ORDINANCE NO. 5727
AN ORDINANCE OF THE CITY OF ANAHEIM ADDING
CHAPTER 10.24 TO TITLE 10 OF THE ANAHEIM
MUNICIPAL CODE PERTAINING TO WATER CROSS -
CONNECTIONS AND A CROSS -CONNECTION CONTROL
PROGRAM AND REPEALING EXISTING CHAPTER
10.24 OF TITLE 10 OF THE ANAHEIM MUNICIPAL
CODE.
WHEREAS, the public water systems and the health and
safety of persons would be endangered by the cross -connection of
drinking water systems and non -potable water sources ("cross -
connections"); and
WHEREAS, it is necessary and desirable to eliminate and
prevent cross -connections; and
WHEREAS, the purpose of this ordinance is to:
(1) protect the public water supply against actual or potential
cross -connection by isolating within the water user"s premises
contamination/pollution which may occur because of cross -
connection; (2) eliminate existing cross -connections between
drinking water systems and other sources of water that are not
safe or potable for human consumption; and (3) prohibit and
prevent future cross -connections.
NOW THEREFOR THE CITY COUNCIL OF THE CITY OF ANAHEIM
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1.
That Chapter 10.24 of Title 10 of the Anaheim Municipal
Code be, and the same is hereby, repealed.
SECTION 2.
That new Chapter 10.24 be, and the same is hereby,
added to Title 10 of the Anaheim Municipal Code to read as
follows:
"Chapter 10.24 WATER SYSTEM CROSS -CONNECTIONS
10.24.010 CROSS -CONNECTIONS PROHIBITED
No person, firm, entity, or corporation shall make or
maintain any cross -connection between a public water system, a
private water system, or a consumer's potable water system.
10,24,020 CROSS -CONNECTION DEFINED
"Cross -connection" shall mean any actual or potention
connection or structural arrangement between a public, private or
consumer's potable water system and any other source or system
through which it is possible to introduce into the potable water
system any used water, industrial fluid, gas, or any substance
other that potable water. "Cross -connection" shall include
bypass arrangements, jumper connections, removable sections,
swivel or change -over devises and other devices (temporary or
permanent) through which or because of which backflow can occur.
10.24.030 EXCEPTIONS
The prohibition set forth in Section 10.24.010 shall
not apply to any cross -connection meeting the protection
requirements of Sections 7583 through and including Section 7605
of Title 17 of the California Code of Regulations.
10.24.040 VIOLATIONS A PUBLIC NUISANCE
Any violation of the provisions of this Section shall
constitute a public nuisance. The General Manager of the Public
Utilities Department is authorized to discontinue water service
to any premises on which is located (1) a prohibited cross -
connection or (2) a backflow prevention device which has not been
tested and determined to function properly.
10.24.050 REGULATIONS AUTHORIZED
The General Manager is authorized to promulgate rules
and regulations governing cross -connections and may adopt all or
part of the Manual of Cross -Connection Control as such part or
all of said rules and regulations.
SECTION 3.
SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance of the Code, hereby adopted, be declared for any reason
to be invalid, it is the intent of the Council that it would have
passed all other portions of this ordinance independent of the
elimination herefrom of any such portion as may be declared
invalid.
SECTION 4. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal
of any other ordinance of this City shall in any manner affect
the prosecution for violations of ordinances, which violations
were committed prior to the effective date hereof, nor be
construed as a waiver of any license or penalty or the penal
provisions applicable to any violation thereof. The provisions
of this ordinance, insofar as they are substantially the same as
ordinance provisions previously adopted by the City relating to
the same subject matter, shall be construed as restatements and
continuations, and not as new enactments.
SECTION 5. PENALTY
It shall be unlawful for any person, firm or
corporation to violate any provision or to fail to comply with
any of the requirements of this ordinance. Any person, firm or
corporation violating any provision of this ordinance or failing
to comply with any of its requirements shall be deemed guilty of
a misdemeanor and upon conviction thereof shall be punished by a
fine not exceeding One Thousand Dollars ($1,000.00) or by
imprisonment not exceeding six (6) months, or by both such fine
and imprisonment. Each such person, firm or corporation shall be
deemed guilty of a separate offense for each day during any
portion of which any violation of any of the provisions of this
ordinance is committed, continued or permitted by such person,
firm or corporation, and shall be punishable therefor as provided
for in this ordinance.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 18th day of April
2000.

TITLE 10 OF THE ANAHEIM MUNICIPAL CODE BY
ADDING THERETO A NEW CHAPTER, ENTITLED
"CHAPTER 10.24, QUALIFICATION AND CERTIFICATION
OF PERSONNEL TO INSPECT AND MAINTAIN BACKFLOW
PREVENTION DEVICES,* AND INCLUDING THEREUNDER
SECTIONS 10.24.010 TO 10.24.080, BOTH INCLUSIVE.
THAT: THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND
WHEREAS, Section 500 of the Health and Safety Code and
Section 7032 of the Business and Pro'esslons Code authorizn the
regulation by municipalities of health and sanitary matters; and
WHEREAS, the purity and potability of the water supply
of a mun!clpallty is a matter affecting the health and safety of
said municipality; and
WHEREAS, pursuant to the authority of Section 208 and
Sections 4010 through 4025 of the Health and Safety Code, the
State Department of Public Health hes promulgated Regulations
Relating to Cross -Connections contained in Title17, Chapter V,
Sections 7583 to 7622, both inclusive, of the California Admin-
Istrative Code; and
WHEREAS, Stiction 7.583 of the aforementioned Regulations
Relating to Cross -Connections places upon the water Ourveyor the
primary responsibility of preventing water from unapproved sources,
or any substances, entering the public water supply oystem; and
WHEREAS, the City of Anaheim is a water purveyor; and
WHEREAS, the aforementioned Section 1583 further provides
that the Regulations Relating to Cro!s... Ccnrectlor.s promulgated by
the State Dapa:tment of Publi: Heaitn shall not be construed as
prohibiting local governmental author!tles or water purveyors from
estaDilshing requirements regarding protection of the water supply,
sh 1ch requirements ars more rigid than those. contained in Title 17,
Chapter V, Sections 7583 to 7622, both -inclusive, of the California
Administrative Code; and
WHEREAS, "BaekflowPrevention Devizes' ere devices used
to prevent the contamination of supplies of water for drinking
purposes by any Water or other substance that is not safe or potable
for human consumption; and
WHEREAS, Section 7605 of the aforementioned Regulations
Relating to Cross -Connections imposes a duty upon the water user
on any premise on account of Which backflow prevention devices
are installed to ':ave competent inspections of said devices made
at least once a year; and
WHEREAS, the term 'competent inspections," as used in
the aforementsoned Section 7605, 13 nowhere further defined in
the. St r statutes, ,judicial declsicns, or in the aforementioned
Regulations Relating to Cross-Cenne•:tions contalned in the
California Administrative Code.
