the Anaheim Redevelopment Agency at the Office of the Secretary of
the Anaheim Redevelopment Agency up to the hour of 2:00 o'clock
P.M. on the 27th day of September , 19 79 , for the furnishing
of all plant, labor, services, materials and equipment, all utili-
ties and transportation, including power, fuel and water, and

performing all work necessary to complete in a good.and'work-
manlike manner, the Improvement hereinabove more particularly
mentioned and described, and which notice did state and declare
that pursuant to the provisions of Section 1770 of the Labor
Code, the Anaheim Redevelopment Agency had ascertained the pre-
vailing rate of wages in the locality in which this type of
labor is to be performed for each craft or type of workman or
mechanic needed to execute the contract, and which wage scale
is on file in the Office of the Secretary of the Agency; and
WHEREAS, the Executive Director of the Agency did
receive the following sealed proposals prior to 2:00 o'clock
P.M. on the 27th day of September , 19 79 , in response to
the notice aforesaid inviting sealed proposals, to wit:

AND WHEREAS, the Agency Representative did thereupon
examine and tabulate sealed proposals and did report to the
Anaheim Redevelopment Agency the result of his examination and
tabulation; and
WHEREAS, the Anaheim Redevelopment Agency finds that
the sealed proposal submitted by MEANS & ULRICH, 1629 E.

hereinafter successful bidder' is the lowest responsible pro-
posal submitted for the furnishing of all plant, labor, services,
materials and equipment, all utilities and transportation, in-
cluding power, fuel and water, and performing all work necessary
to complete in a good and workmanlike manner, in strict accord-
ance with the specifications therefor on file in the Office of
the Secretary of the Agency, the Improvement hereinabove mentioned
and described, together with the appurtenances thereto, and as
specified in the notice inviting sealed proposals, and that said
proposal of said above -named bidder should be accepted and a
contract awarded to said bidder in accordance therewith; and

WHEREAS, the Anaheim Redevelopment Agency finds that
the above - mentioned sealed proposal is the lowest resonsible pro-
posal received and that the person, firm or corporation submitting
said proposal is a responsible person, firm or corporation and
that the proposal submitted is the best suited and fitted for the
Improvement to be undertaken; and
WHEREAS, the Anaheim Redevelopment Agency does hereby
approve, in accordance with Section 830.6 of the Government Code,
the plan or design of Improvement.
NOW, THEREFORE, BE IT RESOLVED by the Anaheim
Redevelopment Agency that the sealed proposal submitted by said.
contractor for the furnishing of all plant, labor, services,
materials and equipment, all utilities and transportation, in-
cluding power, fuel and water, and performing all work necessary
to complete in a good and workmanlike manner, in strict accord-
ance with the specifications therefor on file in the Office of
the Secretary of the Anaheim Redevelopment Agency and the notice
inviting sealed proposals, the Improvement hereinabove more
particularly mentioned and described, together with the appurten-
ances thereto, be, and the same is hereby, accepted, and that a
contract for the completion of said Improvement be, and the same
is hereby, awarded to the said above -named bidder.
AND BE IT FURTHER RESOLVED that the successful bidder
or bidders, upon each contract awarded as hereinabove set forth,
shall be, and they are hereby, required to execute a contract in
the required form with the Anaheim Redevelopment Agency upon the
terms and conditions specified in the notice inviting sealed pro-
posals and the proposal submitted by said successful bidder or
bidders.and in accordance with the specifications for said
Improvement hereinabove described, and in accordance with the
terms, conditions and provisions of this resolution, and that
said successful bidder or bidders to whom each contract is
awarded shall be required to furnish a surety bond in the amount
of ONE HUNDRED FORTY -EIGHT THOUSAND, EIGHT HUNDRED DOLLARS ($148,
for all labor, materials and equipment to be furnished and per-
formed, as set forth in the sealed proposal submitted by said
bidder for the Improvement, together with the appurtenances
thereto or such portion thereof as is covered by said contract,
as security for the faithful performance of said contract, and
a separate surety bond in the amount of ONE HUNDRED FORTY -EIGHT
THOUSAND, EIGHT HUNDRED DOLLARS ($148,800.)
as security for the payment of all persons performing labor and
furnishing material for said Improvement.
AND BE IT FURTHER RESOLVED that said successful bidder
or bidders be, and they are hereby, required to furnish to the
Anaheim Redevelopment Agency in companies satisfactory to the
Anaheim-Redevelopment Agency, public liability, property damage,
compensation, and other insurance in the amounts and for the
purposes set forth and specified in the notice inviting sealed
proposals, and subject to the approval of the General Counsel of
the Agency as to form and sufficiency.

AND BE IT FURTHER RESOLVED that the Chairman and
Secretary of the Anaheim Redevelopment Agency be, and they are
hereby, authorized and directed to make, execute and enter into,
for and on behalf of the Anaheim Redevelopment Agency, a written
contract with said successful bidder or bidders for the furnishing
of all plant, labor, materials, and equipment and performing all
work, as hereinabove more particularly described for the comple-
tion of said Improvement hereinabove described upon the terms and
conditions as specified in the notice inviting sealed proposals,
the specifications, and all addenda thereto, and all modifications
incorporated therein prior to the date of the opening of bids, on
file in the Office of the Secretary of the Anaheim Redevelopment
Agency and in strict accordance with the terms, conditions and
provisions of this resolution, and in accordance with all of the
contract documents herein specified.
BE IT FURTHER RESOLVED that should Means and Ulrich
fail to post required bonds or insurance, or otherwise fail to
execute a contract for the work, that Agency officers are directed
to take such steps as are necessary to execute an agreement with
the next lowest responsible bidder (D. B. Enterprises, in the
amount of $158,073.00).
THE FOREGOING RESOLUTION is approved and adopted by
the Anaheim Redevelopment Agency this 2nd,4y of October, 1979.
