AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM APPROVING AMENDMENT NO.4
TO THE PACIFICENTER ANAHEIM SPECIFIC PLAN
88-3 AND AMENDING ORDINANCE NO. 5045, AS
PREVIOUSLY AMENDED, ACCORDINGLY.
WHEREAS, pursuant to the procedures set forth in Chapter 18.72 (formerly, Chapter
18.93) of the Anaheim Municipal Code, on July 25, 1989, the City Council of the City of Anaheim
adopted Ordinance No. 5045 amending the zoning map to reclassify certain real property described
therein into the PacifiCenter Anaheim Specific Plan No. 88-3 Zone (formerly, Santa Fe Pacific
Specific Plan Zone) subject to certain conditions as specified therein, and Ordinance No. 5046
relating to establishment of Zoning and Development Standards for the PacifiCenter Anaheim
Specific Plan No. 88-3 Zone by the addition of Chapter 18.106 (formerly, Chapter 18.73) to said
Municipal Code; and
WHEREAS, in connection with adoption of Specific Plan No. 88-3 Zone
(PacifiCenter Anaheim), the City Council certified EIR No. 280 and Addendum with Statement of
Overriding Considerations with mitigation measures from the PacifiCenter Anaheim Specific Plan
No. 88-3 document incorporated as conditions of approval and further identified in Mitigation
Monitoring Plan No. 29; and
WHEREAS, on March 5, 1991, the City Council adopted Ordinance No. 5207
amending Ordinance No. 5045 relating to the PacifiCenter Anaheim Specific Plan No. 88-3, which
amendment added a provision to permit warehouse and distribution facilities in support of permitted
on-site office uses and indoor physical recreation facilities in support of permitted on-site office uses
as accessory uses and structures in Development Area I ("Amendment No. 1 "); and
WHEREAS, on December 10, 1991, the City Council adopted Ordinance No. 5277
amending Ordinance No. 5046 by rezoning and reclassifying certain additional real property
described therein into the PacifiCenter Anaheim Specific Plan No. 88-3 Zone, and Ordinance No.
5278 amending Ordinance No. 5045, as previously amended, by revising all references to Specific
Plan No 88-3 contained therein to mean and refer to that certain document entitled PacifiCenter
Anaheim Specific Plan 88-3 ("Amendment No. 2"); and
WHEREAS, on August 24, 1999, the City Council adopted Ordinance No. 5695
amending Ordinance Nos. 5045 and 5046, as previously amended, to amend the Sign Program and
the Final Site Plan ("Amendment No. 3"); and
WHEREAS, on January 11, 2000, the City Council adopted Ordinance No. 5715
approving an adjustment to Ordinances No. 5045 relating to the requirements for self-service laundry
establishments to authorize such establishments by the approval of a conditional use permit; and
WHEREAS, on July 24, 2006, the City Council adopted Ordinance No. 5773
approving an adjustment to Ordinance No. 5045, as previously amended, modifying PacifiCenter
Anaheim Specific Plan No. 88-3, Appendix No. 11 (Hotel Conditions) to revise Condition No. 4
relating to daily maid service; and
WHEREAS, proposed Amendment No. 4 modifies the PacifiCenter Anaheim
Specific Plan No. 88-3 by deleting Condition No. 3 of Appendix 11 (Hotel Conditions) which
restricts the length of occupancy for a hotel guest, as follows:
"3. That hotel guest rooms shall not be rented or let for periods of less
than twelve (12) consecutive hours nor more than thirty (3 0) consecutive
days, excluding one (1) manager's unit."
WHEREAS, the Anaheim City Planning Commission did hold a public hearing at the
Anaheim Civic Center, Council Chambers, 200 South Anaheim Boulevard, in the City of Anaheim
on October 2, 2006, at 2:30 p.m., notice of said public hearing having been duly given as required by
law and in accordance with the provisions of Chapter 18.60 of the Anaheim Municipal Code to hear
and consider evidence for and against said Amendment No. 4 to the PacifiCenter Anaheim Specific
Plan No. 88-3 and to investigate and make findings and recommendations in connection therewith;
and
WHEREAS said Planning Commission, by its Resolution No. PC2006-83, made
certain findings and recommended that the City Council adopt Amendment No. 4 to the PacifiCenter
Anaheim Specific Plan No. 88-3; and
WHEREAS, pursuant to the provisions of the California Environmental Quality Act
("CEQA"), the City Council has determined that the previously -certified Final Environmental Impact
Report 280 is adequate to serve as the environmental documentation for this project; and
WHEREAS, the City Council desires to amend Ordinance No. 5045, as previously
amended, by deleting Condition No. 3 of Appendix I I (Hotel Conditions) which restricts the length
of occupancy for a hotel guest, as described above.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES
ORDAIN AS FOLLOWS:
SECTION 1.
That Amendment No. 4 to the PacifiCenter Anaheim Specific Plan No. 88-3 be, and
the same is hereby, approved; and that Ordinance No. 5045 be, and the same is hereby, amended by
deleting Condition No. 3 of Appendix 11 (Hotel Conditions) which restricts the length of occupancy
for a hotel guest, as follows:

113. That hotel guest rooms shall not be rented or let for periods of less
than twelve (12) consecutive hours nor more than thirty (3 0) consecutive
days, excluding one (1) manager's unit."
SECTION 2.
That, except as expressly amended herein, Ordinance Nos. 5045, as previously
amended, shall remain in full force and effect.
SECTION 3. SEVERABILITY
The City Council of the City of Anaheim hereby declares that should any section,
paragraph, sentence or word of this ordinance of the Code, hereby adopted, be declared for any
reason to be invalid, it is the intent of the Council that it would have passed all other portions of this
ordinance independent of the elimination herefrom of any such portion as may be declared invalid.
SECTION 4. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal of any other ordinance of this
City shall in any manner affect the prosecution for violations of ordinances, which violations were
committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or
the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as
they are substantially the same as ordinance provisions previously adopted by the City relating to the
same subject matter, shall be construed as restatements and continuations, and not as new
enactments.
SECTION 5. PENALTY
Except as may otherwise be expressly provided, any person who violates any
provision of this ordinance is guilty of a misdemeanor and shall, upon conviction thereof, be
punished in the manner provided in Section 1.01.370 of the Anaheim Municipal Code.

18.106 (formerly, Chapter 18.73) to said Municipal Code; and
WHEREAS, in connection with adoption of Specific Plan No. 883 Zone (PacfiCenter
Anaheim), the City Council certified EIR No. 280 and Addendum with Statement of Overrid-
ing Considerations with mitigation measures from the PacifiCenter Anaheim Specific Plan
No. 88-3 document incorporated as conditions of approval and further identified in Mitiga-
tion Monitoring Plan No. 29; and
WHEREAS, on March 5, 1991, the City. Council adopted Ordinance No. 5207 amending
Ordinance No. 5045 relating to the PacifiCenter Anaheim Specific Plan No. 88-3, which
amendment added a provision to permit warehouse and distribution facilities in support o1
permitted on-site office uses and indoor physical recreation facilities in support ofpermit-
tedon-site office uses as accessory uses and structures in Development Area 1 ("Amend
ment No. 1"); and
WHEREAS, on December 10, 1991, the City Council adopted Ordinance No. 5277
amending Ordinance -No. 5046 by rezoning and reclassifying certain additional real proper-
ty described therein into the PacifiCenter Anaheim Specific Plan No. 88-3 Zone, and Ordi-
nance No. 5278 amending Ordinance No. 5045, as previously amended, by revising all ref-
erences to Specific Plan No 88-3 contained therein to mean and refer to that certain docu-
ment entitled PacifiCenter Anaheim Specific Plan 88-3 ("Amendment No. 2"); and
WHEREAS, on August 24, 1999, the City Council adopted Ordinance No. 5695 amend-
ing Ordinance Nos. 5045 and 5046, as previously amended, to amend the Sign Program
and the Final Site Plan ("Amendment No. 3"); and
WHEREAS, on January 11, 2000, the City Council adopted Ordinance No. 5715 approv-
ing an adjustment to Ordinances No. SM relating to the requirements for self-service
laundry establishments to authorize such establishments by the approval of a conditional
use permit; and
WHEREAS, on July 24, 2006, the City Council adopted Ordinance No. 5773 approving
an adjustment to Ordinance No.5045, as previously amended, modifying PacifiCenter Ana-
heim Specific Plan No. 88-3, Appendix No. 11 (Hotel Conditions) to revise Condition No. 4
relating to daily maid service; and
WHEREAS, proposed Amendment No. 4 modifies the PacifiCenter Anaheim Specific
plan No. 883 by deleting Condition No. 3 of Appendix 11 (Hotel Conditions) which restricts
the length of occupancy for a hotel guest, as follows:
3. That hotel guest rooms shall not be rented or let for periods of less than
twelve (12) consecutive hours nor more than thirty (30) consecutive days, exclud-
ing one (1) manager's unit."
WHEREAS, the Anaheim City Planning Commission did hold a public hearing at the
Anaheim Civic Center, Council Chambers, 200 South Anaheim Boulevard, in the City of
Anaheim on October 2, 2006, at 2:30 p.m., notice of said public hearing having been duly
given as required by law and in accordance with the provisions of Chapter 18.60 of the
Anaheim Municipal Code to hear and consider evidence for and against said Amendment
No. 4 to the PacifiCenter Anaheim Specific Plan No. 88-3 and to investigate and make find-
ings and recommendations in connection therewith; and
WHEREAS said Planning Commission, by its Resolution No. PC2006-83, made certain
findings and recommended that the City Council adopt Amendment No. 4 to the
PacifiCenter Anaheim Specific Plan No. 88-3; and
WHEREAS, pursuant to the provisions of the California Environmental Quality Act
("CEQA"), the City Council has determined that the previously -certified Final Environmental
Impact Report 280 is adequate to serve as the environmental documentation for this proj-
ect; and
WHEREAS, the City Council desires to amend Ordinance No. 5045, as previously
amended, by deleting Condition No. 3 of Appendix 11 (Hotel Conditions) which restricts the
length of occupancy for a hotel guest, as described above.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN
AS FOLLOWS:
SECTION 1.
That Amendment No. 4 to the PacifiCenter Anaheim Specific Plan No. 883 be, and
the same is hereby, approved; and that Ordinance No. 5045 be, and the same is hereby,
amended by deleting Condition No. 3 of Appendix 11 (Hotel Conditions) which restricts the
length of occupancy for a hotel guest, as follows:
"3. That hotel guest rooms shall not be rented or let for periods of less thari
twelve (12) consecutive hours nor ,more than thirty (30) consecutive days, exclud-
ing one (1) manager's unit."
SECTION 2.-
That,
:That, except as expressly amended herein, Ordinance Nos. 5045, as previously
amended, shall remain in full force and effect.
SECTION 3. SEVERABILITY
The City Council of the City of Anaheim hereby declares that should any section, para-
graph, sentence or word of this ordinance of the Code, hereby adopted, be declared for
any reason to be invalid, it is the intent of the Council that it would have passed all other
portions of this ordinance independent of the elimination herefrom of any such portion as
may be declared invalid.
SECTION 4. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal of any other ordinance of this City
shall in any manner affect the prosecution for violations of ordinances, which violations
were committed prior to the effective date hereof, nor be construed as a waiver of any li-
cense or penalty or the penal provisions applicable to any violation thereof. The provisions
of this ordinance, insofar as they are substantially the same as ordinance provisions previ-
ously adopted by the City relating to the same subject matter, shall be construed as re-
statements and continuations, and not as new enactments.
SECTION S. PENALTY

Except as may otherwise be expressly provided, any person who violates any provi-
sion of this ordinance is guilty of a misdemeanor and shall, upon conviction thereof, be
punished in the manner provided in Section 1.01.370 of the Anaheim Municipal Code.
