A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AMENDING SPECIFIC PLAN NO. 90 -1 FOR THE
ANAHEIM HILLS FESTIVAL AND AMENDING RESOLUTION
NOS. 90R -86 AND 90R -87 ACCORDINGLY (AMENDMENT
NO. 2).
WHEREAS, pursuant to the procedures set forth in Chapter
18.93 of the Anaheim Municipal Code, the City Council of the City
of Anaheim has heretofore adopted its Resolution No. 90R -86
approving the Anaheim Hills Festival Specific Plan No. 90 -1 and
Resolution No. 90R -87 approving Zoning and Development Standards
with conditions of approval for Specific Plan No. 90 -1; and
WHEREAS, in connection with adoption of Specific Plan No.
90 -1 (Anaheim Hills Festival), the City Council certified
Supplemental EIR No. 300 and adopted the corresponding Mitigation
Monitoring Program (Attachment C of Resolution No. 90R -86); and
WHEREAS, on July 28, 1992 the City Council amended
Specific Plan No. 90 -1 by approving Resolution No. 92R -160
(amending Resolution Nos. 90R -86 and Resolution No. 90R -87) and
adopting Ordinance No. 5324 (amending Ordinance No. 5110) amending
conditions of approval of the Specific Plan and the Zoning and
Development Standards relating thereto "Amendment No. 1 and
WHEREAS, the applicant has submitted a revised site plan
for Development Area 2 to expand the existing theater (up to 25,000
sq.ft. or 1,500 seats) and to redesignate 20,000 sq.ft. of "home
improvement furnishings" to "general retail" uses which site plan
is attached to this Resolution as Attachment 1 and incorporated
herein as though set forth in full; and
WHEREAS, the applicant has also requested that Condition
No. 9 of Ordinance No. 5110 be amended to permit on- street parking
on Festival Drive;
WHEREAS, Amendment No. 2 to Specific Plan No. 90 -1 does
consider the following:
(1) Expansion (up to 25,000 sq.ft. or 1,500 seats) of the
existing theater, (2) revision of the site plan to redesignate
20,000 sq.ft. of area for general retail uses, (3) construction of
a 35,000 sq.ft. health club and a 10,000 sq.ft. child day care
facility with a 15,000 sq.ft. outdoor play area, subject to
approval of a conditional use permit and (4) amendment of Condition
No. 9 of Ordinance No. 5110 to permit on- street parking on Festival
Drive; and
WHEREAS, on March 17, 1997 the City Planning Commission
did hold a public hearing upon Amendment No. 2 to Specific Plan No.
90 -1, notice of which hearing was given in the manner required by
law; and
WHEREAS, said Commission, after due inspection,
investigation and study made by itself and in its behalf, and after
due consideration of all evidence and reports offered at said
hearing, did adopt its Resolution No. PC97 -28 recommending to the
City Council the adoption of Amendment No. 2 to Specific Plan No.
90 -1 (Anaheim Hills Festival) as specifically shown on the March
17, 1997, staff report to the Planning Commission on file in the
Planning Department and incorporated herein by this reference; and
WHEREAS, the City Council did hold a public hearing upon
Amendment No. 2 to Specific Plan No. 90 -1, notice of which hearing
was given in the manner required by law; and
WHEREAS, the City Council, after due consideration of the
recommendations and findings of the Planning Commission set forth
in Planning Commission Resolution No. PC97 -28, and all evidence,
testimony and reports offered at said hearing does hereby find
thatAmendment No. 2 is consistent with Specific Plan No. 90 -1, and
further finds that:
1. The City Council has reviewed the proposal for
Development Area 2 of Specific Plan No. 90 -1 to (1) expand (up to
25,000 sq.ft. or 1,500 seats) the existing theater, (2) revise the
site plan to redesignate 20,000 sq.ft. of area for general retail
uses, (3) approve a conditional use permit to construct a 35,000
sq.ft. health club and a 10,000 sq.ft. child day care facility with
a 15,000 sq.ft. outdoor play area, (4) amend Condition No. 9 of
Ordinance No. 5110 to permit on- street parking on Festival Drive,
and (5) waive the minimum number of parking spaces on an
irregularly- shaped parcel consisting of approximately 85 acres
located at the southwest corner of Santa Ana Canyon Road and
Roosevelt Road, having approximate frontages of 2,170 feet on the
south side of Santa Ana Canyon Road and 850 feet on the west side
of Roosevelt Road, and further described as The Anaheim Hills
Festival Shopping Center; and does hereby approve the Negative
Declaration upon finding that the declaration reflects the
independent judgement of the lead agency and that it has considered
the Negative Declaration together with any comments received during
the public review process and further finding on the basis of the
initial study and any comments received that there is no
substantial evidence that the project will have a significant
effect on the environment.
2. The property covered by the specific plan has unique
site characteristics including topography, location and
surroundings which will be enhanced by the special land use and
development standards of the specific plan;

3. The specific plan is consistent with the goals and
policies of the General Plan and with the purposes, standards, and
land use guidelines therein;
4. The specific plan results in development of
desirable character which will be compatible with existing and
proposed development in the surrounding neighborhood;
uses; and
5 The specific plan contributes to a balance of land
6 The specific plan respects environmental and
aesthetic resources consistent with economic realities.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that Resolution Nos. 90R -86 and 90R -87, as
previously amended, be, and the same are hereby, amended to (i)
amend Specific Plan No. 90 -1, including but not limited to all
applicable Exhibits thereto, as shown on Attachment 1, which is
incorporated herein by this reference.
BE IT FURTHER RESOLVED, that Resolution Nos. 90R -86 and
90R -87, as amended, be, and the same are hereby, further amended to
revise condition of approval No. 9 to Anaheim Hills Festival
Specific Plan No. 90 -1 as follows:
"9. Prior to issuance of any building permit for the
additional twenty thousand (20,000) square feet of
general retail use in Development Area 2, a modified
striping plan providing for fifty (50) on- street parking
spaces on Festival Drive within the vicinity of the
theater shall be submitted to the City Traffic and
Transportation Manager for his review and approval."
BE IT FURTHER RESOLVED, that Specific Plan No. 90 -1,
including but not limited to all applicable Exhibits thereto, be,
and the same is hereby, amended as shown on Attachment 1.
BE IT FURTHER RESOLVED that, except as expressly amended
herein, Resolution Nos. 90R -86 and 90R -87 and Specific Plan No. 90-
1, as previously amended, shall remain in full force and effect.

THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 1st day of Apri1,1997.
