96-198 RESOLUTION NO. 96R-198 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM HPPROVING THE SECOND COOPERATION HGREEMENT WITH THE ANAHEIM REDEVELOPMENT AGENCY REGAHDING DEVELOPMENT AND FUNDING OF THE DOWNTOWN COMMUNITY CENTER WHEREAS, the Anaheim Redevelopment Agency (the "Agency") is engaged in implementation of the Redevelopment Plan for the Alpha Redevelopment Project area (the 'Project Area"); WHERE~E, in order to provide new and improved cultural, community service, educational and recreational opportunities to residents of the City of Anaheim generally and of the Project Area particularly, the City of Anaheim (the 'City") and the Agency desire to construct the Downtown Community Center on property located at the intersection of Center and Philadelphia Streets (the "Community Center"); WHEREAS, the Community Center will consolidate several existing and new uses, including a Senior Citizen's Center, City Recreation and Human Services Programs, City Gymnasium, Arts Center, and City Boxing Club; WHEREAS, in connection with the Community Center, City and Agency have heretofore entered into that certain Cooperation Agreement Regarding Downtown Community Center dated as of January 10, 1995; WHEREAS, in order to further develop the Community Center (the "Project"), City and Agency propose to enter into that certain Second Cooperation Agreement Regarding Downtown Community Center dated as of December 3, 1996 (the "Second Cooperation Agreement"); WHEREAS, pursuant to the Second Cooperation Agreement, (a) Agency, with funds drawn from its Low and Moderate Income Housing Fund, will prepay (the "Agency Payment") certain City park and recreation fees (the "Park Fees") for future Agency- sponsored affordable housing projects located within the area benefitted by the Community Center, (b) City will pay interest on the Agency Payment, (c) City will hold Park Fees at current levels for five (5) years for such affordable housing projects, and (d) City will allocate the Agency Payment to fund the cost of constructing the Community Center; WHEREAS, Agency contemplates that the prepaid Park Fees will be used to support the development of approximately two hundred (200) affordable housing units within the central Anaheim area; WHEREAS, development of the Community Center will free up the site on which an affordable senior housing project (the "Senior Housing Project") will be developed adjacent to the Community Center and, inasmuch as the Community Center will provide facilities for the use of the residents of the Senior Housing Project, it will also reduce the cost of development of the Senior Housing Project; W~ERR~$, the City freezing, for five (5) years at current levels, Park Fees for Agency-sponsored affordable housing projects will promote the development of affordable housing in the community; WRER~AS, the Community Center will be used by area groups, organizations (such as the Boys and Girls Club) and residents, many of whom are of very low and low or moderate income; and ~ERRAS, in conjunction with the use of federal funds for the Project, City, pursuant to the National Environmental Policy Act, prepared and circulated a Finding of No Significant Impact ("FONSI") for the Project, which FONSI found that, with the inclusion in the Project of certain mitigation measures, the Project would have no significant impact on the environment. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. The City Council finds that the Project is primarily of benefit to the Project Area. 2. The City Council hereby finds that the payment of funds for the acquisition of land and/or the cost of the Community Center will assist in the elimination of one or more blighting conditions inside Redevelopment Project Alpha, and is consistent with the Agency's Implementation Plan adopted pursuant to Health and Safety Code Section 33490. 3. The City Council finds that implementation of the Second Cooperation Agreement and development of the Downtown Community Center will promote Agency's obligation to increase the supply of affordable housing in the community. 4. The Second Cooperation Agreement is hereby approved. 5.
