A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AUTHORIZING THE DIRECTOR OF PUBLIC
WORKS TO APPLY FOR MEASURE M2 PROJECT S
(TRANSIT EXTENSIONS TO METROLINK) FUNDING
UNDER ORANGE COUNTY TRANSPORTATION
AUTHORITY
WHEREAS, in May and July 2010, the Orange County Transportation Agency
( "OCTA ") Transportation 2020 Committee reviewed possible funding scenarios and discussed
approaches to develop competitive funding guidelines for Measure M2's Project S (Transit
Extensions to Metrolink); and
WHEREAS, on September 13, 2010, the OCTA Board of Directors approved the
Measure M2 Project S (Transit Extensions to Metrolink) funding guidelines for preliminary
engineering efforts for eligible fixed guideway projects and directed its staff to issue a call for
projects and return to the Transportation 2020 Committee with programming recommendations
on November 15, 2010; and
WHEREAS, Measure M2 Project S (Transit Extensions to Metrolink) is a
competitive transit program (the "Program ") to provide funding to broaden the reach of Orange
County's rail system by developing transit system extensions that will link communities and
activity centers to the backbone services provided by the Metrolink corridor; and
WHEREAS, twenty -five percent (25 %) of the Measure M2 net revenues are
available for development and implementation for a Countywide Transit Program that will
enhance the public transportation system in Orange County; and
WHEREAS, projects must meet specific criteria in order to compete for funding
through this Program; and
proposals; and WHEREAS, OCTA has established the procedures and criteria for reviewing
WHEREAS, the City of Anaheim believes it meets the specific criteria set forth
by OCTA Measure M2 Project S Funding Program Guidelines to receive the funding under this
Program; and
WHEREAS, the City of Anaheim is one of only two cities in Orange County with
eligible fixed guideway projects engaged in Go Local Step 2 efforts; and
WHEREAS, local agencies will be required to demonstrate: the ability to provide
a ten percent (10 %) local match for the preliminary engineering phase costs, a ten percent (10 %)
match requirement for the whole project comprised of any combination of private contributions,
advertising revenues and local discretionary funds; and, the ability to fund the local share of
operations and maintenance on an on -going basis using non -OCTA resources; and
WHEREAS, the City of Anaheim has the ability to provide the ten percent (10 %)
local match requirement and fund the local share of operations and maintenance on an on -going
basis using non -OCTA resources; and
WHEREAS, the ten percent (10 %) local match requirement for the preliminary
engineering phase is anticipated to be funded from Anaheim Tourism Improvement District
(ATID) transit funds and the ten percent (10 %) local match for the whole project is anticipated to
be funded from a combination of federal, state and local sources and private assessments (this
assessment may be in the form of ATID transit funds, a parking assessment, community facilities
district, or some other self - imposed private assessment) determined in cooperation with the
stakeholders; and
WHEREAS, the local share of operations and maintenance is anticipated to be
paid by ticket revenue and private assessment (this assessment may be in the form of ATID
transit funds, a parking assessment, community facilities district, or some other self - imposed
private assessment) determined in cooperation with the stakeholders; and
WHEREAS, by formal action the Anaheim City Council authorizes the Director
of Public Works of the City of Anaheim to act in connection with the application of the Measure
M2 Project S funds and to provide such additional information as may be required; and
WHEREAS, the City of Anaheim will comply where applicable with provisions
of the California Environmental Quality Act, the National Environmental Policy Act, the
American with Disabilities Act, and any other federal, state, and /or local laws, rules and /or
regulations;
NOW, THEREFORE, BE IT RESOLVED that the City of Anaheim hereby
authorizes the Director of Public Works of the City of Anaheim to apply for the Measure M2
Project S funds.
BE IT FURTHER RESOLVED that the City of Anaheim hereby demonstrates
financial commitments for match funding from local sources and for operating and maintenance
funds as shown in the attached funding plan (Attachment 1).
THE FOREGOING RESOLUTION is approved and adopted by the City Council
of the City of Anaheim this 28th day of September , 2010, by the following roll call
vote:
