A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AMENDING SPECIFIC PLAN NO. 94-1 FOR THE
NORTHEAST INDUSTRIAL AREA SPECIFIC PLAN AND
AMENDING RESOLUTION NO. 95R-155 ACCORDINGLY.
WHEREAS, pursuant to the procedures set forth in Chapter
18.93 of the Anaheim Municipal Code, on August 22, 1995, the City
Council of the City of Anaheim adopted Resolution No. 95R-155 to
approve Specific Plan No. 94-1, the Northeast Area Specific Plan
for the area described therein ("Specific Plan No. 94-1"} and did
further adopt its Resolution 95R-156 approving Zoning and
Development Standards for Specific Plan No. 94-1; and
WHEREAS, the petitioner has submitted Amendment No. 1 to
the Northeast Area Specific Plan (Anaheim Canyon Business Center)
relating to a 1.82-acre irregularly-shaped property located at the
northwest corner of La Palma Avenue and Hancock Street with
frontages of 500 feet on the north side of La Palma Avenue and 110
feet on the west side of Hancock Street, and further described as
4633 East La Palma Avenue, to change the development area
boundaries for this property from Development Area 5 (Commercial
Area) to Development Area 2 (Expanded Industrial Area), including
proposed amendments to certain exhibits contained in the Specific
Plan document, in order to facilitate future construction of a new
industrial building across the north property line on a larger site
that traverses the two development areas ("Amendment No. 1"); and
WHEREAS, this property consists of four parcels that are
developed with a portion of an industrial building that traverses
two development areas in the Northeast Area Specific Plan, which
four parcels are designated in the Anaheim General Plan Land Use
Element Map for General Commercial land uses; and
WHEREAS, in connection with adoption of Specific Plan No.
94-1, the City Council, acting as Responsible Agency, has
previously adopted Resolution No. 95R-153 approving Environmental
Impact Report No. 317, with a Statement of Findings and Facts and a
Statement of Overriding Considerations, and, pursuant to Section
21081.6 of the Public Resources Code, adopted the Northeast Area
Specific Plan No. 94-1 as the mitigation monitoring program for the
Project, finding that the Northeast Area Specific Plan incorporates
measures to mitigate or avoid significant impacts on the
environment and will itself act as effective mitigation for
potential environmental impacts identified in the final EIR; and
WHEREAS, the City Council has reviewed Amendment No. 1 to
the Northeast Area Specific Plan (Anaheim Canyon Business Center)
on property described as a 1.82-acre irregularly-shaped property
located at the northwest corner of La Palma Avenue and Hancock
Street with frontages of 500 feet on the north side of La Palma
Avenue and 110 feet on the west side of Hancock Street, and further
described as 4633 East La Palma Avenue, to reclassify said property
from Development Area 5 "Commercial Area" of SP 94-1 to Development
Area 2 "Expanded Industrial Area" of SP 94-1, and to amend certain
exhibits in the Specific Plan document accordingly, and does hereby
approve a Negative Declaration upon finding that the declaration
reflects the independent judgement of the lead agency and that it
has considered the Negative Declaration together with any comments
received during the public review process and further finding on
the basis of the initial study and any comments received that there
is no substantial evidence that the project will have a significant
effect on the environment; and
WHEREAS, on March 13, 2000, the City Planning Commission
did hold a public hearing upon Amendment No. 1 to Specific Plan No.
94-1, notice of which hearing was given in the manner required by
law; and
WHEREAS, said Planning Commission, after due inspection,
investigation and study made by itself and in its behalf, and after
due consideration of all evidence and reports offered at said
hearing, did adopt its Resolution No. PC2000-26 recommending to the
City Council the adoption of Amendment No. 1 to Specific Plan No.
94-1 as ~pecifically shown on Attachment A (a copy of which is
available in the Planning Department), which is attached to this
· Resolution and incorporated herein; and
WHEREAS, the City Council did hold a public hearing upon
Amendment No. 1 to Specific Plan No. 94-1, notice of which hearing
was ~iven in the manner required by law; and
WHEREAS, the City Council, after due consideration of the
recormmendations and findings of the Planning Commission set forth
in Planing Conumission Resolution No. PC2000-26, and all evidence,
testimony and reports offered at said hearing does hereby find that
Amendment No. 1 is consistent with Specific Plan No. 94-1, and
further finds and determines:
That Development Area 2 is intended to provide for
increased opportunities for a mix of light industrial and
corporate headquarters research and development uses with
essential support services at strategic locations; and
that the underlying base zone used for land uses and
development standards is ML (Limited Industrial).

That the property proposed for the amendment has unique
site characteristics such as topography, location or
surroundings which are enhanced by special land use and
development standards.
That the proposed amendment is consistent with the goals
and policies of the Anaheim General Plan and with the
purposes, standards, and land use guidelines therein, and
will encourage high quality development compatible with
the surrounding area.
That the proposed amendment will result in development of
desirable character and will contribute to a balance of
land uses, which will be compatible with existing and
proposed development in the surrounding neighborhood.
That the size and shape of the property allows for
adequate development of the site for industrial uses
without negatively impacting adjacent land uses.
That the proposed amendment respects environmental and
aesthetic resources consistent with zoning and
development standards and with economic realities.
That the proposed amendment will encourage the assemblage
of property to provide for a comprehensively planned
project.
WHEREAS, the City Council desires to amend Specific Plan
No. 94-1 to reclassify said property from Development Area 5
"Commercial Area" of Specific Plan No. 94-1 to Development Area 2
"Expanded Industrial Area" of Specific Plan No. 94-1, and to amend
certain exhibits in the Specific Plan document accordingly.
NOW THEREFORE, BE IT RESOLVED, that Resolution No. 95R-
155 adopting Specific Plan No. 94-1, be and the same is hereby
amended to amend the Specific Plan, including but not limited to
Exhibit No. 4 and all applicable Exhibits thereto, as shown on
Attachment A {Amendment No. 1).
BE IT FURTHER RESOLVED that, except as expressly amended
herein, Resolution No. 95R-155 and Specific Plan No. 94-1 shall
remain in full force and effect.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this l~B day of April, 2000.
