A RESOLUTION OF THE ANAHEIM REDEVELOPMENT AGENCY
ACCEPTING A SEALED PROPOSAL AND AWARDING A
CONTRACT TO THE LOWEST RESPONSIBLE BIDDER FOR
THE FOLLOWING WORK OF IMPROVEMENT. (CONTRACT
NO. D 84 -1)
WHEREAS, the Anaheim Redevelopment Agency did cause to
be published in a newspaper of general circulation, printed,
published and circulated in the City of Anaheim, to wit: The
Anaheim Bulletin and The Register on the 15th and 21st days of
March 1984, a notice inviting sealed proposals for furnishing
the following:
All supervision, technical personnel, labor,
materials, equipment, tools, permits, and services
needed to perform and complete removal of existing
improvements, site clearance, and grading
operations, excavation, importing fill, and other
items, as well as to construct asphalt concrete
pavement, portland cement concrete curbs, ;utters,
and sidewalks, building connection sewer, sewer
cleanouts, water service, electrical, telephone,
landscape, irrigation, parking lot lights, and all
appurtenances as directed by the Engineer, of the
parcel of land bounded generally on the west by
Harbor Boulevard, on the south by Chestnut Street,
and on the east by Helena Street, and on the north
by existing bank property in the City of Anaheim,
designated as Contract No. D 84 -1,
in accordance with the specifications on file in the Office of
the Secretary of the Agency; and
WHEREAS, said notice inviting sealed proposals for
Improvement did provide that sealed proposals would be
received by the Anaheim Redevelopment Agency at the Office of
the Secretary of the Anaheim Redevelopment Agency up to the
hour of 2:00 o'clock P.M. on the 29th day of March 1984, for
the furnishing of all plant, labor, services, materials and
equipment, all utilities and transportation, including power,
fuel and water, and performing all work necessary to complete
in a good and workmanlike manner, the Improvement hereinabove
more particularly mentioned and described, and which notice
did state and declare that pursuant to the provisions of
Section 1770 of the Labor Code, the Anaheim Redevelopment
Agency had ascertained the prevailing rate of wages in the
locality in which this type of labor is to be performed for
each craft or type of workman or mechanic needed to execute
the contract, and which wage scale is on file in the Office of
the Secretary of the Agency; and

WHEREAS THE Secretary of the Agency did receive the
following sealed proposals prior to 2:00 o'clock P.M. on the
29th day of March 1984, in response to the notice aforesaid
inviting sealed proposals, to wit:

AND WHEREAS, the Agency Representative did thereupon
examine and tabulate sealed proposals and did report to the
Anaheim Redevelopment Agency the result of his examination and
tabulation; and
WHEREAS, the Anaheim Redevelopment Agency finds that
the sealed proposal submitted by R. J. NOBLE COMPANY, 15505
East Lincoln Avenue, P. 0. Box 620, Orange, California 92666
hereinafter "successful bidder ") is the lowest responsible
proposal submitted for the furnishing of all plant, labor,
services, materials and equipment, all utilities and
transportation, including power, fuel and water, and
performing all work necessary to complete in a good and
workmanlike manner, in strict accordance with the
specifications therefor on file in the Office of the Secretary
of the Agency, the Improvement hereinabove mentioned and
described, together with the appurtenances thereto, and as
specified in the notice inviting sealed proposals, and that
said proposal of said above -named bidder should be accepted
and a contract awarded to said bidder in accordance therewith;
and
WHEREAS, the Anaheim Redevelopment Agency finds that
the above- mentioned sealed proposal is the lowest responsible
proposal received and that the person, firm, or corporation
submitting said proposal is a responsible person, firm, or
corporation, and that the proposal submitted is the best
suited and fitted for the Improvement to be undertaken; and
WHEREAS, the Anaheim Redevelopment Agency does hereby
approve, in accordance with Section 830.6 of the Government
Code, the plan or design of Improvement.
NOW, THEREFORE, BE IT RESOLVED by the Anaheim
Redevelopment Agency that the sealed proposal submitted by
said contractor for the furnishing of all plant, labor,
services, materials and equipment, all utilities and
transportation, including power, fuel and water, and
performing all work necessary to complete in a good and

workmanlike manner, in strict accordance with the
specifications therefor on file in the Office of the Secretary
of the Anaheim Redevelopment Agency and the notice inviting
sealed proposals, the Improvement hereinabove more
particularly mentioned and described, together with the
appurtenances thereto, be, and the same is hereby, accepted,
and that a contract for the completion of said Improvement be,
and the same is hereby, awarded to the said above -named bidder.
AND BE IT FURTHER RESOLVED that the successful bidder
or bidders, upon each contract awarded as hereinabove set
forth, shall be, and they are hereby, required to execute a
contract in the required form with the Anaheim Redevelopment
Agency upon the terms and conditions specified in the notice
inviting sealed proposals and the proposal submitted by said
successful bidder or bidders and in accordance with the
specifications for said Improvement hereinabove described, and
in accordance with the terms, conditions, and provisions of
this resolution, and that said successful bidder or bidders to
whom each contract is awarded shall be required to furnish a
surety bond in the amount of ONE HUNDRED TWENTY ONE THOUSAND
SIX HUNDRED TWENTY FIVE AND 00 /100 DOLLARS ($121,625.00) for
all labor, materials, and equipment to be furnished and
performed, as set forth in the sealed proposal submitted by
said bidder for the Improvement, together with the
appurtenances thereto or such portion thereof as is covered by
said contract, as security for the faithful performance of
said contract, and a separate surety bond in the amount of ONE
HUNDRED TWENTY ONE THOUSAND SIX HUNDRED TWENTY FIVE AND 00 /100
DOLLARS ($121,625.00) as security for the payment of all
persons performing labor and furnishing material for said
Improvement.
AND BE IT FURTHER RESOLVED that said successful bidder
or bidders be, and they are hereby, required to furnish to the
Anaheim Redevelopment Agency in companies satisfactory to the
Anaheim Redevelopment Agency, public liability, property
damage, compensation, and other insurance in the amounts and
for the purposes set forth and specified in the notice
inviting sealed proposals, and subject to the approval of the
General Counsel of the Agency as to form and sufficiency.
AND BE IT FURTHER RESOLVED that the Chairman and
Secretary of the Anaheim Redevelopment Agency be, and they are
hereby, authorized and directed to make, execute, and enter
into, for and on behalf of the Anaheim Redevelopment Agency, a
written contract with said successful bidder or bidders for
the furnishing of all plant, labor, materials, and equipment
and performing all work, as hereinabove more particularly
described for the completion of said Improvement hereinabove
described upon the terms and conditions as specified in the
notice inviting sealed proposals, the specifications, and all
addenda thereto, and all modifications incorporated therein

prior to the date of the opening of bids, on file in the
Office of the Secretary of the Anaheim Redevelopment Agency
and in strict accordance with the terms, conditions and
provisions of this resolution, and in accordance with all of
the contract documents herein specified.
BE IT FURTHER RESOLVED that should R. J. Noble Company
fail to have bid documents and bid guarantee in order, or
otherwise fail to execute a contract for the work, that said
Agency officers are directed to take such steps as are
necessary to execute the agreement with the next lowest
responsible bidder, Sully- Miller Contracting, in the amount of
$81,688.00.
THE FOREGOING RESOLUTION is approved and adopted by the
Anaheim Redevelopment Agency this 1st day of May , 1984.

hereby certify that the foregoing Resolution No. ARA84 -14 was passed and
adopted at a regular meeting of the Anaheim Redevelopment Agency held on the
1st day of May, 1984, by the following vote of the members thereof:
