A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ANAHEIM APPROVING
AN AMENDMENT TO SPECIFIC PLAN NO.
87-1 AND THE ZONING AND DEVELOP-
MENT STANDARDS RELATING THERETO
WHEREAS, the Anaheim City Council approved Specific
Plan No. 87-1 (The Highlands at Anaheim Hills Specific Plan) on
August 25, 1987, to provide for development of a total of 816
acres to include up to 2,147 residential units, 8 acres of
commercial uses, a park site, an 8-acre elementary school and 292
acres of open space; and
WHEREAS, The Highlands at Anaheim Hills Specific Plan
was subsequently amended in July of 1992; and
WHEREAS, Development Area 8 of the The Highlands at
Anaheim Hills Specific Plan is currently designated for
development as General Commercial; and
WHEREAS, the petitioner proposes to redesignate
Development Area 8 from General Commercial to residential land
uses to allow development of up to thirty two condominium units,
thereby increasing the total number of permitted dwelling units
in the Specific Plan from 2,147 to 2,168 units; and
WHEREAS, the petitioner also proposes to amend
Subsection .070 "Development Area 8" of Section 18.70.060
"Development Standards" of the Anaheim Municipal Code, to
establish standards similar to the RM-3000(SC) Residential,
Multiple Family, Scenic Corridor Overlay Zone with certain
exceptions.
WHEREAS, the City Council did hold a public hearing
upon said application on October 17, 1995, notice of which
hearing was given in the manner required by law; and
WHEREAS, the City Council, after due consideration of
all evidence, testimony and reports offered at said public
hearing does hereby find with respect to said proposed amendment
that:
1. The property covered by the specific plan has unique
site characteristics including topography, location and
surroundings which will be enhanced by the special land use and
developments standards of the specific plan;
2. The plan is consistent with the goals and policies of
the General Plan and with the purposes, standards and land use
guidelines therein;
3. The specific plan will result in development of a
desirable character which will be compatible with existing and
proposed development in the surrounding area;
4. The specific plan contributes to a balance of land
uses; and
5. The specific plan respects environmental and aesthetic
resources consistent of economic realities.
NOW, THEREFORE, BE IT RESOLVED that the City Council
does hereby approve amendments to Specific Plan No. 87-1,
consisting of revised Exhibits 5, 14 and 23 changing the land use
designation for Development Area 8 from General Commercial to
single family residential (attached) and revising the Development
Standards for Development Area 8, as set forth herein, upon the
conditions set forth in the ordinance amending said Specific Plan
which conditions are hereby found to be a necessary prerequisite
to the proposed use of the subject property in order to preserve
the safety and general welfare of the citizens of the City of
Anaheim.
BE IT FURTHER RESOLVED that approval of this
application constitutes approval of the proposed request only to
the extent that it complies with the Anaheim Municipal Zoning
Code and any other applicable City, State and Federal regu-
lations. Approval does not include any action or findings as to
compliance or approval of the request regarding any other app-
licable ordinance, regulation or requirement.
BE IT FURTHER RESOLVED that the final approval of the
amendment to Specific Plan No. SP 87-1 is contingent upon, and
shall not take effect, until the City Council shall adopt an
ordinance amending said Specific Plan No. SP 87-1.
BE IT FURTHER RESOLVED that, except as expressly
amended herein, Specific Plan No. 87-1, as heretofore adopted,
shall remain in full force and effect.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 14th day of November,
