AHA-1982-013RESOLUTION NO. AHA82 -13 A RESOLUTION OF THE ANAHEIM HOUSING AUTHORITY AGREEING TO COOPERATE WITH THE APARTMENT IMPROVEMENT PROGRAM. WHEREAS, the Anaheim Housing Authority is a "public housing agency" as defined in the U.S. Housing Act of 1937, as amended (42 U.S.C. 1437 et seq.) (the Act); and WHEREAS, the Apartment Improvement Program of Anaheim (AIP) is a locally controlled effort which has been established with the assistance of the Neighborhood Reinvestment Corporation, and which aids owners and residents of properties in the neighborhoods specified by AIP to improve their proper- ties and bring them up at least to minimum code standards by providing counseling and assistance in dealing with contrac- tors, private financial institutions and local government agencies; and WHEREAS, the Neighborhood Reinvestment Corporation (NRC) is a joint effort of the Secretary of Housing and Urban Development (HUD) and the heads of five Federal financial regu- latory agencies, and has been established primarily to develop and provide support to Neighborhood Housing Services programs (NHS) and supportive efforts such as the AIP; and WHEREAS, the NRC has obtained a commitment from HUD to allocate 40 Section 8 Existing Housing Program units to AHA to provide rental assistance for families who might otherwise be adversely affected by private rehabilitation including, but not limited to, families in the neighborhoods of designated AIP programs. NOW, THEREFORE, BE IT RESOLVED that the Anaheim Housing Authority does agree as follows: 1. Upon approval by HUD of a special allocation of Section 8 Existing Housing Program units for families adversely affected or to be affected by private rehabilitation, AIP shall perform the following tasks: a. Disseminate information concerning the avail- ability of Section 8 assistance for lower income families, pri- marily through personal contact and counseling; b. Provide information to families and property owners regarding housing quality standards, inspection proce- dures, and basic program requirements; C. Take applications from families, make prelimin- ary determinations of family eligibility and gross family con- tribution, and refer eligible families to the AHA; d. Provide relocation advice to families, if necessary; and e. Provide the AHA with specific quarterly esti- mates of the number of Section 8 eligible families to be refer- red so that the AHA can assure use of the Section 8 funds over a 12 -month period. 2. AHA will fulfill all duties outlined or specified in the Act, the Annual Contributions Contract (ACC), the Section 8 Existing Housing Program Regulations, and applicable HUD hand- books and guidelines and will: a. Notify the AIP when a family referred to the AHA is issued a Certificate of Family Participation (Certificate) or determined to be ineligible. b. Notify the AIP when a Housing Assistance Payments Contract is executed. 3. The following guidelines will apply to the AHA in issuing the Section 8 Certificates: a. Preference shall be given for issuance of Certificates for the units covered by this agreement to eligi- ble families who, because of higher rents resulting from reha- bilitation of either their own unit or other existing units in their neighborhood, would have to pay more than 25 percent of their income towards rent, or move. b. If AIP does not refer on a quarterly basis a sufficient number of families to meet its 12 -month leasing schedule, the AHA may issue Certificates for the units to other eligible families. 4. Nothing in this agreement shall be construed to con- flict with the HUD regulations, handbooks and guidelines cover- ing the Section 8 Existing Housing Program. AHA hereby agrees to adhere to the HUD issuances in carrying out the work under this Resolution. 5. This Resolution shall not be construed as limiting the number of Section 8 Certificates which may be issued to residents of the AIP neighborhood. 6. The term of this Resolution shall be five years, com- mencing with the effective date of the ACC covering the units allocated for this purpose.
