A RESOLUTION OF THE ANAHEIM REDEVELOPMENT AGENCY
ACCEPTING A SEALED PROPOSAL AND AWARDING A
CONTRACT TO THE LOWEST RESPONSIBLE BIDDER FOR
ANAHEIM CITY CENTER PARKING STRUCTURE PHASE I.
(Contract No. C85 -3)
WHEREAS, the Anaheim Redevelopment Agency did cause to be
published in a newspaper of general circulation, published and
circulated in the City of Anaheim, to wit: The Anaheim Bulletin,
on the 29th day of August, 1985, a notice inviting sealed
proposals for the construction of a parking structure on the
following Agency property, to wit:
Anaheim City Center Parking Structure, 411 West
Broadway, in the City of Anaheim, consisting of
furnishing all labor and materials necessary
for the construction of a parking structure.
The work includes, but is not limited to,
sitework, post- tensioned concrete structure,
electrical, mechanical, masonry and metal
work. All work shall be performed in strict
accordance with all local codes and plans and
specifications for this project, designated as
Contract No. C85 -3 , which are on file in the
office of the Anaheim Redevelopment Agency, 76
South Claudina Street, Suite 300, Anaheim,
California 92805 ( "Improvement "),
in accordance with the specifications on file in the Office of the
Secretary of the Agency; and
WHEREAS, said notice inviting sealed proposals for said
Improvement did provide that sealed proposals would be received by
the Anaheim Redevelopment Agency at the Office of the Secretary of
the Anaheim Redevelopment Agency up to the hour of 2:00 o'clock
P.M. on the 12th day of September, 1985, for the furnishing of all
plant, labor, services, materials and equipment, all utilities and
transportation, including power, fuel and water, and performing
all work necessary to complete in a good and workmanlike manner,
the Improvement hereinabove more particularly mentioned and
described, and which notice did state and declare that pursuant to
the provisions of Section 1770 of the Labor Code, the Anaheim
Redevelopment Agency had ascertained the prevailing rate of wages
in the locality in which this type of labor is to be performed for
each craft or type of workman or mechanic needed to execute the
contract, and which wage scale is on file in the Offices of the
Secretary of the Agency; and
WHEREAS, the Secretary of the Agency did receive the
following sealed proposals prior to 2:00 o'clock P.M. on the 12th
day of September, 1985, in response to the notice aforesaid
inviting sealed proposals, to wit:

AND WHEREAS, the Agency Representative did thereupon
examine and tabulate said sealed proposals and did report to the
Anaheim Redevelopment Agency the result of his examination and
tabulation; and
WHEREAS, the Anaheim Redevelopment Agency finds that the
sealed alternate proposal for Five Million Eight Hundred Thousand
Dollars (15,800,000.00) submitted by PACIFIC INLAND CONSTRUCTORS
CORP., 888 South West Street, Suite 400, Anaheim, California
92802, is the lowest responsible proposal submitted for the
furnishing of all plant, labor, services, materials and equipment,
all utilities and transportation, including power, fuel and water
and performing all work necessary to complete in a good and
workmanlike manner, in strict accordance with the specifications
therefor on file in the Office of the Secretary of the Agency, the
Improvement hereinabove mentioned and described, together with the
appurtenances thereto, and as specified in the notice inviting
sealed proposals, and that said proposal of said above -named
bidder should be accepted and a contract awarded to said bidder in
accordance therewith; and
WHEREAS, the Anaheim Redevelopment Agency finds that the
above - mentioned sealed proposal is the lowest responsible proposal
received and that the person, firm or corporation submitting said
proposal is a responsible person, firm or corporation and that the
proposal submitted is the best suited and fitted for the
Improvement to be undertaken.
NOW, THEREFORE, BE IT RESOLVED by the Anaheim
Redevelopment Agency that the sealed proposal submitted by said
contractor for the furnishing of all plant, labor, services,
materials and equipment, all utilities and transportation,
including power, fuel and water, and performing all work necessary
to complete, in a good and workmanlike manner, in strict
accordance with the specifications therefor on file in the Office
of the Secretary of the Anaheim Redevelopment Agency and the
notice inviting sealed proposals, the Improvement hereinabove more
particularly mentioned and described, together with the
appurtenances thereto, be, and the same is hereby, accepted, and
that a contract for the completion of said Improvement be, and the
same is hereby, awarded to the said above -named bidder.

BE IT FURTHER RESOLVED that the successful bidder or
bidders upon each contract awarded as hereinabove set forth, shall
be, and they are hereby, required to execute a contract in the
required form with the Anaheim Redevelopment Agency upon the terms
and conditions specified in the notice inviting sealed proposals
and the proposal submitted by said successful bidder or bidders
and in accordance with the specifications for said Improvement
hereinabove described, and in accordance with the terms,
conditions and provisions of this resolution, and that said
successful bidder or bidders to whom each contract is awarded
shall be required to furnish a surety bond in the amount of Five
Million Eight Hundred Thousand Dollars ($5,800,000.00) for all
labor, materials and equipment to be furnished and performed, as
set forth in the sealed proposal submitted by said bidder for the
Improvement, together with the appurtenances thereto or such
portion thereof as is covered by said contract, as security for
the faithful performance of said contract, and a separate surety
bond in the amount of Five Million Eight Hundred Thousand Dollars
(15,800,000.00) as security for the payment of all persons
performing labor and furnishing material for said Improvement.
BE IT FURTHER RESOLVED that said successful bidder or
bidders be, and they are hereby, required to furnish to the
Anaheim Redevelopment Agency in companies satisfactory to the
Anaheim Redevelopment Agency, public liability, property damage,
workers' compensation, and other insurance in the amounts and for
the purposes set forth and specified in the notice inviting sealed
proposals, and subject to the approval of the General Counsel of
the Agency as to form and sufficiency.
BE IT FURTHER RESOLVED that the Chairman and Secretary of
the Anaheim Redevelopment Agency be, and they are hereby,
authorized and directed to make, execute and enter into, for and
on behalf of the Anaheim Redevelopment Agency, a written contract
with said successful bidder or bidders for the furnishing of all
plant, labor, materials, and equipment and performing all work, as
hereinabove more particularly described for the completion of said
Improvement hereinabove described upon the terms and conditions as
specified in the notice inviting sealed proposals, the
specifications, and all addenda thereto, and all modifications
incorporated therein prior to the date of the opening of bids, on
file in the Office of the Secretary of the Anaheim Redevelopment
Agency and in strict accordance with the terms, conditions and
provisions of this resolution, and in accordance with all of the
contract documents herein specified.
BE IT FURTHER RESOLVED that the Executive Director be,
and he is hereby, authorized to approve change orders the total of
which shall not exceed two percent (2 %) of the contract price.

BE IT FURTHER RESOLVED that should Pacific Insland
Constructors Corp. fail to post the required bonds or insurance,
or otherwise fail to execute a contract for the work, that said
Agency officers are directed to take such steps as are necessary
to execute the agreement with the next lowest responsible bidder
(Macco Constructors, Inc. in the amount of Six Million Nine
Hundred Fifty -Four Dollars [$6,954,000.001).
