A RESOLUTION OF THE ANAHEIM HOUSING AUTHORITY
APPROVING A PURCHASE AND SALE AGREEMENT WITH
THE STATE OF CALIFORNIA DEPARTMENT OF
TRANSPORTATION
WHEREAS, the Anaheim Housing Authority (the "Housing Authority") and Monarch Pointe LP
(the "Developer") entered into that certain Amended and Restaffed Affordable Housing
Agreement dated as of February 1, 2007 (the "Affordable Housing Agreement")• and
WHEREAS, the Affordable Housing Agreement provides for the development and operation by
Developer of a sixty-three (63) unit multi-family residential ~ornplex (the "Affordable Housing
Project") on approximately two and seven tenths (2.7) acres of real property generally located at
the southwest corner of Chippewa and Crescent Streets in the City of Anaheim (the "Affordable
Housing Site"); and
WHEREAS, the Affordable Housing Agreement provides that all but one (1) of the units in the
Affordable Housing Project are to be rented to Very Low and rower Income Households at
Affordable Rents for not Iess than sixty-five (~5) years; and
WHEREAS, the Affordable Housing Site, identified as a Housing Opportunity Site in the City
of Anaheim's Housing Element, consists of two (2) remnant parcels (each, a "Remnant Parcel
and jointly, the "Remnant Parcels") remaining after the widening of Interstate 5; and
WHEREAS, the larger Remnant Parcel (the "OCTA Remnant Parcel") was acquired from the
Orange County Transportation Authority ("OCTA") by the Anaheim Redevelopment Agency and
transferred to the Housing Authority to be used for the Affordable Housing Project; and
WHEREAS, the State of California Department of Transportation ("Caltrans") owns the other
Kemnant Parcel (the "Caltrans Remnant Parcel''} which Caltrans intends to sell to the Housing
Authority pursuant to that certain Purchase and Sale Agreement -Real Property -DD-001197-O1-
Ol (the "Purchase and Sale Agreement"); and
WHEREAS, the Housing Authority intends to combine the. I?.erranant Parcels to create the
Affordable Housing Site on which Developer will construc;i and operate the .Affordable Housing
Project pursuant to the Affordable Housing Agreement; and
WHEREAS, the Purchase and Sale Agreement requires that t'±~~: Housing Authority adopt a
resolution documenting that the Caltrans Remnant Parcel v~~:~il be used for a public purpose in
accordance Government Code Section 54220, e~ seq.
NOW, THEREFORE, THE GOVERNING BOARD OF THE ANAHEIM HOUSING
AUTHORITY DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. Approval of Purchase and Sale Agreement. The Purchase and Sale Agreement,
a copy of which is on file with the Secretary of the Housing Authority, is hereby approved
(substantially in the form on file) and the Executive Director of the Housing Authority is hereby
authorized and directed to execute and administer the Purchase and Sale Agreement on behalf of
the Housing Authority.
Section 2. Use of Caltrans Remnant Parcel. The Executive Director of the Housing
Authority is hereby directed to combine the Remnant Parcels to provide for the Affordable
Housing Project in accordance with the Affordable Housir_g Agreement.

GOVERNING BOARD OF THE ANAHEIM HOUSING AUTHORITY THIS TWENTY-
