2000-119RESOLUTION NO. 2000R- 119 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ADOPTING NEW FEE SCHEDULES FOR PLANNING, ZONING AND LAND USE PETITIONS, PERMITS, APPROVALS, APPEALS, AND INSPECTIONS WHEREAS, the Anaheim Municipal Code and State Law authorize the City Council to establish filing fees for the purpose of defraying the costs and expenses to the City of receiving and processing certain petitions and applications for various planning, zoning and other land-use related permits, approvals and inspections, and WHEREAS, those costs and expenses include: labor costs in reviewing and analyzing the applications; postage, materials and labor costs to post and advertise notices of hearings for application; and other direct and indirect costs to the City; and WHEREAS, the City Council has heretofore established the fees authorized by said provisions of the Anaheim Municipal Code and State Law; and WHEREAS, due to increases in the City costs, it is in the public interest and welfare to amend certain fees heretofore established ana to establish certain new fees; and WHEREAS, the proposed fees have been considered at a duly noticed public meeting or hearing as required by law; and WHEREAS, the City Council further finds and determines that this amendment to fees is exempt from the provisions of the California Environmental Quality Act pursuant to Section 21080(b}(8) of the California Public Resources Code in that the fees and rates are established to meet operating expenses, including employee wage rates and fringe benefits and purchasing or leasing supplies, equipment or materials. WHEREAS, the City Council hereby finds that said fees, in the amounts hereinafter set forth, are less than or equal to, but in any event not greater than, the actual direct and indirect costs and expenses incurred by the City in receiving, processing and analyzing said petitions, applications and appeals; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. The fees set forth in the fee schedule attached hereto as Exhibit E shall be, and are hereby, adopted. 2. The fees established herein shall become effective sixty (60) days following the date of adoption of this Resolution. 3. The fees established herein shall, upon the effective date of said fees, supersede any previously adopted fees for the same permit or approval. 4. The City Council hereby declares that should any one or more fees established by this Resolution or any portion of this Resolution be declared for any reason to be invalid, it is the intent of the City Council that it would have adopted all other fees and portions of this Resolution independent of the elimination herefrom of any such fee or such portion as may be declared invalid.
