A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
AMENDING RATES, RULES AND REGULATIONS FOR THE SALE AND
DISTRIBUTION OF ELECTRICITY AND WATER AS ADOPTED BY
RESOLUTIONS NOS. 71-478 AND 72-600 AND MOST RECENTLY
AMENDED BY RESOLUTIONS NOS. 95-4 AND 93-195.
WHEREAS, the City of Anaheim (Anaheim) maintains electric
generation and distribution systems and a water transmission and
distribution system for the distribution of electricity and water
to residents and inhabitants of Anaheim and has adopted Rates,
Rules and Regulations for the sale and distribution of
electricity and water; and
WHEREAS, the Anaheim Municipal Code authorizes the City
Council to approve reasonable Rates, Rules and Regulations
governing water and electric service and fees for providing water
and electric services; and
WHEREAS, these fees shall be based on the actual costs of
providing water and electric services including labor costs and
other direct and indirect costs to Anaheim; and
WHEREAS, the City Council has previously established some of
the fees authorized by the Anaheim Municipal Code; and
WHEREAS, due to increases in Anaheim's costs it is in the
public interest and welfare to establish fees heretofore
authorized but not established a~d to amend other fees heretofore
established; and
WHEREAS, due to a review and analysis of actual costs to
provide water and electric services it is appropriate to
establish or increase such fees;
WHEREAS, the City Council hereby finds that said fees, in
the amounts hereinafter set forth, are less than or equal to, but
in any event not greater than, the actual direct and indirect
costs and expenses incurred by Ehe City in providing the related
water and electric services; and
WHEREAS, text revisions to the Electric and Water Rates,
Rules and Regulations are necessary to clarify applicability of
the Rates, Rules and Regulations.
WHEREAS, the City Council further finds and determines that
this, establishment of and amendment to fees is exempt from the
California Environmental Quali~y Act pursuant to Section
21080(b) (8) of the California Public Resources Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim as follows:
1. The changes and additions to the Water and Electric
Rates, Rules and Regulations as set forth in Appendix A shall be,
and are hereby, adopted and shall be effective July 3, 1995.
2. The fees established and/or amended herein shall, upon
effectiveness, supersede any previously adopted fees for the same
water and/or electric services.
3. The City Council hereby declares that should any one or
more fees established by this Resolution or any portion of this
Resolution be declared for any reason to be invalid, it is the
intent of the City Council that it would have adopted all other
fees and portions of this Resolution independent of the
elimination herefrom of any such fees or portion as may be
declared invalid.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this20day of June, 1995.

4. Pro rata computation.
All bills for electric service rendered will be computed in accordance with the applicable thirty-day
rate schedule, but the size of the energy blocks and the amount of the customer, service, demand or
minimum charge, specified therein, will be prorated on the basis of the ratio of the number of days
service has been rendered to the number of days in an average month of thirty days.
B. READINGS OF SEPARATE METERS NOT COMBINED
1. Where combinations of meter readings are specifically provided for in the tariff schedules.
2. Where the Utility's operating convenience requires the use of more than one meter.
C. PAYMENT OF BILLS
1. All bills are due upon receipt. Payment shall be made at the City of Anaheim, Division of
Collections.
2. Bills for connection or reconnection of service and payments for deposits or to reinstate deposits as
required under the rules of the Utility shall be paid before service will be connected or reconnected.
D. RETURNED CHECK CHARGE
The Utility may require payment of a returned check charge equal to that permitted under the City of
Anaheim Municipal code for any check returned from the bank unpaid.
E. FUND VERIFICATION FEE
1. The Utility may require a fund verification fee if the utility deems it necessary to verify that the
customer has sufficient funds in their bank when a customer, who is paying their account with a
personal check, has been disconnected for non-payment of service or has a history of non-sufficient
funds.

2. The Utility shall not be responsible for any loss or damage occasioned or caused by the negligence,
want of proper care or wrongful act of the customer or of any of his agents, employees, or licensees
on the part of the customer in installing, maintaining, using, operating, or interfering with any such
wires, lines, machinery or apparatus.
H. RIGHT OF ACCESS
~ 1. The Utility shall, at all times, have the right of ingress to and egress from a customer's premises
at all reasonable hours for any purposes reasonably connected with the furnishing of electric energy
and the exercise of any and all right secured to it by law or these rules.
2. The Utility shall require that each customer furnish the Utility, at the expense of the customer and
in the appropriate quantity as specified by the Utility, with the appropriate devices to gain access
to a customer's premises by way of keys, gate opener/clickers or a personal escort.
3. The Utility may charge a meter reading fee if the Utility cannot gain access to the customer's
metering equipment on the scheduled read date.

IL COMMERCIAL/INDUSTRIAL SERVICE FEES
Applicants requesting new commercial/industrial service shall pay, before start of construction, the
following charges:
I. $1,400for an underground service fed from an existing overhead transformer.
2. $1,700for an underground service fed from an existing overhead padmount transformer.
32-. $1,900for an underground service fed from a new overhead transformer.
4. $2,000for an underground service fed from an upgraded padmount transformer at an existing
location.
5~-.$4,032for an underground service fed from a new padmount transformer.
ENGINEERING FEE FOR REDESIGN
If a contractor/builder/developer requests the Utility to revise, redesign, or change the Electrical
Utility system design for a project after final approval by the Planning Commission, and such t'exluest
requires duplication of engineering effort and a reassignment of priorities to accommodate his
construction schedule, a fee shall be charged.
IV. TEMPORARY POWER AND SERVICE CHARGES
Applicants requesting temporary electrical service shall pay, before start of tunstraction, the
following charges:
A. Single phase meter & overhead service $260.00
B. Span of single phase, three-wire secondary, phis meter & service $710.00
C. Single phase overhead transformer plus meter & service $1,750.00
D. Single phase underground meter & service using existing connections at pull box $150.00
E. Single phase service from new overhead transformer $3,500.00
F. Three phase service from new overhead transformer $3,500.00
G. Three phase service new padmount transformer $6,250.00

VI. REIMBURSEMENT FOR ACCESS REQUEST EVALUATION COSTS
A. The Electric Utility shall charge a fee equal to all costs incurred to evaluate infrastructure
access requests, including but not limited to direct City labor (plus a standard fifteen percent
overhead), contracted labor, materials, equipment rental and usage, and documentation costs.
These fees shall be payable to disposition of any access request.

b. When the total period of service is less than 30 days, no prorations will be made, and the bill shall
not be less than the monthly minimum.

4. Primary Distribution Mains
a. Primary Distribution Mains which supply water to all areas of the
system shall be paid for by acreage fees assessed on all properties
in the system except those properties excluded in (1) above. The
fees will be based upon gross acreage served by domestic water
service and/or fire protection, and will be due prior to signature
approval of the final water improvement plans by the Water
Engineering Manager. This does not apply to application for
temporary or agricultural irrigation service. The water main
extension fees shall be $2,225.00 per acre.
The above fees will be calculated to the nearest one hundredth
{.01) acre, however the minimum fee shall be $100.00
Public-owned facilities such as freeways, flood control channels,
and water spreading basins may not be required to pay the water
main extension fees if water service for these properties is not
required. If a portion of these facilities require water service,
the water main extension fees shall be paid on that portion
requiring service.
b. When a Primary Distribution Main must be extended to a new
subdivision or development, the Utility will extend the main up to
five hundred (500) feet. If an extension greater than 500 feet is
required, the developer will pay for the extension that is in
excess of 500 feet, in addition to the normal water main extension
fees. The developer's portion of the cost shall be reimbursed to
him without interest as acreage fees are collected from others
connecting to the extended main within a refund area designated by
the Utility at the time the advance is made. The reimbursement
agreement shall be in effect for a period of ten (10) years. In no
case shall the reimbursement exceed the developer's cost of the
extension.

7. Rights-Of-Way
All rights-of-way required by the Water Utility for operation and
maintenance of the secondary water system, which are not a part of the
recorded tract or parcel map, shall be due prior to signature approval
of the Water System Improvement Plans by the Water Engineering Manager.
All rights-of-way shall be offered to the City of Anaheim in a form
acceptable to the City's Real Property Section, City Engineer's Office,
and shall consist of an irrevocable offer, a legal description of the
parcel, a plot plan and a current title report showing the legal owner
of the property offering the dedication to the City.
~ 8. Fees
The Water Utility shall charge a fee for all labor required by Utility
personnel in support of plan checking, right-of-way acquisition,
inspection and field valve programs which are directly related to the
plan review, construction and acquisition of the Secondary System.
Plan check fees shall be due concurrently with the initial submittal of
plans to the Water Utility for review.
Right-of-way, inspection and field valve program fees shall be due
prior to signature approval of the water system improvement plans by
the Water Engineering Manager.
Fees for Utility Labor are hereby established as follows:
a. Plan Check Fee: Four Eundrcd Ten Dollars (~10.00) Five Hundred,
Ninety Dollars ($590.00) plus Forty Onc Fifty-Nine Cents ($0.~!
$0.59) per linear foot of pipe in excess of five hundred (500')
feet.
b. Construction Inspection Fee: Four Hund=cd Twenty Dollars ($420.00
Five Hundred, Forty ($540.00) plus Forty Two Fifty-Eight Cents
($0.4~ 58) per linear foot of pipe in excess of five hundred (500')
feet, plus Fifty Ninety Dollars ($50.00 $90.00) per service
connection when large meters and services are included on the main
extension improvement plans, plus ten dollars ($10.00) per small
meter set.

SERVICE CONNECTIONS, METERS AND CUSTOMERS' FACILITIES
A. GENERAL
1. For all services, other than those where the developer is installing the main, the Utility shall furnish
and install the service connection, and meter box, and meter after application is made and all
applicable fees are paid.
2. In new subdivisions, and in other cases where the developer installs the mains, the developer shall
furnish and install the service connection a.':-a meter box, and the Utility shall furnish and install the
meter.
3. The service connection, meter, and meter box will generally be installed at a convenient location
between the curb or edge of pavement and the property line. If it is considered impractical to install
the facilities in this location, they may be installed upon the customer's premises, n which case an
easement will be required.

b. Request for such services shall be made to the Public Utilities
Department, Water Engineering Division.
A fee of ~ $695.00 per application, plus $5~.~ $90.00 for
each additional service connection, when processed as part of a
single application shall be required to cover the cost of plan
check and inspection.
A fee of $170.00 per application, plus $60.00 for each additional
service connection, when processed as part of a single application
shall be required to cover the cost of the field valve program.
For services installed on private property an additional fee of
$3~.~0 $345.00 shall be required to cover the cost of processing a
public utility easement.
c. All installations in the public right-of-way will require a Public
Right-of-Way Excavation and Construction Permit as issued by the
City of Anaheim's Engineering Department, together with appropriate
fees, deposits and insurances.
8. 10. Increase in existing service and/or meter size.
In the event a customer is required or requests a larger service,
connection and/or meter for his property, the fees as stated in
Sections 3 and 5 above will apply.

4. Whenever backflow protective devices are installed, the customer shall have competent inspections
made thereof at least once a year, or more often in those instances where successive inspections
indicate repeated failure thereof. These devices shall be repaired, overhauled or replaced at the
expense of the customer whenever they are found to be defective. Records of such tests, repairs and
overhaul shall be kept and made available to the Utility and the Public health agency having
jurisdiction.
5. Refusal to Serve or discontinuance of Service for Failure to Install Protective Devices.
The Utility may refuse or discontinue service until there has been installed on the customer's piping
approved devices of the required type to protect against backflow of water from the customer's
premises into the Utility's system.
G. RIGHT OF ACCESS
1. The Utility shall, at all times, have the right of ingress to and egress from customer's premises at
all reasonable hours for any purposes reasonably connected with the furnishing of water services
and exercise of any and all right secured to it by law or these rules.
2. The Utility shall require that each customer furnish the Utility, at the expense of the customer and
in the appropriate quantity as specified by the Utility, with the appropriate devices to gain access
to a customer's premises by way of key gate opener/dickers or a personal escort.
3. The Utility may charge a meter reading fee if the Utility cannot gain access to the customer's
metering equipment on the scheduled read date.
Rule No. 21 contains the above referenced charges.

FIRE PROTECTION
A. PRIVATE FIRE PROTECTION
1. Private fire protection services will be provided under the conditions
specified in RULE NO. 16, "Service Connections, Meters, and Customers'
Facilities."
2. The rates for private fire protection services are specified in RATE
SCHEDULE W-PFL, "Private Fire Line Service."
3. When a fireline service is provided to a building for an automatic
sprinkling system, it shall be the option of the property owner to be
responsible for the monthly service charges or to require the tenant of
the property to be responsible. In either case, it is the
responsibility of the property owner to notify the Utilities Department.
In the event the building is vacant and/or not leased, the property
owner shall be responsible for the monthly service charges for the
fireline.
A flow test witness fee of $60.00 per location shall be charged for each
location for the cost of Utility Field Personnel to witness a flow test
conducted by a private consultant for a property owner or developer.
B. PUBLIC FIRE PROTECTION
1. The location of all public fire hydrants shall be determined by the
Utility and the City of Anaheim Fire Department.
2. Where public fire hydrants are installed on Primary Distribution Mains,
the cost for these hydrants shall be borne by the property benefiting
from these hydrants according to the following rules:
a. Where hydrants of standard spacing are installed on one side of a
right-of-way to serve both sides of a right-of-way, there shall be
a front footage charge of $3.50 per foot on property which fronts
this right-of-way. Street intersections shall not be included in
the calculation of the fees, however, corner lots will be required
to pay the appropriate charges on each side of a lot.
b. Where hydrants of standard spacing are installed on both sides of
a right-of-way, the front footage charge shall be $7.00 per foot.
Street intersection and corner lots shall be treated as outlined in
(a.) above.
c. Where hydrants of standard spacing are installed to serve only one
side of a right-of-way, the front footage charge shall be $7.00 per
foot.
d. The above fees are due at the time application for water service,
other than temporary, is made or the property is developed.
