AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
VARIOUS SUBSECTIONS OF SECTION 14.32.450 OF CHAPTER
14.32 OF TITLE 14 OF THE ANAHEIM MUNICIPAL CODE
RELATING TO PERMIT PARKING.
THE CITY COUNCIL OF THE CITY OF ANAHEIM HEREBY ORDAINS
AS FOLLOWS:
SECTION 1.
That subsections .030, .040 and .045 of Section 14.32.450 of Chapter 14.32 of Title
14 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows:
".030 The City Chief of Police, which term shall include his or her designee, or such other
person as authorized by the City Council, shall, upon application therefor, issue a parking permit
exempting from the provisions of this section vehicle(s) owned or controlled by any resident or
merchant of property adjacent to the street, or portion thereof, so restricted.
0301 The total number of parking permits issued in a permit parking district or segment
thereof shall be based on consideration of the number of dwelling and/or non-
residential units and the number of on -street parking spaces available on permit
parking district streets, as determined by City Traffic and Transportation Manager,
and shall be subject to the restrictions and conditions in this Section 14.32.450.
(a) Except as set forth in subparagraph .0301 (c), and further subject to
paragraph .0301, the number ofpermits shall not exceed three (3) per legally
established unit.
(b) Each permit shall be specific to a vehicle and shall be installed by an
authorized representative of the Police Department. A new transfer parking
permit may be issued to a replacement vehicle upon payment of the parking
permit transfer fee. Upon issuance of the new permit, the prior permit shall
be terminated and removed from the prior vehicle.
(c) A maximum of 26 one -day guest parking permits per year may be
issued to each such residence or legally established unit upon payment of the
applicable guest permit parking fee, subject to consideration of the number
of available parking spaces, as determined by the Chief of Police.
Notwithstanding the foregoing, more than 26 such one -day guest parking
permits may be approved by the Chief of Police at his or her discretion for
extraordinary events, provided such events are consistent with the use of the
property, the number of available parking spaces, and have obtained any
other permits required by the Anaheim Municipal Code.
.0302 Permit issuance shall require that the applicant provide evidence to establish the
following:
(a) Residency at an address in the Permit Parking district (the "Subject Address);
(b) Current vehicle registration to the applicant at the Subject Address;
(c) Required on -premises parking is available and will be maintained for parking
of vehicles; and
(d) Payment of the applicable parking permit fee.
.0303 No permit (excluding temporary permits) shall be issued for tractor or other trailers,
recreational vehicles or other towable trailers.
.040 Any permit issued by the City pursuant to this section shall be valid for a period of two
years, provided the person to whom the permit is issued owns or controls the property which
ownership or control qualified the person to the permit. Any such permit is nontransferable.
.045 No parking permit shall be issued until the applicant has paid the full cost recovery permit
fee. Each permit, including guest parking permits and transfer parking permits, shall be subject to
the applicable fee. The amount of the permit fees shall be established by resolution of the City
Council."
SECTION 2.
That subsection .070 of Section 14.32.450 of Chapter 14.32 of Title 14 of the
Anaheim Municipal Code be, and the same is hereby, amended to read as follows:
".070 In addition to police officers, police cadets, traffic control officers, City code
enforcement officers and any other persons authorized by State law, persons employed by the City
of Anaheim as security guards, who may be so designated, are hereby authorized and directed to
issue citations to any and all persons violating any of the provisions of this section and such citation
shall be deemed to be a civil complaint charging violations of this title and requiring payment of the
penalty set forth therein. The method of giving notice of citation for unattended vehicles shall be as
specified in Section 40202 of the California Vehicle Code or any successor provision thereto.
Violations of this section shall be processed as civil penalties in accordance with California Vehicle
Code Sections 40200 et seq., or any successor provision thereto."
SECTION 3.
That new subsection .080 be, and the same is hereby, added to Section 14.3 2.450 of
Chapter 14.32 of Title 14 of the Anaheim Municipal Code to read as follows:
".080 Existing Districts. Permit parking districts duly formed and existing on September
1, 2007 shall be permitted to continue as districts. Applications for new permits in such districts shall
be required to comply with requirements of this Section, including the limitations on the maximum
of number of permits per unit. Existing permits in such districts shall expire on September 1, 2009.
Permit holders will be sent written notice of the date of expiration of their existing permits and
information relating to applications for new permits no later than 90 calendar days prior to expiration
of the permits. "
SECTION 4. SEVERABILITY
The City Council of the City of Anaheim hereby declares that should any section,
paragraph, sentence or word of this ordinance of the Code, hereby adopted, be declared for any
reason to be invalid, it is the intent of the Council that it would have passed all other portions of
this ordinance independent of the elimination herefrom of any such portion as may be declared
invalid.
SECTION 5. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal of any other ordinance of this
City shall in any manner affect the prosecution for violations of ordinances, which violations
were committed prior to the effective date hereof, nor be construed as a waiver of any license or
penalty or the penal provisions applicable to any violation thereof. The provisions of this
ordinance, insofar as they are substantially the same as ordinance provisions previously adopted
by the City relating to the same subject matter, shall be construed as restatements and
continuations, and not as new enactments.
SECTION 6. PENALTY
It shall be unlawful for any person, firm or corporation to violate any provision or
to fail to comply with any of the requirements of this ordinance. Any person, firm or corporation
violating any provision of this ordinance or failing to comply with any of its requirements shall
be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not
exceeding One Thousand Dollars ($1,000.00) or by imprisonment not exceeding six (6) months,
or by both such fine and imprisonment. Each such person, firm or corporation shall be deemed
guilty of a separate offense for each day during any portion of which any violation of any of the
provisions of this ordinance is committed, continued or permitted by such person, firm or
corporation, and shall be punishable therefor as provided for in this ordinance.

14 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows:
".030 The City Traffie Engineer Chief of Police, which term shall include his or her
designee, or such other person as authorized by the City Council, shall, upon application therefor, issue
a parking permit exempting from the provisions of this section any -vehicle vehicle(s) owned or
controlled by any resident or merchant of property adjacent to the street, or portion thereof, so

than 30 such one -day guest parking permits may be approved by the
Chief of Police at his or her discretion for any such residence or unit for
extraordinary events, provided such events are consistent with the use of
the property, the number of available parking spaces, and the applicant
has obtained any other permits required by the Anaheim Municipal Code
for such event.
.0302 Permit issuance shall require that the applicant provide evidence to establish the
following:
(a) Residency at an address in the Permit Parking district (the "Subject
Address);
(b) Current vehicle registration to the applicant at the Subject Address;
(c) Required on -premises parking is available and will be maintained for
parking of vehicles; and

applicable fee. The amount of the permit fees shall be established by resolution of the City Council."
SECTION 2.

Municipal Code be, and the same is hereby, amended to read as follows:
