95-095 RESOLUTION NO. 95R-95 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING SPECIFIC PLAN NO. 92-1 FOR THE DISNEYLAND RESORT AND AMENDING RESOLUTION NOS. 93R-146 AND 93R-147 ACCORDINGLY (AMENDMENT NO. 2). WHEREAS, pursuant to the procedures set forth in Chapter 18.93 of the Anaheim Municipal Code, the City Council of the City of Anaheim has heretofore adopted its Resolution No. 93R-146 approving The Disneyland Resort Specific Plan No. 92-1 and Resolution No. 93R-147 approving Zoning and Development Standards with conditions of approval for Specific Plan No. 92-1; and WHEREAS, in connection with adoption of Specific Plan No. 92-1 (The Disneyland Resort), the City Council adopted Resolution No. 93R-107 certifying Environmental Impact Report No. 311, with a Statement of Overriding Considerations, and adopting Mitigation Monitoring Program No. 0067; and WHEREAS, on April 12, 1994, the City Council amended Specific Plan No. 92-1 by approving Resolution No. 94R-41 (amending Resolution Nos. 93R-146 and Resolution No. 93R-147) and adopting Ordinance No. 5420 (amending Ordinance Nos. 5377 and 5378) ("Amendment No. 1") to (i) add a fifth planning district named District A (Development Area 5) consisting of approximately 9 acres located at the southeast corner of Freedman Way and Harbor Boulevard; and (ii) add Section 18.78.095 "Land Use and Site Development Standards-District A" to Chapter 18.78 "Specific Plan No. 92-1" of the Anaheim Municipal Code. WHEREAS, pursuant to Chapter 18.93 of the Anaheim Municipal Code, Melodyland Christian Center, Inc. filed a petition to amend Specific Plan No. 92-1 to include property located at 400 West Freedman Way (the "Property") in District A of the Disneyland Resort Specific Plan, thereby eliminating parking and transportation facilities as primary uses for the subject property; and WHEREAS, the Property consists of approximately 9.86 acres with a frontage of approximately 630 feet on the south side of Freedman Way, a maximum depth of approximately 900 feet, and located approximately 260 feet west of the centerline of Clementine Street, more particularly described in Attachment A to this resolution, which is incorporated herein; and WHEREAS, Amendment No. 2 to Specific Plan No. 92-1 does consider the following: 1. Redesignation of the Property from the Parking District (Development Area 3a) of The Disneyland Resort Specific Plan to District A (Development Area 5), and removal of District A acreage from the C-R Overlay and the East Parking Area Option, thereby removing parking and transportation facilities as a permitted use in the subject property. District A allows development of permitted and conditionally permitted uses allowed in Specific Plan 92-2 "Anaheim Resort" (which supersedes the C-R Zone) as set forth in Chapter 18.48 of the Anaheim Municipal Code, as it currently exists or may be amended or superseded in the future, which revisions would be consistent with existing provisions for the C-R Overlay of the Disneyland Resort; and 2. Revisions to text and exhibits in The Disneyland Resort Specific Plan document, to Chapter 18.78 "Specific Plan No. 92-1," and to the Conditions of Approval to reflect the addition of the subject property to District A and revisions to the Specific Plan associated therewith. WHEREAS, on May 15, 1995, the City Planning Commission did hold a public hearing upon Amendment No. 2 to Specific Plan No. 92-1, notice of which hearing was given in the manner required by law; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. PC95-51 recommending to the City Council the adoption of Amendment No. 2 to Specific Plan No. 92-1 and amendment of Chapter 18.78 Specific Plan No. 92-1 Zoning and Development Standards (The Disneyland Resort) as specifically shown on Attachment B of the May 15, 1995, staff report to the Planning Commission on file in the Planning Department and incorporated herein by this reference ("Attachment B"); and WHEREAS, the City Council did hold a public hearing upon Amendment No. 2 to Specific Plan No. 92-1, notice of which hearing was given in the manner required by law; and WHEREAS, the City Council, after due consideration of the recommendations and findings of the Planning Commission set forth in Planing Commission Resolution No. PC95-51, and all evidence, testimony and reports offered at said hearing does hereby find that Amendment No. 2 is consistent with Specific Plan No. 92-1, and further finds that: 1. There is no evidence that Amendment No. 2 to Specific Plan No. 92-1 would result in any additional environmental effects and no evidence of any new information or any circumstances requiring any additional review pursuant to the California Environmental Quality Act beyond the analysis and consideration of The Disneyland Resort Project in Final Environmental Impact Report No. 311 with the Statement of Findings and Facts and Statement of Overriding Considerations and the corresponding Mitigation 2 Monitoring Program No. 0067, certified and adopted on June 22, 1993, and further finds that previously certified EIR No. 311 is adequate to serve as the required environmental documentation for the proposed amendment; 2. The property covered by the specific plan has unique site characteristics including topography, location and surroundings which will be enhanced by the special land use and development standards of the specific plan; 3. The specific plan is consistent with the goals and policies of the General Plan and with the purposes, standards, and land use guidelines therein; 4. The specific plan results in development of desirable character which will be compatible with existing and proposed development in the surrounding neighborhood; 5. The specific plan contributes to a balance of land uses; and 6. The specific plan respects environmental and aesthetic resources consistent with economic realities. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Resolution Nos. 93R-107 and 93R-146, as previously amended, be, and the same are hereby, amended to (i) redesignate the Property from Parking District (Development Area 3a) to District A (Development Area 5), and (ii) amend Specific Plan No. 92-1, including but not limited to all applicable Exhibits thereto, as shown on Attachment B, which is incorporated herein by this reference. BE IT FURTHER RESOLVED, that Resolution Nos. 93R-147 and No. 93R-148, as amended, be, and the same are hereby, further amended to revise and delete conditions of approval to the Disneyland Resort Specific Plan No. 92-1 as follows: A. Amend Condition No. 27 to read: "That no development shall occur unless such development is substantially in accordance with the Disneyland Resort Specific Plan No. 92-1, Amendment No. 2, document on file with the Planning Department and marked Exhibit A, Amendment No. 2." B. Amend Condition No. 70 to read: "That development within District A shall be in compliance with the Conditions of Approval set forth in Ordinance No. 5377, as amended and the mitigation measures set forth in the adopted Mitigation 3 Monitoring Program No. 0067, as it may be amended from time to time." C. Delete condition Nos. 65, 66 and 68 in their entirety. 3. That Specific Plan No. 92-1, including but not limited to all applicable Exhibits thereto, be, and the same is hereby, amended as shown on Attachment B. BE IT FURTHER RESOLVED that, except as expressly amended herein, Resolution Nos. 93R-146 and 93R-147 and Specific Plan No. 92-1, as previously amended, shall remain in full force and effect.
