A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AMENDING RESOLUTION NO. 92R-17 ADOPTING
PERSONNEL RULES APPLICABLE TO EMPLOYEES IN
MANAGEMENT, CONFIDENTIAL AND NON-REPRESENTED PART-
TIME CLASSIFICATIONS
WHEREAS, the Human Resources Director has recommended in a staff
reported dated April 5, 1994, that Resolution No. 92R-17 be amended in the manner
hereinafter set forth, effective April 8, 1994; and
WHEREAS, as a result thereof, the need exists to amend Resolution No. 92R-
17 which adopted Personnel Rules for Management, Confidential and Part-Time Un-
Represented classifications; and
WHEREAS, the City Council of the City of Anaheim does find that the
aforementioned amendment is in the best interest of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City
of Anaheim that Personnel Rules 15 (Holidays), 16 (Vacation) 17 (Sick Leave) and 19
(Bereavement Leave) be replaced with revisions, copies of which are attached and
incorporated herein by this reference.
BE IT FURTHER RESOLVED that the effective date of said amendment
to Resolution No. 92R-17 is April 8, 1994.
AND BE IT FURTHER RESOLVED that, except as amended herein,
Resolution No. 92R-17 shall remain in full force and effect.
THE FOREGOING RESOLUTION is approved and adopted by the Cits'

RULE 15. HOLIDAYS

Section 15.1 In the event that any of the above holidays fall on an employee's schedule~
day off, said employee shall observe the preceding work day or the following work day a:
scheduled by the Executive Manager ~o provide maximum regular service to the public.
Section 15.2 Certain designated employees may be required to work on an3, ~,f ~:he above
holidays or days observed in lieu of those holidays. A confidential employee required
work on any of the above holidays or days observed in lieu of those holidays shall receive:
additional compensation equivalent m one and one-half times his regular rate of pa.,,'.

time worked. Fire Battalion Chiefs assigned to Suppression and job classes exempt

Section 15.3 Fire Battalion Chiefs assigned to Suppression shall receive additional
compen:;ation equivalent to i/l.0th of his regular biweekly compensation for each holiday
listed in Section 15.0 and for September 9 (Admission Day). Employees in this classification
shall also have the option to accumulate 11.2 hours per holiday. Under the option, any
hours accrued but not taken will be paid off at the employee's regular hourly rate of pay as
of the end of the pay period includirtg October 1st. Upon termination, a Fire Battalion
Chief assigned to Suppression shall bz compensated in cash at his current rate .'.)f pay for
any tmurs accrued but not taken. Selection of the Iloliday option shall be made on
September 1st of each year. No emph)yee who is on suspension or unpaid leave of absence
during a holiday pay period shall rc~:eive additional compensation or acc:n'nu!ate hours
during that pay period.

Section 15.4 In order to be eligible f, 3r holiday pay, an employee must be eithbr at work
or on paid leave of absence on the regularly schedoled work day immediately preceding the

RULE 16. VACATION

16.01 For the fkst four years of continuous, full-time service such employees shall
accrue paid vacation at the rate of f~mr (4) hours for each complete biweekly
pay period plus two (2) hours for paid vacation at the close of the final
complete biweekly pay period of each fiscal year (106 hours or 13.:25 working
days per year).
16.02 Upon completion of four years of continuous, fidMime sexyice, such
employees shall accrue paid vacation at the rate of five (5) bouts for each
complete biweekly pay period (130 hours or 16.25 working days per year).
16.03 Upon completion of e. igbt years of continuous, full-time service, such
employees shall accrue paid vacation at the rate of six (6) hours for each
complete biweekly pay period (156 hours or 19.5 working days per year).
16.04 Upon completion of fc~urteen years of continuous, full-time service such
employees shall accrue paid vacation at the rate of seven (7) hours for each
complete biweekly pay period (182 hours or 22.75 working days per year).
16.05 Upon completion of nineteen years of continuous, full-time service, such
employees shall accrue paid vacation at the rate of eight (8) hours for each
complete biweekly pay period (208 hours or 26 working days per year).
Section 16.1 Employees working in part-time classifications listed below who work
eight..hundred (800) or more hours in any calendar year shall be paid three percent (3%)
of his/her gross earnings as vacation benefits. The calendar year shall be defined as the
period for which wages earned are reported for tax purposes.

Section 16.2 Paid vacations shall continue to accrue in accordance with the above
provisions during any period of leave whh pay, except that Public Safety employees who
rema!.n 0n Industrial Accident Leave in accordance with Personnel Rule 18 INDUSTRIAL
ACCIDENT LEAVE after exhausting State mandated 4850 benefits shall accumulate no
vacation. All vacations shall be scheduled and takc. n in accordance with the best interests
of the City of Anaheim and the department or division in which the employee ia employed.
The maximum amount of vacation tha! may be taken at any given time shall be that amount
that has accrued to the employee concerned. The minimum amount of vacation that may
be taken at any given time shall be orte-half (1/2) hour.
Section 16.3 An employee shall be eligible to take any accrued vacation upon completion
of thirteen (13) complete biweekly pay periods of service.
Section 16.4 Each employee shall have one-half (1/2) hour deducted from his accrued
vacation time for each one-half (1/2) hour of vacation taken. An employee with a regular
work day of eight (8) hours shall have eight (8) hours deducted from his accrued vacation
time for each day of vacation taken.
Section 16.5 Maximumvacationaccumulationsforconfidentialandmanagementemployees
with an average regular work week ot' forty (40) hours shall be as follows:
16.51 For employees accruing vacation at the rate of one hundred six (106) hours
for every twenty-six (26) complete biweekly pay periods, the m~imum amount
of vacation that may be accumulated shall be two hundred twelve (212) hours.
16.52 For employees accruing vacation at the rate of one hundred thirty (130) lmurs
for every twenty-six (26) complete biweekly pay periods, the maximum amount
of vacation that may be accumulated shall be two hundred sixty (260) hours.
16.53 For employees accruing vacation at the rate of one hundred fifty-six (156)
hours for every twenty-six (26) cumplete biweekly pay periods, the maximum
amount of vacation tha! may be accumulated shall be three hundred twelve
(312) hours.
16.54 For employees accruing vacation at the rate of one hundred eighty-two (182)
hours for every twenty-six (26) complete biweekly pay periods, the maximum
amount of vacation that may be accumulated shall be three bundred sixty-four
(364) hours.
16.55 For employees accruing vacation at the rate of two hundred eight (208) hours
for every twenty-six (26) complete biweekly pay periods, the maximurn amount

of vacation that ~nay be accumulated shall be four hundred sixieen (416)
hours.
Section 16.6 Upon termination, a confidential or management employee shall be
compensated in cash at his current base rate of pay for any vacation accrued but not taken.
Upon termination the employee shall t~e compensated for the full accrual for the final pay
period.
Section 16.7 In the event that any recognized holiday occurs during any employee's
vacation, the holiday shall not be charged against the employee's accrued vacation. The
only vacation hours that shall be charged against any employee's accrued vacation shall be
those hours that the employee is regqfiarly scheduled to work.
Section 16.8 Any employee in a classification designated as confidential or management
shall be provided the option on an annual basis of being compensated at his/her regular
rate of pay for up to eighty (80) hours of vacation accrued but not taken, subject to the
following provisions:
16.81 For employees with an 0vetage work week of forty (40) hours, a minimunn. of
eighty (80) hours of vacation must have been used during the pi evious payroll
year. A maximum of eighty (80) hours may be paid in cash.
16.82 The employee's Executi,~e Manager must approve the employee's request ft~r
the annual vacation pay-off.
16.83 Payment shall be made in Jannary of each year.
Section 16.9 The City Manager, City Attorney, City Clerk and City Treasurer shall also be
subject to the provisions of this RULE.
Section 16.10 This rule does not apply to management employees with an average work,
week of fifty-six (56) hours, with the adoption of Rule 32, Paid Leave Program.

Section 17.3 A confidential or manag:ement employee who has completed six (6) months
as a regular full-time employee and is continuously and totally disabled for ~nore than one
(I) calendar ~nonth, shall receive a short term disability benefit of net sixty percent (60%)
of his/her base rate of pay, after wilhhnlding taxes, and less deductible benefits. Such
disability benefit shall continue during total disability up to a maximum of six months from
date of disability. Upon completion o.~~ thirty (30) and/or ninety (90) days of absence while
receiving short term disability benefits, an employee shall be required to undergo a physical
examination by the treating physician or medical practitioner and shall submit a report of
such examination explaining the nature and extent of the disabling illness or injury and the
prognosis and date of expected return to work. Short term disability benefits shall continue
beyond sixty (60) and/or one hundred and twenty (120) days of absence only upon
submission of the report of physical examination by the treating physician or medical
practitioner.
17.31 Deductible benefits include salary or other compensation paid by any
employer; Worker's Co~npensation Act or similar law including benefits for
partial or total disability, whether perlnanent or temporary if benefits being
received are for the current disabling condition; a pension plan. toward which
the City contributed.
17.32 Total disability nreans an employee's complete inability to engage in his/her
regular occupation.
17.32 Benefits are not payable unless the employee is regularly seen and treated by
a licensed physician or medical practitioner who certifies to the conrimming
disability.
Section 17.4 In the event that any puid holiday occurs during a period when any
confidential or management employee is on paid sick leave, the holiday shall not be charged
against the employee's accrued sick leave. The only sick leave hours that shall be charged
against any employee's accrued sick leave shall be those hours that the employee is regularly
scheduled to work.
Section 17.5 An employee eligible fc~r paid sick leave shall be granted such leave for the
following reasons:

17.51 Illness of the employee r~r physical incapacity of the employee due to illness
or injury.
17.52 Enforced quarantine of tt~e employee in accordance with commnnity health
regulations.
17.53 Medical and dental apl~ointments dnring work hours. Use of sick leave for
scheduled medical and dental appointments shall require prior approval of the
employee's supervisor and will be granted in accordance with the best
interests of the City of Anaheim and the employee's department or division.
17.54 Temporary disabilities caused by pregnancy and childblrth.
17.55 Up to forty-eight (48) hm~rs of sick leave per calendar year shall be granted
for illness of the employee's immediate family.
Section 17.6 A confidential or management employee who cannot perform his ,'tssigned
duties due to illness or physical incapacity shall inform his immediate supervisor of the fact
and the reason therefore as soon as possible. Failure to do so within a reasonable time may
be cause of denial of sick leave with pay.
Section 17.7 In the event that an employee is absent on sick leave in excess of twenty-four
(24) consecntive working hours, the employee's Execntive Manager or Administrative
Manager may require that the employee submit m hiin a written statemenl by a physician
licensed by the State of California certifying that the employee's condition prevented him
from performing the duties of his positiou. l?ailure on the part of the employee to comply
with such a requirement may be considered cause for disciplinary action.
Section 17.8 In the event that an employee becomes ill during working hours and is placed
on paid sick leave prior to the close of the work day, such paid sick leave shall be ca~culuted
to the nearest one-half (1/2) honr.
Section 17.9 Effective December 19, 1980, accrued Sick Leave hours shall be entered in
a new Sick Leave plan.
17.91 Regular full-time confidential and management employees with an average
regular work week of fi)rty (40) hours who were employees as of that date
shall have up to one hundred seventy-five (175) hours transferred to the
usable Sick Leave account. The remainder (over 175 hours) shall be credited
as follows: seventy-five percent (75%) to be reported as service credit at
retirement; twenty-five percent (25%) converted to cash value at the

employee's current (De(ember 19, 1980) regular hourly rate of pay and paid
with interest at retirement, layoff or to his/her beneficiary, as designated by
Public Employee's Retirement System records if t~e employee dies while
employed. Employees who retire during calendar year 1984 or thereafter
shall receive service credit for all hours up to one hundred seventy-five (175).
117.92 Regular full-time management emplnyees with an average regular work week
of fifty-six (56) hours shall have up to two hundred forty-five (245) hours
credited to a usable Sick Leave account. The remainder (over 245 hours)
shall be credited as follc. ws: seventy-five percent (75%) to be used as service
credit at retirement; two aty-five percent (25%) converted to cash value at the
employee's current (Dec. ember 19, 1980) regular hourly rate of pay and paid
with interest at retirement, layoff or to his/her beneficiary, as designated by
Public Employee's Retirement Syste~n records, if the employee dies while
employed. Employees who retire in calendar year 1984 or thereafter shall
receive service credit for all honrs up to two hundred forty-five (245).
17.93 ,Mr employee in a classification designated as confidential or management
who has more than five (5-)-years ten (10) years of continuous City service and
is~ge-50-or otde~ may elect once each calendar year to receive all or a
portion of his/her Employee Sick I~eave Trust Fund account. When
requested, such payments may be diverted to the employee's De~erred
Compensation account~ or paid in cash by separate check subject to
standardized withholdip, g taxes. When partial payment is requesied, the
amount shall not be less than 25% of the balance, and a maximum of four (4)
such partial payments shall be allowed with the fourth paytnent paying the
entire remaining balance in tile account.
Section 17.10 If two or more periods of total disability occur during a specific
six-month eli~nination period for the insured LTD plan, all such periods shall be considered
as one period of continuous total disability under tile following conditions:
17.101 All periods of total disability nmst be due to the same cause or causes;
and
17.102 All recurring periods of total disability that qualify as one period of
continuous total disability for the insured L~IT) plan, shall qualify as
one period of continuous total disability for the ANAHEIM Disability
Plan and shall not require a new one month waiting period before
ANAIIEIM Disability Benefits will be paid; and

17.103 Commencement of the benefit period for the insured LTD plan shall
automatically ter~ninate benefits from the ANAttEIM Disability Plan.
Section 17.11 The City Manager, City Attorney, City Clerk and City Treasurer shall
also be subject to the provisions of this
Section 17.12 This rule does not apply to management employees with an average
work week of fifty-six (56) hours (with the exception of Section 17.92). Coverage for these
employees is contained in Rule 32, Pv.id Leave Program.

RULE 19. BEREAVEMENT LEAVE
Section 19.0 In the event a death occurs in the immediate family of a full-time confidential
or management employee in the ciassified service, the employee shall be granted
bereavement leave with pay for up to a maximum of twenty-four (24) worl~ing hours.
"Immediate family" shall be defined as any relative by blood or marriage who is a member
of the employee's household, under the same roof, and any parent, foster parent,
step-parent, spouse, child, grandch_i_!~l brother, or sister of the employee, or any parent, foster
parent, step-parent or grandch_iLcl of the cmployee's spouse, regardless of residence.
19.01 In the event a death uccurs anmug other family members of a full-ti~ne
confidential or management employee in the classified service, the employee
shall be granted bereaw~meut leave with pay for up to a maxinmm of eight (8)
working hours. Other family members shall be defined as grandparent,
grandchild, dm~ghter-indaw, son-in-law, not under the same roof of the
employee, and any graadparent, gmndehitd~ child, brother, or sister of the
e~nployee's spouse, regurdlcss of residence.
19.02 Bereavement leave may be used only at the time a death occurs, or to make
burial arrangements and/or attend funeral or memorial services.
19.03 The City will guarantee, that in addition to the above, employees may use all
available vacation on the books up to forty (40) hours. If no vacation is on
the books, the City guarantees the employee the ability to use leave without
pay up to forty (40) hours.
Section 19.1 The City Manager, City Atlorney, City Clerk and City Treasurer shall also be
subject to the provisions of this RULE.
