A RESOLUTION OF THE ANAHEIM HOUSING AUTHORITY
AUTHORIZING THE EXECUTION OF DOCUMENTS TO
IMPLEMENT DISPOSITION AND DEVELOPMENT
AGREEMENT WITH CHEVY CHASE ANAHEIM PARTNERS
AND TO CLOSE ESCROWS AND ACQUIRE REAL PROPERTY.
WHEREAS, the Anaheim Housing Authority (Authority) is
empowered by state law to engage in activities to provide safe,
adequate and affordable housing opportunities for the citizens of
the City of Anaheim including the acquisition and disposition of
real property by eminent domain and otherwise; and
WHEREAS, pursuant to this power, on July 21, 1987, the
Authority entered into a Land Disposition and Development
Agreement (DDA) with Chevy Chase Anaheim Partners doing business
as Park Vista Apartments for acquisition, construction and
rehabilitation of approximately 392 apartment units on 94 parcels
within the Chevy Chase neighborhood in the City of Anaheim; and
WHEREAS, under DDA the Authority made offers to purchase
and then re -sell a number of the parcels and to cause to be
executed on behalf of the Authority various documents including,
but not limited to, offer letters, escrow instruction and grant
deeds; and
WHEREAS, pursuant to contingent offers made by the
Authority, a number of same were accepted and escrows were opened
which escrows Authority and sellers now wish to complete in light
of extinguishment of the contingencies set forth in the offers; and
WHEREAS, under the DDA the Authority also agreed to
commence condemnation proceedings on any parcels within the
project area which Authority is not able to purchase through
negotiated sales; and
WHEREAS, the Authority desires that execution of
documents referenced by this resolution be carried out by the
Executive Director and the Assistant Executive Director of the
Authority, so as to close the escrows and to determine the number
of parcels on which condemnation proceedings must be commenced by
delivery of final offers.
NOW, THEREFORE, BE IT RESOLVED by the Anaheim Housing
. Authority that the Executive Director and the Assistant Executive
Director are hereby authorized to take all steps and sign all
documents and instruments (including but not limited to: grant
deeds; escrow instructions; and offer letters) necessary to
implement and carry out the DDA on behalf of the Authority.
BE IT FURTHER RESOLVED by the Anaheim Housing Authority
that all offers heretofore made were made by or on behalf of the
Authority with the understanding and intent that if they were not
accepted, the Authority would have commenced condemnation
proceedings to acquire said properties pursuant to and under the
terms of the DDA.
