A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ANAHEIM AMENDING RATES,
RULES AND REGULATIONS FOR THE SALE
AND DISTRIBUTION OF ELECTRICITY AS
ADOPTED BY RESOLUTION NO. 71R-478
AND MOST RECENTLY AMENDED BY
RESOLUTION NO. 95R-207
WHEREAS, the City of Anaheim maintains an electric
generation and distribution system for the furnishing of
electricity to residents and inhabitants of the City of Anaheim
and has adopted Electric Rates, Rules and Regulations for the
sale and distribution of electricity; and
WHEREAS, a Notice of Hearing was published as follows:
On January 22, 1996, notice of the public hearing on
revisions to the electric rates, rules and regulations was
published in the Orange County Register and proof thereof is on
file with the Secretary of the Public Utilities Board; and
WHEREAS, the Public Utilities Board held a public
hearing on February 1, 1996, and evidence was presented in
support of the proposed revisions to the Electric Rates, Rules
and Regulations; and
WHEREAS, the Public Utilities Board considered the
proposal of the Public Utilities Department and has considered
the evidence presented at the public hearing; and,
WHEREAS, the Public Utilities Board has made the
following findings with respect to the need for revisions to the
Electric Rates, Rules and Regulations:
1. Section 1221 of the city Charter provides that utility
rates charged to a class of customers shall be uniform within the
class and shall be based on the cost of service revenue
requirement for the class.
2. It is appropriate to give consideration to both cost of
service and the retail rates of Southern California Edison and
other utilities in setting rate levels.
3. It is appropriate to recognize the benefits the Anaheim
Public Utilities Department will realize through having rates for
commercial and industrial customers remain competitive with those
of Southern California Edison through revision of rates for Rate
14, Rate 19, and Time-of-Use Customers.
4. It is appropriate to unbundle the underground
conversion charge from the electric rates reducing the electric
rates for all classes of customers and create a separate line
item charge on future bills to fund the underground
conversion program.
5. It is appropriate to decrease the Electric Utility
revenue from sales budget by $1.3 million in Fiscal Year
1995/1996 and by $4.0 million in Fiscal Year 1996/1997.
6. It is appropriate to reduce the Electric Utility's
operating expenses by the following amounts:
Purchase power costs $1,900,000
San Juan costs 600,000
Bad debt write-off costs 600,000
Personnel costs 450,000
IPA Debt costs 150,000
Misc. operations costs 300,000
$4,000,000
7. It is appropriate to reduce the transfer to the General
Fund by $52,000 in Fiscal Year 1995/1996 and by $160,000 in
Fiscal Year 1996/1997.
8. It is appropriate to reduce the Right-of-Way Fee by
$19,500 in Fiscal Year 1995/1996 and by $60,000 in Fiscal Year
1996/1997; and
WHEREAS, the Public Utilities Board considered the
California Environmental Quality Act and made the following
finding:
The matters covered in this hearing come within Section
21080(8) of the Public Resources Code of the State of California.
Thus, the establishment of these rates is statutorily exempt from
the California Environmental Quality Act; and
WHEREAS, based on the findings hereinabove made, the
Public Utilitles Board of the City of Anaheim recommended to the
City Council that the Council adopt the findings of the Public
Utilities Board with respect to the matters contained herein and
adopt the changes to the Electric Rates, Rules and Regulations as
shown in Attachment B; and
WHEREAS, based on the finding hereinabove made, the
Public Utilities Board of the city of Anaheim recommended to the
city Council that the Council, by Motion, certify that the
adoption of the Electric Rates, Rules and Regulations is
statutorily exempt under the California Environmental Quality
Act, Public Resource Code, Section 21080(b) (8), in accordance
with Title 14 of the California Administrative Code, Section
15273(a); and
WHEREAS, the City Council has considered the evidence
and concurs with the findings of the Public Utilities Board as
set forth hereinabove.
NOW, THEREFORE BE IT RESOLVED that=
1. The findings of the Public Utilities Board as set forth
herein are hereby adopted by the City Council of the City of
Anaheim.
2. The changes to the Electric Rates, Rules and
Regulations as shown in Attac~ent B are hereby adopted by the
City Council of the City of Anaheim and will become effective
March 1, 1996.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the city of Anaheim this 13th day of

SCHEDULE GS-IBX
GENERAL SERVICE - EXPERIMENTAL
APPLICABILITY
For purposes of business development and retention, applicable to single and three phase general service, including
lighting and power, for production and manufacmnng operations within the City. of Anaheim with 15 kW demand
or greater, but less than 200 kW demand. This schedule is available to customers whose normal production hours
would include the on-peak time periods as specified in the Special Conditions set forth herein and who can
demonstrate to the Public Utilities General Manager that it would be to the customer's economic advantage to
locate operations elsewhere. Eligibility for this schedule is solely at the discretion of the Public Utilities General
Manager and the number of customers on the schedule at any' time may be limited.

SPECIAL CONDITIONS

B. The Facilities charge shall be based on the rated transformer capacity, which shall be 50 percent of the
installed transformer kilovolt-amperes dedicated to the customer, or the highest demand recorded in the
preceding eleven billing periods, whichever is greater, but in no event shall it be less than 15 kW.
C. The Maximum Demand shall be the average kilowatt load to the nearest one-tenth kilowatt during the 15-
minute period of greatest use at any time diuing a rating interval, as recorded by the Department's meter.
In cases where demand is intermittent or subject to severe ilucntations. the Department may establish the
Maximum Demand on the basis of measurement over a shorter interval of time or the kilovolt-amperes of
installed transformer capacity required to meet the customer's load.

all customers whose monthly maxtmum demand has exceeded 200 kW for any three months dunng the preceding
12 months and whose average demand for the preceding 12 months also exceeds 200 kW. Any customer whose
monthly maximum demand has fallen below 200 kW for any three months during the preceding 12 months and
whose average demand for the preceding 12 months also is less than 200 kW may elect to take service on Schedule
GS-1B.

SPECIAL CONDITIONS

B Billing Demand
The billing demand in any month shall be the average kilowatt input indicated or recorded by instruments
to be supplied, owned, and maintained by the City and at the City's expense upon the consumer's promises
adjacent to the watt-hour meter, in the 15 minute interval which the consumption of electric energy is
greater than in any other 15 minute interval in the month, but not less than either (1) 50% of the
contracted for or connected load, or (2) 50% of the highest billing demand in the preceding eleven
months, whichever is the greater. However, in no case shall the billing demand be less than 200 kW.
Billing demand shall be determined to the nearest kW. Whenever the measured maremum demand has
exceeded 400 kW for three consecutive months and thereafter until it has fallen below 300 kW for 12
consecutive months, a 30 minute interval will be used. Where the demand is intermittent or subjected to
violent fluctuations, the mayamum demand may be based on a shorter interval.

A. Area lighting service will be furnished from dusk to dawn, approximately 4,140 hours per year, by
utility-owned lunnnaires supphed from the utility's existing 120/240 volt overhead circuits and mounted
on existing utility-owned wood poles as standard equipment. Where the service requested required the
installation of additional new wood poles, not more than one new wood pole will be installed for each
luminaire in the installation.
B. Where the customer requests the installation of other than the standard equipment furnished by. the utility
and such requested equipment is acceptable to the utility, the utility will install the requested equipment
provided the customer agrees to advance the estimated difference in cost installed between such equipment
and standard equipment. Advances made for this purpose will not be refunded. Facilities installed in
connection with such agreements become and reinran the sole propony of the utility.

RULE NO. 20
REPLACEMENT OF OVERHEAD WITH UNDERGROUND DISTRIBUTION
AND TRANSMISSION FACILITIES UP TO 69kV
A. The Utility will, at its expense, replace its existing overhead distribution and transmission facilities with
underground distribution and transmission facilities up to 69kV along public streets and roads, and on
public lands and private property across wluch rights-of-way satisfactory to the Utility have been obtained
or may be obtained without cost of condemnation, by the Utility, provided that:
1. The City Council of the City of Anaheim in which such distribution and transmission facilities
up to 69kV are and will be located has:
a. Determined, after cousulmfion with the Utility and after holding public hearings on the
subject, that such undergrounding is in the general public interest for one or more of the
following reasons:
(1) Such undergrounding will avoid or eliminate heavy concentration of overhead
distribution and transmission facilities up to 69kV;
(2) Said ~eet or road or fight-of-way is extensively used by the general public and
cames a heavy. volume of pedestrian or vehicular traffic;
(3) Said street or road or right-of-way adjoins or passes through a civic area or
public recreation area or an area of unusual scenic interest to the general
public.
b. Adopted a resolution creating an underground district in the area in which both the
existing and new facihfies are and will be located requiring, among other things, (1) that
all existing overhead communication, electric distribution and transmission facilities up
to 69kV and CATV in such district shall be removed, and (2) that property owners
served from such elecmc overhead distribution facilities shall, in accordance with the
Utility's rules for underground service, make all elecmcal facility changes on their
premises necessa~ to receive service from the underground facilities of the Utility as
soon as it is available, and (3) that the Utility is authorized to discontinue its overhead
2. The Utility will pay for no more than 100 feet of the customer's underground service lateral. For
v customers that require more than 100 feet of service lateral the Utility will make an evaluation
and the Public Utilities General Manager may at his discretion authorize the additional cost of
undergrounding such semce lateral.

3. The City Council has approved funding of the Underground Conversion Program through a
4.0% surcharge on electric revenues. These funds shall be maintained in a separate account
and this charge shall appear as a line item on the customers' bills [when the billing system
can accommodate this chan~e.I The annual budgeted amount for undergrounding within the
City of Anaheim may be allocated by the City Council upon recommendation of the Public
Utilities General Manager.
4. The undergrounding extends for a minimum distance of one block or 600 feet, whichever is the
lesser.
B. In circumstances other than those covered by A. above, the Utility will replace its existing overhead
distribution and transmission facilities up to 69kV with underground facilities along public streets, roads
,,_. or other locations mutually agreed upon when requested by an applicant or applicants where all of the
following conditions are met:
1. a. All property owners served from the overhead facilities to be removed first agree in
writing to perform the wiring changes on their premises so that service may be furnished
from the underground distribution system in accordance with the Utility's rules and that
the Utility may discontinue its overhead service upon completion of the underground
facilities, or
b. Suitable legislation is in effect requiring such property owners to make such necessary
wiring changes and authorizing the Utility to discontinue its overhead service.
2. The applicant has:
a. Furnished and installed the pads and vatfits for transformers and associated equipment,
conduits, ducts, boxes, pole bases and performed other work related to structures and
substructures including breaking of pavement, trenching, backfilling, and repaving
required in connection with the installation of the underground system, all in accordance
with Utility's specifications, or, in lieu thereof, paid the Utility to do so; and
v b. Transferred ownership of such facilities, in good condition, to the Utility; and

3. The area to be undergrounded includes both sides of a street for at least one block or 600 feet,
whichever is the lesser, and all existing overhead communication and elecmc distribution and
transmission facilities up to 69kV within the area will be removed.
C. In circumstances other than those covered by A. or B. above, where mutually agreed upon by the Utility.
and an applicant, overhead distribution and transmission facilities up to 69kV may be replaced with
underground facilities, provided the applicant requesting the change pays, in advance, a nonrefundable
sum equal to the estimated cost of the underground facilities less the estimated net salvage value and
y depreciation of the replaced overhead facilities. Underground services will be installed and maintained as
provided in the Utility's rules applicable thereto.
D. The term "underground distribution system" means an electric distribution system with all cables installed
underground except those conductors in snrface-moanted equipmere enclosures.
E. The term "underground transmission system" means a transmission system up to 69kV with all cables
installed underground except those conductors in surface-mounted equipment enclosnres~
