WHEREAS, the Anaheim Housing Authority has entered into
an Annual Contributions Contract with the United States of America,
pursuant to Section 8 of the United States Housing Act of 1937;
and
WHEREAS, the Anaheim Housing Authority is undertaking
to provide decent, safe and sanitary housing; and
WHEREAS, the Anaheim Housing Authority must determine
whether applicants for housing assistance qualify for such assist-
ance and must, in addition, make numerous determinations which may
adversely and directly affect certain persons; and
WJHEREAS, it is necessary and desirable to establish a
procedure to consider complaints which such persons may have; and
WHEREAS, a document, entitled "AnaheLm i-sousing Authority-
Complaint and Appeal Procedure" (consisting of a single Page and
� Exhibit A. attached hereto and incorporated by reference
herein) has been prepared; and
WHEREAS, said Procedure described in Exhibit A is found
to be necessary and desirable to effectuate the resolution of com-
plaints which persons may have against the Anaheim Housing Authority.
NOW, THEREFORE, BE IT RE. that - the Anahei - K-ousing
Authority does hereby approve and adopt that procedure as set forth
in Exhibit A entitled "Anaheim Housing Authority-Complaint and
Appeal Procedure."

COMPLAINT AND APPEA L PROCEDURE
Right Applicants, Certificate - holders and assisted families or
to a persons may file a request for an informal hearing on any
Hearing Authority action which directly and adversely affects them.
A request for an informal hearing must be in writing and
presented to the Authority - within 10 working days of the
Authority's action or failure to act which is the basis
for the complaint. The complainant will be notified of a
hearing which will be scheduled within 10 working days of
receipt of request.
Adverse Authority determinations which adversely and directly affect
Actions applicants, Certificate - holders and assisted families or per-
sons shall indicate that they may request an informal hearing
in accordance with these procedures. Adverse actions by the
Authority include, but are not limited to:
1. Written notice of applicant ineligibility.
2. Denial for a request for an extension of the Certificate.
3. Disapproval of a Request for Lease Approval.
4. Determination of the family contribution toward rent.
5. Termination from the program due to a failure to comply
with the conditions stated in the Certificate.
n. Denial of a request for another Certificate.
Informal informal hearings shall be conducted by the Housing iianager.
Hearings If the complainant is not satisfied with the outcome of the
informal hearing, the complainant may file a request within
10 working days, for a formal hearing. A request for a for-
mal hearing must be in writing and state the nature of the
complaint. The complainant will be notified of the date of
the foroial hearing which date will be within 15 working days
of receipt of a request for formal hearing.

Formal hearings shall be conducted by a nearing Panel consist -

ing of the Housing Authority Executive Director, a non- tenant
member of the Housing Commission, and a tenant member of the
Housing Commission. Two votes shall be required for any deci-
sion by the panel. Decisions shall be based solely on the
evidence presented at the :Hearing, the records of the Auth-
ority and upon applicable IUD or Authority regulations.
Housing Panel decisions shall be binding on the Authority.
If a complainant fails to appear at a hearing, the Hearing
Panel may either continue the hearing date or proceed on the
basis of the record presented.
